We cannot attend the meeting tomorrow evening but enclosed is a letter from us outlining the concerns we have with the proposed update from the Pathway Committee. Sincerely yours, Howard Lee howflee@aol.com 9 To: Members of the Planning Commission,Town of Los Altos Hills From: Howard&Ruby Lee,owners of 12933 Atherton Court, LAH Date: October 25, 2016 Re: Comments on Proposed Pathway Map update for 2016, La Paloma to Robleda Dear Members of the Planning Commission My name is Howard Lee and with my wife,have been the owners of 12933 Atherton Court since 1987.We bought this home because of its location at the end of a small, quiet cul-de-sac providing security and privacy. A little history of our property and the Pathway proposal may help to understand the frustration my wife and I have with the current Pathway proposal.Over the past three decades,we had to deal several times with the pathway committees over the same proposed pathway questions and concerns over our property and Atherton Court. Each time the issue was resolved,but then it reappears a few years later? When we bought our home at Atherton Court,there was an existing easement on the west side of our property and this was a major concern we had to deal with but decided the location and setting was worth the compromise and the previous owner understood our concern and we reached an agreement. With the last Pathway Committee,they decided they would not pursue the existing west easement option,and accepted our concerns on coming down the steep narrow path between our driveway and the driveway of our neighbor,Vaz Babayan at 12940 Atherton Court. They agreed with us that the best solution was to have the pathway go along the north end of our property and Babayan's property,then exit to Robleda Road directly. The latest pathway map reflected that agreement. Now,with the new Pathway proposal,we are again facing the same issues! Here are our main concerns: 1. Security and privacy: the proposed pathway directly faces our living quarters for the bedrooms that face north and east.Since we are at the highest end of the cul • - de-sac we never have any strangers wander up or by our property. But with the new proposed pathway, folks will be coming up from both north side and from Atherton Court and can simply walk by to check out the current activities at our home,or stalk us,or worse. 2.Safety and liability: Since the proposed path coming up from both the creek side and the Atherton Court side are going to be steep,folks might prefer to use our driveway instead,especially if the pathway is wet or muddy. This could create both safety and liability issues,especially since our driveway has a sharp blind turn as it comes around and down to Atherton Court. If any pathway users or horses are on our driveway, neither party can see each other until the last moment.This is not good -in fact,it is very dangerous! Furthermore,they will also be trespassing on our private property! 3.Impact to the value of our home: Under this new proposal,our Atherton Court property value will be impacted with the potential of up to three easements that practically surround the house and totally destroy the privacy and safety advantages of being at the end of a small,quiet cul-de-sac. 4.Cost: There is an underground power transformer/junction box right at the point where the proposed pathway reaches Atherton Court.There will be significant cost in relocating this. I do not think the utility junction is designed for folks or horses to walk on. We ask the commission to take these concerns we have under consideration to reject the proposed pathway map.We strongly object to a pathway coming down the steep narrow path between our property and our neighbor Babayan's property, and down the small Atherton Court cul-de-sac,for the reasons listed above.
