HomeMy WebLinkAboutResolution 11-26RESOLUTION 11-26 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS APPROVING ADDITIONAL MINOR REVISIONS TO THE HOUSING ELEMENT AMENDMENT WITH AN EFFECTIVE DATE CONTINGENT UPON CERTIFICATION OF THE AMENDMENT BY THE STATE HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT WHEREAS, on December 9, 2025, the City Council of the Town of Los Altos Hills adopted an Amendment to the 2023-2031 .Housing Element of the General Plan (the "HEA" or "Housing Element Amendment") with the adoption effective contingent upon certification of the amendment by the State Housing and Community Development Department ("HCD"); and WHEREAS, the purpose of the HEA is to provide clarity and maintain internal consistency across governing land use and planning documents, as well as in support of and in conformance with the Town's rezoning of certain properties for multi -family development; and WHEREAS, the Town engaged in discussions with HCD regarding review of the HEA and also provided extensive public outreach, notice and participation opportunities for the preparation and adoption of the HEA; and _ WHEREAS, the HEA was published for public review, including for a 7 -day public review period on subsequent draft revisions, and submitted to HCD for review on December 12, 2025, all in compliance with Government Code section 65585; and WHEREAS, pursuant to additional discussion with HCD since submittal, the Town has identified certain additional minor revisions that would be made to the HEA, consisting of: (1) an additional progress review in 2029 and to identify available sites as necessary; and (2) additional analysis affirming economic feasibility of replacing single-family homes at the Twin Oaks site for multi -family development; and WHEREAS, these additional minor revisions do not substantively change any provisions in the HEA or alter any other goals, policies or programs in the Housing Element, and are consistent with the City Council's prior direction and current activities to explore alternative sites; and WHEREAS, adoption -of these --additional minor revisions by -the Town to the - HEA- -would also -only become effective upon HCD certifying the HEA as substantially compliant with state law; and WHEREAS, the City Council previously determined on December 9, 2025, that the HEA is exempt from the California Environmental Quality Act ("CEQA") pursuant to Public resources Code section 21080.085 and CEQA Guidelines section 15061(b)(3); and WHEREAS, on February 2, 2026, the Los Altos Hills City Council held a duly noticed public hearing during its special meeting to consider approval of the additional minor revisions. At the public hearing, the City Council reviewed and carefully considered the proposed additional minor revisions and all evidence presented in the record and during the hearing. All interested parties were provided with an opportunity to participate and be heard. RESOLUTION 11-26 11 P a g e NOW, THEREFORE, BE IT RESOLVED that the City Council of the Town of Los Altos Hills hereby makes the following findings and decision: 1. General and CEQA Findings. Based on the entirety of the record before it, which includes, without limitation, the California Environmental Quality Act, Public Resources Code §21000, et seq. and the CEQA Guidelines, 14 California Code of Regulations § 15000, et seq. (collectively, "CEQA"); the Los Altos Hills General Plan and Housing Element; the Los Altos Hills Municipal Code; all, reports, minutes, and public testimony submitted to the City Council for this project including those as part of the City Council's duly noticed February 2, 2026 special meeting; and any and all other evidence (within the meaning of Public Resources Code §21080(e) and §21082.2), the City Council of the Town of Los Altos Hills hereby finds as follows: A. The foregoing recitals are true and correct and made a part of this Resolution. B. The documents and other material constituting the record for these proceedings are located at the Community Development Department for the Town of Los Altos Hills, 26379 Fremont Road, Los Altos Hills, and in the custody of the Community Development Director. C. Exhibit A attached to this Resolution, consisting of the proposed additional minor revisions to the Housing Element Amendment, is incorporated herein by reference as if it were each set forth fully herein. D. The proposed additional minor amendments are statutorily exempt from CEQA pursuant to Section 21080.085 of the Public Resources Code as CEQA does not apply to a rezoning that implements the schedule of actions contained in an approved housing element pursuant to subdivision (c) of Section 65583 of the Government Code. The additional minor amendments are a part of the Housing Element Amendment adopted by the City Council contingent upon HCD approval, and the Council previously determined on December 9, 2025 that said Amendment is exempt from CEQA pursuant to Section 21080.085. The additional minor amendments are a part of and do not change any substantive provisions of the Housing Element Amendment and thus are also exempt under the same provision. E. The proposed additional minor revisions are also not subject to CEQA pursuant to CEQA Guidelines section 15061(b)(3), because it can be seen with certainty that there is no possibility that the proposed amendments may have a significant impact on the environment. The proposed is a part of and does not change any substantive provisions of the Housing Element Amendment and continues to achieve internal consistency across land use documents and do not approve any particular project. They also would not impact the physical allowances for development projects. As such, it can be seen with certainty that the proposed additional minor revisions as a part of the Housing Element Amendment do not have a significant impact on the environment. F. As a part of the HEA, the proposed additional minor revisions remain consistent with and serves the other goals, programs, and policies in the Housing Element and allow the Town to continue to comply with state Housing Element and Housing Laws, as well as contribute to the Town's strategies in meeting its RHNA obligation. RESOLUTION 11-26 2 1 P a g e 2. Decision. Based upon the testimony received by the City Council, the background and findings set forth above and all other evidence in the administrative record, the Los Altos Hills City Council hereby approves additional minor revisions to the Housing Element Amendment, as shown in Exhibit A, subject to the Effective Date provision below. The City Council further authorizes the Community Development Director or their designee to make any other minor technical modifications to the Housing Element Amendment as necessary to respond to comments or requests from the State Department of Housing and Community Development (HCD) to achieve HCD certification of the Housing Element Amendment. 3. Effective Date. This resolution and the approval of the additional minor revisions to the Housing Element Amendment shall only become effective upon HCD certifying said Amendment as in substantial compliance with state law pursuant to Government Code sections 65585 and 65585.03. It is hereby affirmed that prior to HCD certification, the 2023-2031 Housing Element as certified by HCD on May 30, 2023, shall remain unmodified and in full force and effect and adoption of the Housing Element Amendment and additional minor revisions shall not take effect.
