HomeMy WebLinkAbout11/17/2016 (2) Town. of Los Altos Hills City Council Regular Meeting Minutes Thursday, November 17, 2016 Council Chambers, 26379 Fremont Road, Los Altos Hills, California Mayor Harpootlian called the meeting to order at 6:05 p.m. CALL TO ORDER(6:00 P.M.) A. Roll Call Present: Mayor Harpootlian,Vice Mayor Waldeck(arrived at 9:55 p.m.) Councilmember Corrigan, Councilmember Radford, Councilmember Spreen Absent: None Staff: City Manager Carl Cahill, City Attorney Steve Mattas, Planning Director Suzanne Avila, Public Works Director/City Engineer Allen Chen, Administrative Services Director Pak Lin, Senior Planner Marni Moseley, Assistant Planer Genevieve Fernandez, City Clerk Deborah Padovan B. Pledge of Allegiance Mayor Harpootlian provided an update on the status of the election. Vice Mayor Waldeck was at a Select Committee on South Bay Arrivals meeting in San Jose and, after completion of that meeting, will join the Council meeting. 1. AGENDA REVIEW Mayor Harpootlian said that Vice Mayor Waldeck has forwarded a request for items 2.D and 6.A to be held until he arrives at the meeting. There was Council consensus to have Vice Mayor Waldeck participate in the Pathways Committee appointments. The Council agreed to interview the applicants for the Pathways Committee,but not take a vote until the next City Council meeting. Agenda Item 6.A was tabled to the December City Council meeting. Mayor Harpootlian said that Item 2.E would be heard before Item 2.D. The Mayor further suggested that Items 4.M and 4.0 be voted on immediately following the presentation from Silicon Valley Clean Energy Authority. There were no other changes to the agenda. 1 City Council Regular Meeting Minutes November 17,2016 2. PRESENTATIONS AND.APPOINTMENTS A. Presentation on the Status of the Silicon Valley Clean Energy Authority by CEO Tom Habashi Tom Habashi, CEO of Silicon Valley Clean Energy Authority provided a report on the activities of the authority, including the work that has been accomplished in the first six months of the authority's formation. Mr. Habashi explained items 4.M and 4.0. The Council now considered Consent Calendar Items 4.M and 4.0. M. Resolution to Subordinate Silicon Valley Clean Energy Authority's Payment Obligations for Initial Contribution made by Los Altos Hills to the Debt Obligation Payment to River City Bank(Silicon Valley Clean Energy Authority) MOTION MADE.AND SECONDED: Councilmember Spreen moved to approve Resolution 83-16 to Subordinate Silicon Valley Clean Energy Authority's Payment Obligations for Initial Contribution made by Los Altos Hills to the Debt Obligation Payment to River City Bank(Silicon Valley Clean Energy Authority). The motion was seconded by Councilmember Radford. Motion Carried 4-0-1: AYES: Mayor Harpootlian, Councilmember Corrigan, Councilmember Radford, Councilmember Spreen NOES: None ABSENT: Vice Mayor Waldeck ABSTAIN: None 0. Resolution to opt into Silicon Valley Clean Energy's Green Prime Product to Serve Electricityto all Town Facilities on a Launch Date Scheduled for April 2017 (Silicon Valley Clean Energy Authority) Councilmember Corrigan asked for clarification on the Town's commitment if the resolution is approved and is the Town the first city to commit. Mr. Habashi confirmed that the City of Campbell has agreed and that Mountain View has budgetedfor the Green Prime product. No action was taken. This item was deferred to a later meeting as a discussion item. 2 City Council Regular Meeting Minutes November 17,2016 B. Reappointment to.the Community Relations Committee City Clerk Deborah Padovan presented the reappointments. Council discussion .ensued. As Mr. Burnell was not yet at the meeting, his reappointment was tabled. MOTION MADE AND SECONDED: Councilmember Corrigan moved to reappoint Karen Emerzian to the Community Relations Committee for a fifth,, four-year term. The motion was seconded by Councilmember Radford. Motion Carried 4-0-1: AYES: Mayor Harpootlian, Councilmember Corrigan, Councilmember. Radford, Councilmember Spreen NOES: None ABSENT: Vice Mayor Waldeck ABSTAIN: None C. Appointments to the Open Space Committee City Clerk Padovan presented the item. Sue Welch, Los Altos Hills, expressed her -desire to be reappointed to the committee as there is a lot of tedious work to be done. Richard Contreras, Los Altos Hills, introduced himself to the City Council and expressed his desire to serve on the committee. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Spreen moved to reappoint Sue Welch for a fourth, four-year term and appoint Richard Contreras for a four-year term to the Open Space Committee. The motion was seconded by Councilmember Radford. - Motion Carried 4-0-1: AYES: Mayor Harpootlian, Councilmember Corrigan, Councilmember Radford, Councilmember Spreen NOES: None ABSENT: Vice Mayor Waldeck 3 City Council Regular Meeting Minutes November 17,2016 ABSTAIN: None The Council now considered Agenda Item 2.E. E. Appointment to the Education Committee City Clerk Padovan presented the application. Marissa Goodger,.Los Altos Hills, introduced herself to the City Council. MOTION MADE AND SECONDED: Councilmember Radford moved to appoint Marissa Goodger to the Education Committee for a four-year term. The motion was seconded by Councilmember Spreen. Motion Carried 4-0-1: AYES: Mayor Harpootlian, Councilmember Corrigan, Councilmember Radford, Councilmember Spreen NOES: None ABSENT: Vice Mayor Waldeck ABSTAIN: None D. Appointments to Pathways Committee City Clerk Padovan stated that she failed to include an application and requested the Council consider including Les Earnest in the pool of applicants. The Council agreed to include Mr. Earnest. Jim Abraham, Los Altos Hills, expressed his interest in serving on the Pathways Committee. Teresa Baker, Los Altos Hills, expressed her interest in serving on the Pathways Committee. Weegie Caughlin, Los Altos Hills, expressed her interest in being reappointed to the Pathways Committee. Susan Cretekos, Los Altos Hills, expressed her interest in serving on the Pathways Committee Nick Dunckel, Los Altos Hills, expressed his interest in being reappointed to the Pathways Committee. 4 City Council Regular Meeting Minutes November 17,2016 • ' Ann Duwe, Los Altos Hills, expressed.her interest in being reappointed to the Pathways Committee. Hal Feeney, Los Altos Hills, expressed his interest in serving on the Pathways. Committee. Judy Nagy, Los Altos Hills, expressed her interest in serving on the Pathways Committee. Diana Russell, Los Altos Hills, expressed her interest in serving on the Pathways Committee. Glenn Wilkerson, Los Altos Hills, expressed his interest in serving:on the Pathways Committee. Sonja Wilkerson, Los Altos Hills, expressed her interest in serving on the Pathways Committee. Lawrence William, Los Altos Hills,. expressed his interest in serving on the Pathways Committee. Mayor Harpootlian thanked everyone for applying. The appointments to the Pathways Committee will be made at the e December 15, 2016 Special City Council meeting. F. Presentation for Sewer Collection System Update by V.W. Housen and Associates - this item was not heard and continued to the January 2017 City Council meeting. City Clerk Padovan stated that Mr. Waller requested that the Public Hearing Item 5.A be considered next. TheCouncilagreed and after the recess, considered Public Hearing Item S.A. The Council meeting went into recess at 8:25 p.m. The Council meeting reconvened at 8:32 p.m. The Council now considered Public Hearing Item No. 5A. 5. PUBLIC HEARINGS • . A. LANDS OF WALLER; 26105 ELENA ROAD: File 246-16-MISC; A request for a General Plan amendment to remove a path from the Master Path Map and to remove the existing native pathway on 26105 Elena Road. CEQA review: 5 City Council Regular Meeting Minutes November 17,2016 Categorical Exemption per Section 15061(b)(3) (Staff: S.Avila) Ex Parte Disclosures: There were no ex parte communications. Mayor Harpootlian opened the Public Hearing. Senior Planner Marni Moseley:presented the staff report. Mr.Waller spoke in support of his application. Council asked questions of Mr.Waller and received his responses. Ann Duwe, Los Altos Hills Pathways Committee Chair, said the pathway was there and in regular use before the house was built. Linda Swan,Los Altos Hills, said she was not in favor of releasing the pathway. Kathy Liccardo,Los Altos Hills,was not in favor of removing the pathway. Carol Gottlieb, Los Altos Hills, said that this path was in prior to both of the homes being built. Jill Rytand, Los Altos Hills, said her daughters love and use that path daily and it would be a huge loss if it were removed. Teresa Baker, Los_ Altos Hills, said she lives across the street and uses the path around once a week. Alisa Bredo, Los Altos Hills, agreed with other speakers about safety reasons that it is helpful to use this pathway as a cut-through. Mayor Harpootlian closed the Public Hearing. Council discussion ensued. Mr.Waller provided a rebuttal. MOTION MADE AND SECONDED: Councilmember Spreen moved to deny the requested General Plan amendment to amend the Master Path Map and remove the existing native pathway on property at 26105 Elena Road. The motion was seconded by Councilmember Radford. Motion Carried 4-0-1: AYES: Mayor Harpootlian, Councilmember Corrigan, Councilmember Radford, Councilmember Spreen 6 City Council Regular Meeting Minutes November 17,2016 NOES: None ABSENT: Vice Mayor Waldeck ABSTAIN: None DIRECTION: Staff shall determine the boundaries of the existing easement and provide some mitigation for landscaping if necessary. Any demarcation of the path shall be discussed with the homeowner. Vice Mayor Waldeck arrived at the meeting at 9:55 p.m. MOTION:MADE AND SECONDED: Councilmember Corrigan moved to continue the. meeting past 10:00 p.m. The motion was seconded by Councilmember Radford. ABSTAIN: None The Council returned to Item 2.D to interview one more Pathways Committee candidate. D. Appointments to Pathways Committee Les Earnest, .Los Altos Hills, was interviewed by the City Council for the Pathways Committee.No action was taken. 3. PRESENTATIONS FROM THE FLOOR Persons wishing to address the Council on any subject not on the agenda may do so now. Please complete a Speaker Card located on the back table of the Council Chambers and submit it to the City Clerk. Comments are limited to two (2) minutes per speaker. California law prohibits the. Council from acting on items that do not appear on the agenda. Under a Resolution previously_ adopted by the Council, such items can be referred to staff for appropriate action,which may include placement on the next available agenda. Suellen Haggerty, Public Health Nutritionist from Santa Clara County, invited the City Council to the Healthy Cities Conference at the Tech Museum in San Jose on November 18, 2016. 4. CONSENT CALENDAR 7 City Council Regular Meeting Minutes November 17,2016 MOTION MADE AND SECONDED: Councilmember Corrigan moved to approve the CONSENT CALENDAR withthe exception of 4.M and 4.0. Accepting the Annual Report on Development Impact Fees for Fiscal Year Ending June 30, 2016 (Staff: P. Lin) E. Amending the Resolution Establishing Standing Committees and Adopting General Special Rules Pertaining Thereto Sunsetting the Traffic Safety Committee (Staff: D. Padovan) Mayor Harpootlian suggestedthat the standing committee resolution return to the Council at the next meeting to include the Code of Conduct for Appointed Persons. There was Council consensus to incorporate the code in the resolution. F. CEQA Review: Categorical Exemption per Section 15303(e) - new construction of an accessory structure.:(Staff: S. Avila) Mayor Waldeck stated that he had no ex parte communications. Mayor Harpootlian opened the Public Hearing. Assistant Planner Genevieve Fernandez presented the staff report. Lisa Sousa,Los Altos Hills, spoke regarding the fence on her property. Council asked questions of the applicant and received her responses. Eileen Gibbons, Los Altos Hills, presented a picture of the property and fence that indicated how close to the road the fence is located. Gerald Heitel, Los Altos Hills, said that he is a neighbor of Ms. Sousa and objected to the fence on the grounds that it is unattractive. He said there was a prior fence on this same location he never questioned whether or not that fence was in violation of city ordinances. Alice Mansell, Los Altos, spoke in support of Ms. Souza and the location of the fence. Ms. Souza thanked Mr. Heitel for saying there was a fence there for the past 40 years. 9 City Council Regular Meeting Minutes November 17,2016 Mayor Harpootlian closed the Public Hearing. Council discussion ensued. City Attorney Steve Mattas said that one of the options that is before the Council is to refer the matter to the Planning Commission. The action the Council could take is to uphold the determination that the fence is in the wrong location and authorize a lien be placed on the property. The Council could also direct the matter to the Planning Commission where it could be resolved. Further Council discussion ensued. DIRECTION: Staff shall meet with Ms. Souza and her representatives and return to the City Council. Discussion of Rescheduling.the January City Council Meeting Schedule due to the League of California Cities New Mayors and Councilmembers Academy (Staff: D. Padovan) 10 City Council Regular Meeting Minutes November 17,2016 MOTION MADE AND SECONDED:.Councilmember Corrigan moved to cancel the regularly scheduled City Council meeting on January 19, 2017 and schedule a special meeting to convene on Wednesday,.January 25, 2017. The motion was seconded by Vice Mayor Waldeck. Motion Carried 5-0: AYES: Mayor Harpootlian, Vice Mayor Waldeck, Councilmember Corrigan, Councilmember Radford, Councilmember Spreen NOES: None ABSENT: None. ABSTAIN: None C. Preliminary Assessment of Fremont Road & Pinewood School Driveway Intersection(Staff:.A. Chen) MOTION MADE AND SECONDED: Councilmember Corrigan moved to continue the meeting past 11:00 p.m. The motion was seconded by Vice Mayor Waldeck. Motion Carried 5-0: AYES: Mayor Harpootlian, Vice Mayor Waldeck, Councilmember Corrigan, Councilmember Radford, Councilmember Spreen NOES: None ABSENT: None ABSTAIN: None Public Works Director Allen Chen presented the staff report. Heather Rose, Los Altos Hills, questioned whether or not the pathways on Fremont Road would be widened. Kim.Cranston, Los Altos Hills, said he had a concern about bicycles using the path if the road was restriped. Paul Mercadante, Los Altos Hills, noted that :restriping the road was not necessary. Scott Riches, President of Pinewood School, agreed that the restriping of the road was unnecessary. 11 City Council Regular Meeting Minutes • November 17,2016 Council discussion ensued. No action was taken. D. Resolution Accepting a Cash Donation of$40,000 to the Town of Los Altos Hills for the Purchase of Sculpture to Enhance the Image of the Los Altos Hills Community(Staff P. Lin) Administrative Services Director Pak Lin presented the report. Council discussion ensued. MOTION MADE AND SECONDED: Councilmember Radford moved.to adopt Resolution 87-16 Accepting a Cash Donation of$40,000 to the Town of Los Altos. Hills for the Purchase of Sculpture to Enhance the Image of the Los Altos Hills Community. The motion was seconded by Vice Mayor Waldeck. Motion Carried 5-0: AYES:. Request from the Public Art Committee Seeking City Council Approval for Three (3) Proposed Sculpture Donations Roger Burnell, Chair of the Public Art Conunittee, presented three items of sculpture for the Council's consideration. Council discussion ensued. MOTION MADE AND SECONDED: Vice Mayor Waldeck moved to approve the acquiring of the three (3) proposed sculptures and determine the siting/location at a future date. The motion was 'seconded by Councilmember Corrigan. Mr. Burnell stated that he doesn't know what his availability is for the next four years and he didn't want to do more than he could do, but the committee has asked him to stay on for another year. MOTION MADE AND SECONDED: Councilmember Radford moved to. reappoint Roger Burnell to the Community Relations Committee for a seventh, four-year term. The motion was seconded by Councilmember Corrigan. Enrollment Data from Bullis Charter School (Councilmember Radford) Councilmember Radford presented the request for enrollment data from Bullis Charter.School. Heather Rose, Los Altos Hills, said .having this data collectedis extremely valuable. MOTION MADE AND SECONDED: Councilmember Radford moved to approve the letter the Ed Committee has drafted for the mayor's signature to request that Bullis Charter School provide the same student enrollment data as they provide to Los Altos School District. The motion was seconded by Councilmember Corrigan. . Motion Carried 5-0: . AYES: .
