FROM: Brian Froelich,Assistant Planner APPROVED BY: Debbie Pedro,Planning Director RECOMMENDATION: That the Planning Commission: Forward a recommendation that the City Council approve the requested Site Development Permit and Conditional Use Permit, subject to the recommended conditions and findings of approval in Attachments 1 and 2. BACKGROUND The site is a Town owned 14.96-acre property located at 27210 Altamont Road. Currently, the primary use onsite is the Westwind Barn commercial stable that has been operating under a Conditional Use Permit since 1977. The property is located immediately to the west of the 50.25 acre Byrne Preserve. Existing structures on the property include the barn, paddocks, corrals, and riding arenas. Surrounding uses include single-family residences to the west, south, and north, and the Byrne Preserve to the east. On October 13, 2005, the Planning Commission voted 5-0 forwarding a recommendation of approval for a wireless communication facility that includes a 65 foot tall Verizon Wireless pole, antennas, and ground equipment at the West Wind Barn site. The City Council then voted 3-0 to approve a monopine, antennas, and ground equipment at the regular meeting of November 3, 2005. The approved monopine and ground equipment enclosure are designed to accommodate collocation with one additional carrier. Verizon Wireless has entered into a lease agreement with the Town and has reported that structural design plans will be submitted to the Town's Building Department for review by the end of July 2006. Verizon Wireless' planning approvals and entitlements will expire in November 2006 if a Building Permit has not been issued. T-Mobile and Verizon Wireless are currently in lease negotiations for this collocation. PROJECT SUMMARY T-Mobile USA has submitted plans to collocate on the approved 65 foot tall Verizon Wireless monopine and install ground equipment in the approved cabinet enclosure. The proposal includes three (51" x 20.5" x 3") panel antennas mounted at 48 feet above grade and three (5' x 3' x 13') ground mounted equipment cabinets. A radio frequency analysis for the project was prepared b Diamond Services, Consulting Engineers in July of 2006. The report concluded that the combined RF emissions generated by the T-Mobile facility and the Verizon facility would comply with the FCC's current prevailing standard for limiting human exposure to RF energy. No significant RF energy impact on the environment or general population is expected. See full report attached (Attachment 5). DISCUSSION A wireless communications facility is a conditionally permitted use per section 10-1.703 (h) of the Zoning Code. Further, section 10-1.1104 of the Zoning Code requires all applications for Conditional Use Permits to be reviewed by the Planning Commission with a recommendation forwarded to the City Council. Pursuant to section 10-1.1107(l) of the zoning code, specific findings must be made in order to approve a Conditional Use Permit. The findings for-this Conditional Use Permit are attached for the Commission's review (Attachment 2). Recommended conditions of approval for the project are included in this report (Attachment 1) for Planning Commission review. The recommended conditions are consistent with the Verizon Wireless approval on site. The Conditional Use Permit renewal for all wireless carriers at the site would be reviewed simultaneously. Aesthetics The antennas would be subject to the same aesthetic conditions as the approved Verizon monopine and antennas. The materials, colors, and design-used to screen the antennas must match the Verizon antenna installation. The antennas would be painted an earthtone color and screened with sufficient artificial vegetation to resemble a healthy mature pine tree. WIRELESS COMMUNICATIONS FACII ITY POLICY The Town's Wireless Communications Policy (Attachment 3) specifies Town-owned properties as the top priority for wireless installations and encourages collocation where possible. Visual impacts are minimized by the design of the (previously approved) monopine and the requirement that the proposed antennas be painted an earthtone color and screened with sufficient artificial vegetation to resemble a healthy mature pine tree per Wireless Planning Commission T-Mobile USA 27210 Altamont Road July 20,2006 Page 3 of 5 Communications Policy #8. A mailing notice was sent by T-Mobile to neighbors within 500 feet of the project(Attachment 9). Pursuant to the Town's Wireless Communications Facilities Policy, T-Mobile USA has submitted a 3-5 year Antenna Master Plan showing all existing and anticipated T-Mobile antenna sites within the Town boundaries for Planning Commission review (Attachment 4). This site would be T-Mobile's only site west of Interstate 280 in Los Altos Hills. CEOA REVIEW The proposed wireless communications facility is categorically exempt from the provisions of the California Environmental Quality Act by provision of section 15301, Class 1 (a): "Class I consists of...minor alteration of existing public or private structures... Any changes or revisions to the telecommunications facility or its use shall require an amendment to the applicable conditional use permit(s). Additionally, the Planning Director may, at any time, schedule a review or revocation hearing before the Planning Commission regarding the use permit, if any condition of approval is not being met or the facility is being used inconsistently with the approved use or in violation of Town development codes. 2. The use permit shall expire five (5) years from the date of approval. Renewal of the permit must be requested in writing, with appropriate fees, prior to the expiration date. Use Permit renewal review shall be simultaneous with all other wireless carriers onsite. 3. The screening materials, colors, and design used to screen the antennas must match the Verizon Wireless antenna installation. The mono-pine shall contain sufficient artificial vegetation to resemble a healthy mature pine and to screen all antennas. A sample of all colors and materials must be reviewed and approved by the Planning Department prior to acceptance of plans for building plan check. 4. The applicant shall submit a signed agreement to the Town that should the use be discontinued by the carrier, all facilities will be removed and the easement abandoned not later than ninety (90) days after discontinuance of the use or abandonment. The agreement shall be approved by the City Attorney, and must be signed by the applicant and submitted to the Town prior to acceptance of plans for building plan check. 5. The applicant shall not cause radiation in the frequencies allocated as primary to the amateur radio service and may be required to correct any and all future interference problems experienced by other licensed services. 6. T-Mobile USA or the operator of the site shall be responsible for repair or repainting of the proposed facilities in case of vandalism or wear and must do so within 72 hours of notice by the Town that a complaint has been received. The applicant is required to water sweep roads if soil material is carried onto public streets during installation or maintenance. ENGINEERING: 8. Any, and all, changes to the approved Site Plan shall first be approved by the Town Engineering Department. No grading shall take place during the grading moratorium (November 1 to April 1) except with prior approval from the City Engineer. No grading shall take place within ten feet of any property line. 9. Final grading and drainage shall be inspected by the Engineering Department and any deficiencies corrected to the satisfaction of the Engineering Department prior to final approval. 10. Any, and all, areas on the project site that have the native material disturbed shall be protected for erosion control during the rainy season and shall be replanted prior to final inspection. 11. The applicant shall inform the Town of any damage and shall repair any damage caused by the construction of the project to pathways, private driveways, and public and private roadways,prior to final inspection and shall provide the Town with photographs of the existing conditions of the roadways and pathways prior to acceptance ofplans for building plan check CONDITION NUMBERS 3, 4 AND 11 SHALL BE COM[PLETED, AND SIGNED OFF BY THE PLANNING DEPARTMENT AND THE ENGINEERING DEPARTMENT PRIOR TO ACCEPTANCE OF CONSTRUCTION PLANS FOR PLAN CHECK BY THE BUILDING DEPARTMENT. ,NOTE: The Site Development permit is valid for one year from the approval date (until August 10, 2007). All required building permits must be obtained within that year and work on items not requiring a building permit shall be commenced within one year and completed within two years. Upon completion of the construction, a final inspection shall be required to be set with the Planning and Engineering Departments two weeks prior to final building inspection approval. Attachment 2 CONDITIONAL USE PERMIT FINDINGS T-MOBILE USA TELECOMMUNICATIONS FACILITY (COT-LOCATED ON VERIZON WIRLESS MONOPINE) 27210 ALTAMONT ROAD(LANDS OF LOS ALTOS HTLLS/WESTWIND BARN) File#121-06-ZP-SD-CUP 1. The proposed use or facility is properly located in relation to the community as a whole, land uses,and transportation and service facilities in the vicinity; The Town's Wireless Communications Policy establishes Town owned properties as the top priority for wireless installations. Further the policy encourages collocation. The additional wireless carrier on the approved pole provides greater wireless coverage to the community with a minimal aesthetic impact. The approved equipment shelter will not be enlarged. Construction of the proposed wireless installations will not place an undue burden on existing transportation, utilities and services in the vicinity. The unmanned facility requires on-site visits by maintenance personnel on a monthly basis. 2. The site for the proposed use is adequate in size and shape to accommodate this use and all yards, open spaces, walls and fences, parking, loading, landscaping, and such other features as may be required by this chapter or will be needed to assure that the proposed use will be reasonably compatible with land uses normally permitted in the surrounding area; The 14.96 acre site is adequate in size and shape to accommodate all wireless installations (300 square feet). The proposed installations have been designed to minimize any impact to the existing uses onsite. The existing access and parking facilities onsite are sufficient for the limited trips generated by construction and maintenance of the equipment. No trees would are proposed for removal. 3. The site is served by streets and highways of adequate width and pavement to carry the quantity and kind of traffic generated by this proposed use; and The construction and maintenance of the proposed pole and ground mounted equipment will generate minimal additional traffic. The site is served by Altamont Road, which can accommodate traffic generated by the proposed use. No materials will be stored in the right of way. 4. The site does not adversely affect the abutting property or the permitted use thereof. The conditions of approval of this permit include standards in accordance with the Wireless Communication Policy to ensure land use compatibility. In addition the proposal will not increase visual impacts from surrounding properties. The proposed wireless communication facility, as conditioned, does not pose any foreseeable impact to human or environmental health and will not interfere with permitted uses in the vicinity. ATTACHMENT TOWN OF LOS ALTOS BILLS Policy Re: Wireless Communications Facilities Code Sections and Design Guidelines: Section 10-1.703(h)(2) of the Zoning Ordinance allows service uses, including "communications facilities", to be permitted in the Town if a Conditional Use Permit is granted by the Planning Commission and City Council. Section 10-1.1107(1) of the Code outlines findings which must be made to approve a use permit,including the proper location of the use or facility relative to others in the vicinity, the adequacy of the site to accommodate the use, and that the facility or use will not have an adverse effect on adjacent properties. The Design Guidelines do not address such uses, but do suggest (on pages 29-31) that ancillary facilities, such as lights, pool equipment, and satellite dishes, be located so as to minimize impacts on neighbors. Intent: The purpose of this policy is to outline the desired criteria for siting of wireless communications facilities, generally including monopoles, related antennas, and equipment shelters. As the Town's land use is virtually entirely residential, wireless communication facilities will be most appropriately located on public or institutional sites existing within the Town. Collocation, location on or near existing buildings, and landscape screening will be desired to minimize the visual impacts of the facilities on neighbors and the public. Policies: 1. Priorities for Siting. Wireless communication facilities shall generally be located on properties with priority as follows:* a) Town-owned properties; b) Foothill College; c) water tanks; d) other public'or quasi-public facilities, such as schools or churches; and e) residential properties of at least ten (10) acres. 2. Siting on Residential Parcels. Wireless communication facilities may be permitted on properties used for residential purposes or vacant parcels intended for residential use if the residential property owner provides written consent and significant visual impacts are mitigated. 3. Collocation. Collocation of wireless communication facilities with other facilities is encouraged to the maximum extent feasible, as long as the collocation is technologically compatible and does not substantially increase visual impacts. The Town will generally require as a condition of approval for any conditional use permit that the applicant permit collocation of other facilities, subject to technological constraints and Town review. Landscape screening shall be required by the Town to minimize the visual impacts of wireless communication facilities. Poles, antennas, and equipment buildings should be painted to blend with the surrounding environment and/or buildings to further minimize visual impacts. 5. Environmental Review. A Negative Declaration will typically be prepared for review of proposed wireless communication facilities, with special attention to the visual impacts of the facilities. Categorical exemptions may be used where facilities are collocated with or would be minimal additions to existing structures,with negligible additional visual impact. 6... Antenna Master Plans. Any applicant for a wireless communication facility site shall submit applications, to the best of their knowledge, for all sites anticipated to be required by the carrier for a three (3) to five (5) year period, and the requests shall be reviewed by the Planning Commission and City Council as a master plan application. 7. Term of Permits and Abandonment of Sites. Conditional use permits for wireless communication facilities shall be established for periods not to exceed five (5) years, at which time renewal of the permit must be requested by the applicant. More frequent review of the operation of the permit may be made a condition of approval. Approval will also require a written agreement from the applicant that, should the use be discontinued by the carrier, all facilities will be removed not later than ninety (90) days after discontinuance of the use or abandonment. Such a provision shall also be included in any lease with the Town for use of Town lands for wireless communications facilities. The Town may require bonding or other surety to assure the removal of such facilities. 8. Wireless communication firms shall, at the time of application for permits, demonstrate efforts which have been made to inform neighboring residents of the proposed facilities, such as conducting meetings, or mailing fact sheets and/or letters,etc. to neighbors. 9. The Planning Director is authorized to reduce or waive permit fees for any wireless communications facility that is proven to expand wireless coverage in the Town and is structurally capable of co-location. 10. The Planning Director is authorized to administratively approve portable wireless communications facilities also known as cell on wheels or COWS on certain properties as specified in Policy#1 on a temporary basis. SF 14972 '"ALTAMONT" 27210 ALTAMONT ROAD, LOS ALTOS HILLS, CALIFORNIA By: Diamond Services Date 07/13/2006 I� T-Mobile Site No.SF 14972 Page 1 of 8 Diamond Services Report Summary Based upon information provided by T-Mobile and the design engineer, and using the calculated method for determining RF field strength, it is the engineer's opinion that the telecommunication facility which will be located at 27210:Altamont Road, Los Altos Hills, California will comply with the FCC's current prevailing standard for limiting human exposure to RF energy. Due to the mounting method utilized, the general public would not normally be able to approach the antennas. Therefore, no significant impact on the general population is expected. The calculated electromagnetic field strength level in publicly accessible areas is less than the existing standard allows for exposure of unlimited duration. Additionally, due to the mounting method used,no significant impact on the environment is expected. General Recommendations For personnel who perform maintenance or work near the antennas, a training program in exposure to RF fields is recommended, since any access closer than thirteen feet to the face of a T-Mobile antenna at this site could expose personnel to RF field levels greater than the occupational limits, and such access should be prohibited. At this site, public access to the face of an antenna is not expected. Maintenance personnel should be instructed to contact the appropriate Carrier prior to working in front of an antenna. RF warning sips should be placed at the base of the monotree. Background Diamond Services' has been retained by T-Mobile to conduct a Radio Frequency (RF) electromagnetic analysis for a proposed telecommunication 'facility to be located at 27210 Altamont Road, Los Altos Hills, California. This analysis consists of a review of the proposed site conditions, calculation of the estimated RF field strength of the telecommunication facility, and the provision of a comparison of the estimated field strength with the Federal Communication Commission (FCC) recommended guidelines for human exposure to RF electromagnetic fields. Site Description Based upon the drawings provided by the design engineer, six T-Mobile panel antennas will be mounted on a monotree. The antennas will be mounted approximately 45'- 10"(to bottom of lowest antennas)above ground level. Normal public access to the front of the antenna is not expected due to the mounting location and method utilized. Occupational access to the front of the antennas is not normally expected. In addition to the T-Mobile antennas,Verizon Wireless antennas will be mounted on the monotree. RF Field Strength Calculation Methodology A generally accepted method is used to calculate the expected RF field strength. The method uses the FCC's recommended equation2 which predicts field strength on a worst case basis by doubling the predicted field strength. The following equation is used to predict maximum RF field strength: Equation I S= (2)2 PG PG = EIRP Ir R 2 Ir R 2 Where: S=power density P=power input to the antenna G=power gain of the antenna in the direction of interest relative to an isotropic radiator R=distance to the center of radiation of the antenna The ground level effect of the T-Mobile emissions was calculated using a maximum downtilt of 50, and a maximum ERP of 1531 watts. Results were calculated for a height of 6'-6"above ground level. Using these factors,the maximum calculated T-Mobile fields at ground level are 1.07%of the existing standard for general population uncontrolled exposure. Calculations were performed for the main antenna lobe,the-3dB point, and the first and second lower lobes. Information provided by Verizon Wireless indicates that the Verizon Wireless RF fields at ground level will be less than 5.00%of the existing standard for general population uncontrolled exposure. At ground level,the combined effect of the T-Mobile and Verizon Wireless RF fields is calculated to be less than 6.07%of the existing standard for general population uncontrolled exposure. 2 Referent Federal Communication Commission Office of Engineering Technology Bulletin 65 T-Mobile Site No.SF 14972 Page 3 of 8 L Diamond Services See Table I for the FCC's guidelines on Maximum Permissible Exposure(MPE). T-Mobile Site No. SF 14972 Page 4 of 8 Dimond Services Exposure Environments The FCC guidelines incorporate two separate tiers of exposure limits that are dependent on the situation in which the exposure takes place and/or the status of the individuals who are subject to exposure. The decision as to which tier applies in a given situation should be based on the application of the following definitions. Occupationallcontrolled exposure limits apply to situations in which persons are exposed as a consequence of their employment and in which those persons who are exposed have been made fully aware of the potential for exposure and can exercise control over their exposure. .
