Williams, Planning Direcxgr RECOMMENDATION: That the City Council: Approve the attached resolution granting an easement to the Purissima Hills Water District for installation of a water well on the Town Hall site. ICS '• J�►� On May 6, 1999, the City Council considered a request by the Purissima Hills Water District (PHWD) to grant an easement behind the generator and equipment area near the Town Hall parking lot, for the purpose of installing a water well. The Council conceptually approved the project and directed the City Attorney and other staff to work with the PHWD to prepare the necessary easement document. Council also asked staff to look into the feasibility of providing a trail along the perimeter of the PHWD water tank property near La Loma Drive, in exchange for the proposed easement at Town Hall. The staff report from the May 6"' meeting is attached for further background. DISCUSSION The attached easement agreement has been prepared by the City Attorney and counsel for the PHWD, and would encompass an easement for both exploratory drilling purposes and for the long-term operation of the well. The lease provides that if, upon exploratory drilling, the PHWD determines not to proceed, the easement will be abandoned and the agreement terminated. The stated purpose of the easement is to provide a secondary source of water to be used by the District as necessary to supplement the Water District's primary water source in times of emergency, water shortage, or other water supply problems. The easement agreement also provides the Town with flexibility to revise access to the lease area in the future, so long as acceptable access is maintained. In the event of abandonment, the District is required to cap the well, remove above ground equipment, and restore the site. September 2, 1999: Purissima Hills Water District Easement Page 2 Trail at La Loma Water Tank Site The City Engineer and the General Manager of the PHWD have visited the water tank site off La Loma Drive and it is the City Engineer's opinion that a trail to connect from the access easement to the water site to the adjacent open space area would be problematic and extremely costly, due to the topography at the perimeter of the site. Staff therefore does not suggest that such a requirement be added to this proposal. Exhibit A: Town Hall Legal Description Please note that Exhibit A, the property description for Town Hall, is not included with the agreement, as the only document located thus far has not been verified by the City Engineer. The agreement will not be recorded until the proper exhibit is attached. Staff is available to respond to questions from the Council or the public.
