RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS
ACCEPTING THE EL MONTE FIRE STATION UTILITY UNDERGROUNDING (RULE
20A) PROJECT PERFORMED BY PHOENIX ELECTRIC COMPANY AS COMPLETE;
AUTHORIZING_,THE RELEASE OF FINAL RETENTION TO THE CONTRACTOR; AND
DIRECTING THE CITY CLERK TO FILE A NOTICE OF COMPLETION
WHEREAS, Rule 20A underground program allows cities and counties to utilize Rule 20A work
credits to fund utility undergrounding projects at locally identified underground districts; and
WHEREAS, the City Council adopted Resolution No. 4049 on June 20, 2019, approving the
formation of an Underground Utility District (UUD) around the El Monte Fire Station; and
WHEREAS, the El Monte Fire Station Undergrounding (Rule 20A) Project was added to the Five -
Year Capital Budget on June 20, 2020, and Town hired Sanbell (formerly known as Bellecci and
Associates) in October 2020 to prepare the undergrounding composite plans and to assist with the
coordination with PG&E and other utility companies; and
WHEREAS, on April 15, 2024, the Town Council approved the Plans and Specifications for the
project, authorized staff to advertise the project for a formal bid, and authorized the City Manager to
award a construction contract to the lowest responsible bidder not to exceed $4,200,000, including a
contingency fund for potential change orders; and
WHEREAS, after a formal bid process for construction of the project, Phoenix Electric Company
(Phoenix) was determined to be the lowest responsible bidder, and the construction agreement with
Phoenix was executed on June 3, 2024, for $3,868,742.50; and
WHEREAS, construction started on June 26, 2024, and the work was completed under the terms of
the contract on November 4, 2025; and
WHEREAS, the total project expenditure for the contracted work by Phoenix Electric Company is
$4,119,489, which is below $4,200,000, the amount authorized by the Town Council; and
WHEREAS, staff recommend that the City Council accept the El Monte Fire Station Undergrounding
(Rule 20A) Project performed by Phoenix Electric Company as complete and allow the remittance of
the five percent retention to the contractor 35 days following the project acceptance.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the Town of Los Altos Hills that:
1. The El Monte Fire Station Utility Undergrounding (Rule 20A) Project by Phoenix Electric
Company is accepted as complete; and
2. - Staff- is -authorized -to -make -the -final -retention payment- concerning the above-described- -
work; and
3. The City Cleric is hereby directed to file the notice of the completion of said project with
the County Recorder of the County of Santa Clara, within ten (10) days from the date of
this Resolution,•

The above and foregoing Resolution was passed and adopted by the City Council of the Town of Los
Altos Hills at a regular meeting held on the 9th day of December 2025 by the following vote:

NOTICE IS HEREBY GIVEN that Phoenix Electric Company on June 3, 2024, entered into a
contract for the El Monte Fire Station Utility Undergrounding (Rule 20A) Project, in Los Altos Hills,
situated in Santa Clara County, with the Town of Los Altos Hills. Said improvements were completed
in accordance with the Plans and Specifications adopted by the City Council and upon the terms and
conditions set forth and identified by the written contract.
On the 9th day of December 2025, the work provided to be done under the contract was accepted as
fully completed within the terms of the contract.
NOTICE IS FURTHER GIVEN that the public board for whom the above-described work was done
is the City Council of the Town of Los Altos Hills, a municipal corporation of the State of California,
and that the name and address of the political subdivision for which the above-described work was
done is the Town of Los Altos Hills, State of California, Town Hall, 26379 Fremont Road, Los Altos
Hills, California 94022.
NOTICE IS FURTHER GIVEN that the name of the contractor by whom the above-described work
was done is as follows:
