RESOLUTION 70-26
A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS
MAKING A CATEGORICAL EXEMPTION DETERMINATION UNDER THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT (“CEQA”) AND APPROVING A
CONDITIONAL USE PERMIT RENEWAL AND AMENDMENT FOR WESTWIND
COMMUNITY BARN AT 27210 ALTAMONT ROAD.
WHEREAS, on April 20, 1977, The Town of Los Altos Hills approved an application for a Conditional
Use Permit (File #CUP 8022-77) at City Council public hearing for a commercial stable for Westwind
Community Barn; and
WHEREAS, on April 2, 2026, The Town of Los Altos Hills received an application for Conditional
Use Permit (#CUP26-0002) requesting permit renewal and amendments to existing conditions of
approval from Westwind Barn Manager, Victoria Dye; and
WHEREAS, based on the record presented before it, the project is exempt from the provisions of the
California Environmental Quality Act (CEQA) pursuant to Sections 15301, Class 1, as no physical
changes to existing structure are proposed;
WHEREAS, the project application was processed in accordance with the applicable provisions of the
California Government Code and the Los Altos Hills Municipal Code; and
WHEREAS, the Planning Commission held a duly noticed public hearing on June 8, 2026, and
considered all evidence, testimony, written documentation, and public comments presented regarding
the Project, and unanimously adopted a recommendation that the City Council approve the Project; and
NOW, THEREFORE, based on the entirety of the record before it, the City Council of the Town of
Los Altos Hills hereby finds that the Project is exempt from CEQA pursuant to CEQA Guidelines
Sections 15301, Class 1 and approves the Conditional Use Permit renewal and amendment to existing
conditions subject to the findings and conditions contained in Exhibits “A” and “B” and incorporated
herein by reference.
The above and foregoing Resolution was passed and adopted by the City Council of the Town of Los
Altos Hills at a City Council meeting held on 20th day of August 2026 by the following vote:

FINDINGS
Westwind Community Barn – 27210 Altamont Road – File# CUP26-0002
Conditional use permits shall be granted by the City Council only when it is found that:
1. The proposed use of facility is properly located in relation to the community as a whole, land uses,
and transportation and service facilities in the vicinity;
The commercial stable use is appropriately located on the project site, which is adjacent to Byrne
Preserve and has access from Altamont Road, a collector roadway capable of accommodating
associated vehicle trips. The facility has operated in good standing since its original approval, and
staff's site inspection confirmed that the property is well maintained and generally compliant with
the existing conditions of approval.
2. The site for the proposed use is adequate in size and shape to accommodate the proposed use and all
yards, open spaces, walls and fences, parking, loading, landscaping, and such other features as may
be required by this chapter or, will be needed to assure that the proposed use will be reasonably
compatible with land uses normally permitted in the surrounding area
The 14.96-acre project site is adequately sized and configured to accommodate the existing
commercial stable use and associated operational activities. The proposed project involves only
modifications to operational conditions and renewal terms and does not include any physical
expansion or changes to existing structures. The site continues to comply with existing conditions of
approval and maintains adequate area for parking, circulation, open space, and other required
improvements, ensuring compatibility with surrounding land uses.
3. The site for the proposed use will be served by streets and highways of adequate width and pavement
to carry the quantity and kind of traffic generated by the proposed use.
The project site is adequately served by Altamont Road, a 60-foot-wide collector roadway that
provides sufficient access for the commercial stable use. The proposed amendments would increase
the frequency of permitted horse shows but would not increase traffic or parking demand beyond
the site's existing operational capacity. Accordingly, the existing roadway network is adequate to
accommodate the proposed use.
4. The proposed use will not adversely affect the abutting property or the permitted use thereof.
The proposed project consists of renewing the Conditional Use Permit and amending operational
conditions for an existing commercial stable facility. No physical expansion or modifications to
existing structures are proposed. The facility has historically operated in compliance with
applicable conditions of approval, and the proposed amendments are not anticipated to result in
significant impacts to neighboring properties. Therefore, the proposed use will not adversely affect
adjacent properties or their permitted uses.

CONDITIONS OF APPROVAL

PLANNING DEPARTMENT
1. All conditions of the Westwind Barn Conditional Use Permit approved by the City Council on April
20, 1977, and as amended on January 9, 1985, April 26th, 1995, and September 12th, 2002, and
March 21, 2005, shall remain in effect except as modified by this permit, and shall be conditions of
this approval
2. The perimeter of the upper hillside portion of the feeding pasture shall be permanently fenced and
animals shall have no access to this area. (CUP #39-02 renewal March 3, 2005)
3. The operation and facility shall be subject to annual inspection by the Parks and Recreation
Committee to confirm conformance with these Conditions of Approval. Pursuant to the
concessionaire agreement, the concessionaire shall comply with and facilitate such inspections. Any
noncompliance shall be reported to the Planning Department, which may take action as provided in
Item 4. (Amended by CUP#26-0002)
4. In the event that any of the conditions of this permit are not satisfied, the Planning Department may
cause a noticed public hearing to be sent to review whether the permit should be continued; and upon
a showing of compelling public necessity demonstrated at the noticed public hearing, the Town may
add, amend, or delete conditions and regulations contained in this permit. (CUP #11-95)
5. This permit does not authorize the applicant to intensify the authorized activity beyond that which is
specifically described in this permit. (CUP #11-95)
6. This Use Permit shall be issued in the name above and the life of this Permit shall run with the life
of the ownership of the property or until it is amended or cancelled. (Property designated as parcel
# A&4, 14.96 acres.) (CUP #8022-77)
7. The number of horses to be kept or maintained at this facility shall not exceed 65. (Amended by
CUP#26-0002)
8. Any proposed new buildings or structures shall require an amendment to this Use Permit. (CUP
#8022-77)
9. There shall be twenty-four (24) hour supervision of said premises by a competent attendant who is
knowledgeable about horse care and authorized to see that the conditions of this Use Permit are met.

10. A business License shall be required and shall be renewed annually on January 1st, as long as all
conditions of this Use Permit have been met. (Amount of fee is specified by Section 3-1.209 of LAH
Municipal Code.) (CUP #8022-77)
11. Staff, Planning Commission and City Council shall conduct a review of this Permit every ten (10)
years to ensure compliance with conditions and all conditions shall be subject to amendments and/or
additional conditions as deemed necessary by the City Council. (Amended by CUP#26-0002)
12. All requirements of the Santa Clara County Health Dept. shall be met:
a. Drainage from stables, corrals, pens, barns, etc. must not enter a natural watercourse.
b. Animal quarters must be swept clean, sprayed and otherwise kept in a sanitary manner so as to

prevent unnecessary odor, fly breeding and rodent attraction.
13. Manure shall be disposed of regularly by spreading, collection in an appropriate bin or removal from
site. (CUP #8022-77)
14. All requirements of the Los Altos Fire Department shall be met as designated by the office inspecting
the facility. (CUP #8022-77)
15. There shall be no external lighting, other than that needed for safety and security. All fixtures should
be adequately shielded to prevent any nuisance to adjoining property owners. (CUP #8022-77)
16. All driveways, parking areas, and horse riding areas shall be maintained in a manner sufficient to
control dust to a level compatible with adjoining uses. Except as otherwise permitted by this use
permit, the cars of guests and visitors shall at all times be parked on the property. (CUP #8022-77)
17. Public riding instructions may be given. This shall be under the supervision of qualified instructors.

18. Parking of horse trailers limited to twenty-four (24) hours except for horse trailers not exceeding six
(6) at any time, belonging to lessee or its management. Parking of the horse trailers shall be restricted
to Lot 4. (CUP #8022-77)
19. Any horse breeding operations are to be conducted in an enclosed, discreetly located area during
normal working hours and in a safe manner. (CUP #8022-77)
20. The applicant shall maintain existing trees and shrubs for landscaping to mitigate the visual impact
from offsite. Such landscaping shall not interfere with buildings or the program at the site. The
condition of the trees and shrubs shall be evaluated every spring and the replacement, as needed, to
maintain the mitigation of off site view, shall occur by June 1 of each year. (Amended by Planning
Commission January 9th, 1985)
21. All equipment necessary for the operation of the stable shall be kept in good repair. Equipment
generating noise shall be subject to the Town's noise ordinance and a time schedule approved by the
town. (Amended by Planning Commission January 9th, 1985)
22. There shall be no more than five (5) horse shows per year, to be held between 9:00 A.M. and 5:00
P.M. A schedule of these shows and other scheduled events must be filed with the Town, in writing,
at least seventy-two (72) hours prior to an event. Street and/or driveway parking will be allowed at
the discretion of Town staff. When there is parking in the streets or driveway, parking attendants as
requested by Staff will be present. (Amended by CUP#26-0002)
23. Use of a public address system shall be limited to the permitted horse shows and for other special
events with prior City Council approval and used in such a manner as not to be a nuisance to the
adjacent property owners. (Amended by Planning Commission January 9th, 1985)
ENGINEERING DEPARTMENT
24. Any, and all, changes to the existing grading and drainage plan shall first be approved by the
Engineering Department. No grading shall take place during the grading moratorium between
November 1 and April 1 except with prior approval from the City Engineer. No grading shall take
place within ten feet of any property line. (CUP #11-95)

impose any fees, dedications, reservation or other exactions under the California Government Code

Section 66000, you are hereby notified that these Conditions constitute written notice of a statement of
the amount of such fees, and/or a description of the dedications, reservations, and other exactions. You
are hereby further notified that the 90-day approval period in which you may protest such fees,
dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has
begun. If you fail to file a protest within this 90-day period complying with all requirements of Section
66020, you will be legally barred from later challenging such exactions.
