HomeMy WebLinkAboutResolution 39-26 RESOLUTION 39-26 1 | P a g e RESOLUTION 39-26 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ORDERING AND CALLING FOR THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD ON TUESDAY, NOVEMBER 3, 2026, FOR THE ELECTION OF CERTAIN OFFICERS AS REQUIRED BY THE LAWS OF THE STATE OF CALIFORNIA RELATING TO GENERAL LAW CITIES; REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY OF SANTA CLARA TO CONSOLIDATE SAID MUNICIPAL ELECTION PURSUANT TO SECTION 10403 OF THE CALIFORNIA ELECTIONS CODE; PROVIDING FOR NOTICE OF THE ELECTION; AND ADOPTING UNIFORM POLICIES PERTAINING TO CANDIDATE STATEMENTS AND FEES WHEREAS, under the provisions of the laws relating to general law cities in the State of California, a General Municipal Election shall be held on Tuesday, November 3, 2026, for the election of municipal officers; and WHEREAS, the term of two (2) members of the Town of Los Altos Hills (“Town”) City Council is due to expire in December 2026 and the positions must be filled; and WHEREAS, it is desirable that the General Municipal Election be consolidated with the statewide general election to be held on the same date, and that within the Town the precincts, vote centers, election officers, and ballot processing procedures of the two elections be the same, and that the Santa Clara County Registrar of Voters canvass the returns of the General Municipal Election and that the election be held in all respects as if there were only one election; and WHEREAS, pursuant to California Elections Code Sections 10400, 10402, and 10403, the Town may request consolidation of its General Municipal Election with the statewide general election to be held on November 3, 2026; and WHEREAS, Elections Code Section 10002 authorizes the Town to request election services from the Santa Clara County Registrar of Voters and requires the Town to reimburse the County for services performed in conducting the election; and WHEREAS, Elections Code Section 12101 requires the City Clerk to publish notice of the election in the time and manner prescribed by law; and WHEREAS, Elections Code Section 13307 authorizes the City Council to adopt policies and procedures pertaining to candidate statements and associated costs and fees. NOW, THEREFORE, THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DOES HEREBY RESOLVE AS FOLLOWS: 1. Pursuant to Section 10403 of the Elections Code of the State of California, relating to General Law Cities, there is called and ordered to be held in the Town of Los Altos Hills, California on Tuesday, November 3, 2026, a General Municipal Election for the purpose of electing two (2) Members of the City Council, each for a full term of four (4) years. 2. Pursuant to Sections 10400, 10402, and 10403 of the California Elections Code, it is in the best interest of the public to consolidate the Los Altos Hills General Municipal Election with RESOLUTION 39-26 2 | P a g e the Statewide General Election to be held on November 3, 2026. The consolidated election will be held and conducted in accordance with the provisions of law regulating the statewide election. 3. Pursuant to Section 10002 of the Elections Code of the State of California, the Town of Los Altos Hills requests the services of the Board of Supervisors of the County of Santa Clara and the Registrar of Voters of the County of Santa Clara to render such s ervices to the Town as requested by the City Clerk and shall reimburse the County for the costs incurred by the County of Santa Clara Registrar of Voters in conducting the election for the Town. The Town requests the County of Santa Clara Board of Supervisors to permit the County of Santa Clara Registrar of Voters to prepare the Town’s election materials. The election services to be performed shall include the preparation, printing and mailing of official ballots and county voter information guides; the establishment of precincts, election ballots, return mail envelopes, ballot drop boxes, vote centers, and election officers; the canvassing of the returns of the election; the furnishing of the results of such canvassing to the City Clerk; and the performance of other election services as may be requested by the City Clerk. 4. The City Council of the Town of Los Altos Hills requests the Board of Supervisors of the County of Santa Clara to hold and conduct the municipal election in the manner prescribed in Section 10418 of the Elections Code of the State of California, and to further provide that the Registrar of Voters canvass the returns of the municipal election. The County of Santa Clara is hereby authorized to certify the returns of the municipal election. 5. Pursuant to the requirements of Section 10403 of the Elections Code, the Board of Supervisors of the County of Santa Clara is hereby requested to consent and agree to the consolidation with the Town of Los Altos Hills of a General Municipal Election with the Statewide Election on November 3, 2026, for two (2) Los Altos Hills City Council seats. 6. The Board of Supervisors is requested to make available the services of the Registrar of Voters of the County of Santa Clara for the purpose of providing the usual services necessary in conducting said election, including, but not limited to, the provision of election supplies, voter pamphlets, ballots, notices, printed materials and all supplies, equipment and paraphernalia necessary to properly and lawfully conduct the election. 7. The Registrar of Voters is authorized to specify the location for the tally of ballots, canvass the results of the two City Council seats and certify the results to the City Clerk of the Town of Los Altos Hills. 8. The City Clerk shall file a certified copy of this Resolution with both the Santa Clara County Board of Supervisors and the Santa Clara County Registrar of Voters. 9. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. 10. The City Manager is authorized and directed to compensate Santa Clara County for the cost of conducting the General Municipal Election for the Town. RESOLUTION 39-26 3 | P a g e 11.The City Clerk is hereby authorized and directed to publish a Notice of General Municipal Election within the time and manner specified in Section 12101 of the California Elections Code. 12.In all particulars not recited in this Resolution, the election shall be held and conducted as provided by law for holding municipal elections. 13.Pursuant to Sections 10228 and 13307 of the California Elections Code, the City Council approves and adopts the following uniform policies and procedures concerning the General Municipal Election to be held on November 3, 2026: a)Each candidate for elective office to be voted for at an election to be held in the Town of Los Altos Hills on November 3, 2026, may prepare a candidate statement on an appropriate form provided by the City Clerk. The statement may include the name, age and occupation of the candidate and brief description of no more than 200 words of the candidate’s education and qualifications expressed by the candidate. b)The statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. c)The statement shall be filed in typewritten form in the office of the City Clerk at the time the candidate’s nomination papers are filed. The statement may be withdrawn, but not changed, during the period of filing nomination papers and until 5:00 p.m. on the next working day after the close of the nomination period. d)Candidates shall be exempt from charges for the cost of translations mandated by the Federal Voting Rights Act and the preparation and mailing of Candidate Statements e)Candidates shall be exempt from payment of any filing fee. f)In the event of a tie vote, the City Council, in accordance with Elections Code Section 15651(a), shall set a date, time, and place and summon the candidates who have received the tie votes to appear and will determine the tie by lot. g) Pursuant to the Federal Voting Rights Act, candidate statements will be translated into all languages required by the County of Santa Clara.
