RECOMMENDATION: That the Planning Commission:
Forward a recommendation of approval to the City Council with the requested
Conditional Use Permit Amendment to allow the City Council to review and approve one
time "Special Events" that exceed 200 participants.
BACKGROUND
Site -
The Fremont Hills Country Club property is a 17 -acre site located on Viscaino Place and
has frontage on Roble Ladem Road and Purissima Road. The facility provides its
members with a club house, swimming pool, tennis courts, and equestrian facilities. The
site contains 147 onsite parking spaces. The property is bounded by single family
residences to the north and east and the Little League Fields to the southwest.
The Fremont Hills Development Company was granted approval to operate the Fremont
Hills Country Club by the City Council on November 14, 1957. The Use Permit
conditions for the property are attached to this report. (Attachment 1)
Event -
The Grand View League hosts an annual event (The California Baron's Ball) for the
benefit of the American Cancer Society. The event is scheduled in the evening and
provides food, drinks, games, music, and entertainment. In previous years the event has
been held in San Jose, Atherton, and Sunnyvale. This year's event has a Country and
Western theme titled "Back in the Saddle". The Grandview League is requesting to host
the event at the Fremont Hills Country Club. The Grand View League anticipates 600+
guests and 150 volunteers for the event scheduled on September 29, 2007. Please find the
event description prepared by the Grand View League attached (Attachment 3).

Currently, condition #13 of the use permit limits the number of special event participants
to 200. It is recommended that Fremont Hills Country Club Use Permit condition 413 be
amended to allow a maximum of one (1) special event per year when the size of the event
would exceed 200 persons. The special event would be subject to City Council review
and approval.
The proposed condition #13 amendment is as follows:
13. Fremont Hills Country Club shall maintain 147 parking spaces (108 in the lower
lot and 39 in the upper lot), shall provide adequate off-street parking for all
members and guests, and shall direct traffic to other facilities if an overflow
should occur. The Club is required to provide necessary personnel to assure all
members and visitors park on the premises when attending swim meets, horse
shows or using Club facilities.
Fremont Hills Country Club shall provide the City Clerk (for distribution to the
Planning Commission and City Council) and the Sheriff with a calendar of events
on a yearly basis. All parking shall be accommodated on site. If not, public
parking areas shall be used (valet service, shuttle, etc.). All ,.peei_t evef'- shall be
lifnited to 200 pie4iGipaats. For events that are expected to have more than 200
persons in attendance at any one time (a "Special Event'), the applicant shall
submit a written request to the Planning Department at least 60 days prior to the
date of the Special Event. The Planning Department shall submit the request to
the City Council for a review hearing. Property owners within 500' of the
premises shall be notified of the proposed event and review hearing. A maximum
of one (1) special event shall be permitted during any one (1) calendar year.
DISCUSSION
Event Activities
The event will be centered in the large riding arena at the south end of the property, near
the Roble Ladem Road and Purissima Road intersection. The event is scheduled to start at
5pm with a pre -party for V.I.P guests. The main event will start at 6pm. The event will
provide themed food service, bar and beverage service, country fair type games, live and
silent auctions, country and western band, magicians, and square dance demonstrators,
etc.
Parking
Pursuant to Section 10-1.602 of the Municipal Code, "parking areas for conditional uses
shall be adequate to accommodate all vehicle storage requirements for maximum
foreseeable assemblies without resorting to adjoining roads to interior driveways for

parking." There are 147 existing parking spaces on the property, which is adequate to
accommodate the parking needs during regular operations.
The V.LP guests and some volunteer staff will be using the regular parking facilities on
site. The applicant is requesting that the Town allow overflow volunteer parking along
the roadside adjacent to the Little League Fields as needed (this allowed under the Little
League's CUP (58 -04 -CUP) for their large events). The primary guest parking will be at
SAP Labs on Hillview Avenue in Palo Alto and guests will be shuttled to and from the
Fremont Hills Country Club.
Valet and Shuttle services will be provided by Corinthian Parking Company. A total of 11
staff members will be assisting guests with parking and transportation to and from the
event.
Amplified Sound
The applicant has requested the use of an amplified sound system within the large riding
arena. The system uses "Line Array" technology which, the applicant asserts, allows the
sound to be directed and focused and has been successfully used in previous event that
were held in residential and school use areas. The applicant has provided additional
details and a letter of commendation from a previous event for the proposed system.

The stage will be set facing west and sound will be generally directed away from
surrounding residences and toward the Little League Fields and Highway 280 beyond.
The existing Use Permit condition #10 requires that no amplified sound be allowed after
11:30 p.m. The event will conclude at l 1pm.
Lighting
Temporary lighting will be installed will be installed in five (5) different areas:
• Perimeter lighting will be provided for safety purposes. The lighting will be
mounted to faux trees and focused downward.
• Event lights will be located and focused in the arena. Shutters will be adjusted to
keep the lighting within the arena boundaries.
• Low wattage (25 watt max) decorative stringer lights will be hung inside the
arena.
• Stage lighting is highly controllable and will be focused only on the stage.
• Inside the canopies retail type lights will be hung from the ceiling to illuminate
the items for sale.

The applicant has provided additional details for the proposed lighting. (Attachment 6)
Medical Services
The applicant has hired Golden State Ambulance to provide ambulance and medical
services on site throughout the event.
Security Services
Event security will be provided by Rick Hems Productions. They will provide five (5)
private security guards. Security staff will also assist with traffic and circulation in the
parking lot of Fremont Hills Country Club during primary arrival and departure times.
Santa Clara County Fire Department Comments
The Fire Department has issued a one day event permit to the applicant. A fire inspector
will inspect the site, temporary canopies, fire extinguishers, and exiting prior to the start
of the event. The Fire Department Permit is attached to this report. (Attachment 5)
Santa Clara County Sherriff Comments
The Sherriff requested that Town staff send a reminder one week prior to the event so
they can notify the evening patrols. The Sheniff initially commented to Town staff that
there is a potential issue with traffic arriving and departing from the parking lot on site.
Town staff reported back to the Sherriff that Corinthian Parking Company and Rick
Hems Productions will provide traffic control throughout the event. The Sherriff was
satisfied that the hired staff could manage the parking and traffic.
Neighborhood Outreach
According to the applicant, the Grandview League has sent a neighborhood outreach
letter (Attachment 4) to all neighbors within 500 feet. The letter invited neighbors to
attend an open house at the Fremont Hills Country Club from 4pm to 6pm on June 9,
2007 to find out more about the event and share concerns. The applicant followed up with
Town staff and reported that no neighbors attended the open house.
CONCLUSION
The amended Use Permit condition 413 will allow the Town discretionary authority over
specific events proposed at the Fremont Hills Country Club. Neighborhood notification
will be required and a public hearing will be held. Currently, the Fremont Hills Country
Club is restricted from hosting large events with greater than a 200 persons. The amended
condition allows for more flexibility with regard to the use of the site and will still assure
that the proposed use will not result in any negative impacts to neighbors and residents.
The Grandview League's proposed event is well organized and the applicant has met all
Town, Fire, and Sherriff requirements. They have also performed a neighborhood
outreach program and not received any opposition or concerns regarding the proposed
one day event.

RECOMMENDED CONDITIONS OF APPROVAL FOR A
CONDITIONAL USE PERMIT
FOR OPERATIONS AT FREMONT HILLS COUNTRY CLUB

PLANNING DEPARTMENT
1. The continuation of this Conditional Use Permit shall be issued to Fremont Hills
Country Club for the property designated as Parcel 175-55-46, 12889 Viscaino
Place (17.03 gross acres).
2. The maximum number of horses to be kept or maintained at this facility at any
one time is 55.
3. The maximum floor area and development area allowed under this permit are as
follows:
MDA at 212,313 sq. ft.
MFA at 29,742 sq. ft.
4. There shall be twenty-four (24) hour supervision of said premises by a competent
attendant who is knowledgeable about horse care and authorized to see that the
conditions of this Use Permit are met.
5. A Business License from the Town shall be required for the both the Country
Club and the stable operations, and shall be renewed annually on January first, as
long as all conditions of this Use Permit have been met.
6. Staff, Planning Commission and City Council shall conduct a review of this
Conditional Use Permit every three years to assure compliance with conditions
and all conditions shall be subject to amendments and/or additional conditions to
assure that the public health, safety and general welfare are protected and that the
objectives of the General Plan and Zoning Ordinance are served, as deemed
necessary by the Planning Commission and City Council.
7. All requirements of the Santa Clara County Health Department and Palo Alto
Animal Control shall be complied with throughout the life of this permit:
a. Drainage from stables, corrals, pens, barns, etc., shall not enter a natural
water course.

b. Animal quarters must be swept clean, sprayed and otherwise kept in a
sanitary manner so as to prevent unnecessary odor, fly breeding and rodent
attraction.
C. Manure shall be disposed of regularly by spreading, collection in an
appropriate bin and/or removal from site at least six times per year. Any
changes to the plan for the maintenance and removal of manure shall be
approved by the Town
d. The horses shall be moved to an upper corral by November first, and shall
remain there until April first or the end of the rainy season, whichever is
later.
e. A shelter shall be constructed for the horses in the upper conal no later
than November 1, 1997. The shelter may be temporary so that it can be
removed during the remainder of the year when the horses are in the lower
conal.
f At such time that the lower corral fencing needs to be repaired or replaced,
the fencing shall be changed so that it is all one material (wood is
preferred, and should be treated to prevent horses from chewing on it). No
hot wiring is permitted on the lower corral fencing.
g. The loafing shed in the lower corral shall have rounded comers for the
protection of the horses.
Any new outdoor lighting shall be approved by the Planning Department, prior to
installation. There shall be no external lighting, other than that needed for safety
or security. All fixtures shall be adequately shielded to prevent any nuisance to
adjoining property owners. Tennis court lighting is specifically prohibited.
9. All unpaved driveways, parking areas and horse riding areas shall be maintained
in a manner sufficient to control dust to a level compatible with adjoining uses.
The same type of sand material currently utilized in the large ring off Roble
Lades shall be used in the smaller ring m well.
10. All functions shall be required to end at 12:00 midnight, except on New Years
Eve, and no amplified sound shall be allowed after 11:30 p.m. Alcohol shall not
be served later than one hour prior to the end of an event.
11. No additional outdoor public address system is permitted. The existing public
address system shall be limited to use at five horse shows per year and may be
operated only between the hours of 10:00 a.m. and 4:00 p.m.
12. All bam foundations shall have a minimum earth to wood separation of six (6)
inches. Surrounding areas shall be properly graded (or alternate methods used) to
provide drainage away from all structural foundations for a distance of five (5)
feet from the building.

14. The maximum number of memberships to the Club shall be limited to 500
member families.
15. If at any time the parking needs of the Club exceed the availability of parking on
site, the Town shall review the permit for further requirements. If it is determined
that the Club needs an expansion of parking upon the six (6) month review or
every three (3) year review, the Club shall return to the Planning Commission
with a modification showing enlargement of the puking areas to accommodate
additional parking on site.
16. All landscaping on the premises shall be properly maintained. If any trees need to
be removed, prior approval of the Planning Department is required. Replacement
tree(s) may be required at the discretion of the Planning Director. Any planting
that is providing screening, and landscaping in parking lots and on slopes is
required to be replaced if removed for any reason.
17. In the event that the Planning Director believes any of the conditions of this
permit are not satisfied, the Planning Department may cause a noticed public
hearing to be set to review whether the permit should be continued; and upon a
showing of compelling public necessity demonstrated at the noticed public
hearing, the Town may add, amend, or delete conditions and regulations contained
in this permit.
18. Monitoring and reporting to the Town shall be accomplished by the Club for the
stable operation near the creek and shall include an emergency plan. The plan

shall remain on file at FHCC and at the Town. Any amendments to the plan
require Town approval.
19. Concentration of animal wastes or other nutrients shall be prevented from entering
the creek.
a. No stockpiling of manure shall be done closer than 100' from the creek.
b. The corral adjacent to the creek shall be cleaned out weekly to prevent an
accumulation of animal wastes or other nutrients.
C. The vegetated buffer strip shall be maintained between the creek and the
corral to assist in filtering nutrients.
d. Horses shall be moved from the lower paddock in wet weather (from
November first until the end of the rainy season, or April first, whichever
occurs later).
20. Any, and all, changes to the approved grading and drainage shall be approved by
the Town Engineering Department. No grading shall take place during the
grading momtorium (November 1 to April 1) except with prior approval from the
City Engineer. No grading shall take place within ten feet of any property line.
FIRE DEPARTMENT
21. The following requirements of the Santa Clara County Fire Department shall be
complied with:
a. All buildings and their usage shall meet applicable Town, County, and
State fire and life safety regulations.
b. All buildings which presently are protected by fire sprinklers shall have
the State mandated 5 -year inspection by a state licensed fire sprinkler
contractor. Records of the inspections shall remain on the site.
C. Remodeled and/or additions to buildings protected by fire sprinklers will
require the modification of the existing systems) to the satisfaction of the
Fire Department.
d. The shavings barn shall be completely protected by fire sprinklers.
e. A fire sprinkler system shall be installed in the small horse bam, and shall
be inspected and approved by the Fire Department.
f The fire sprinkler system in the caretaker's unit shall be inspected and
approved by the Fire Department.
g. Weeds on the property shall be cut, disked or removed in the spring (on or
about Mach 31) to avoid a fire danger prior to the start of fire season.

FINDINGS FOR APPROVAL OF CONDITIONAL USE PERMIT

1. The proposed use or facility is properly located in relation to the community
as a whole, land uses, and transportation and service facilities in the vicinity;
The General Plan Recreation Element identifies the land use designation of the
subject property as a Private Recreation Area. The use of the facilities by the
Fremont Hills Country Club is compatible with its land use designation and the
facilities are properly located in relation to the community as a whole. Access to
the site is available, and adequate utilities already exist on the site.
2. The site for the proposed use is adequate in size and shape to accommodate
the proposed use and all yards, open spaces, walls and fences, parking,
loading, landscaping, and such other features as may be required by this
chapter or will be needed to assure that the proposed use will be reasonably
compatible with land uses normally permitted in the surrounding area;
The subject property is over 17 acres in size and large enough to accommodate the
tennis courts, equestrian facilities, swimming pool, parking areas and related
amenities. The site and structures are in compliance with all previous approvals.
Project conditions will restrict the impacts resulting from activities on the site and
ensure that the proposed use will be reasonably compatible with land uses
normally permitted in the surrounding area.
3. The site for the proposed use will be served by streets and highways of
adequate width and pavement to carry the quantity and kind of traffic
generated by the proposed use;
The site has access directly to Viscaino Place which provides connection to
Viscaino Road. Parking is available on the site (147 spaces). During large events
where overflow puking will occur, parking will be restricted on surrounding
neighborhood streets except along Purissima Road to ensure minimal disruption
to the neighborhood.
4. The proposed use will not adversely affect the abutting property or the
permitted use thereof.
Project conditions including restrictions on amplified sound, lighting, and parking
will help ensure that abutting properties are not adversely impacted.

ATTACHMENT
The Grand View League is proud to announce their selection of Fremont Hills Country
Club in Los Altos Hills as the site for this year's Ball, themed "Back in the Saddle". The
mission of the Grand View League is to support the American Cancer Society by
planning, coordinating and hosting this annual event, and raise awareness for the cause.
The 12' Annual California Baron's Ball has helped the American Cancer Society raise
just under $10 million dollars. The event is held every year, at the end of September and
invites some of Silicon Valley's top executives to help fight to find the cure for cancer.
The event provides themed food service, country fair type games, and opportunities to
win prizes in both live and silent auctions. A country western type band is hired as
background entertainment (the band is not the main focus — fundraising is), as well as
strolling guitar players, magicians, square dance demonstrators, etc. The event is written
up in several local publications such as San Jose Magazine, San Jose Mercury News, as
well as other local newspapers. NBC 11 and KRTY radio are also media sponsors.
Per our agreement with FHCC, we would like to set-up for the event on September 28
and 29`h, host the event on the evening of the 29'b, and breakdown / clear away on
September 30th. We respectfully request that Los Altos Hills support this event and grant
the temporary -use -permit request, addending the existing permit held by FHCC to host
this single night, single occurrence event.

Parking Considerations:
1. Volunteers park along baseball diamonds and walk to event
2. VIP are offered valet at the entrance, their cars are parked onsite at FHC C
3. Attendees park at SAP parking lot and are shuttled in by professional service
(See attached quote from Corinthian Valet service)
Sound/Lighting Requirements:
1. Lighting design calls for adequate lighting in all areas, including valet, drop-
off, pathway, prep and main arena. The lights add a festive atmosphere
throughout but with safety and retail in mind:
-2000' of festival stringer lights
-Retail lighting in tented spaces only (General Store + Silent Auction)
-Colorful dance floor lighting (on trussed system, focused to this area)
-Theatrical lighting at stage (on trussed system, focused to this area)
2. Sound: A state of the art "Line Array" sound system that will provide clear
sound, focused inside the arena. The system will include wireless mics for the
MC and Auctioneer so that they can leave the main stage and still be heard. This
system keeps the sound within the proposed area, minimizing travel into the
surrounding neighborhood.
First Aid Considerations:
An EMT service is provided onsite for the duration of the event (see attached map
for location). See attached quote from Golden State for services description.

Plan for Lighting at
California Baron's Ball

The objective of the plan for lighting at this event is fourfold:
1) Provide adequate, perimeter lighting for safety of attendees
2) Provide adequate lighting for the main event areas
3) Provide theatrical lighting for the stage presentations
4) Do not let the lighting bother the neighbors
To this end, we have devised the following plan:
All perimeter, safety lighting will be mounted on heavy duty lighting "trees" enabling the
lights to be mounted high, and focused down, towards the ground.
All event lighting will be focused within the horse riding ring and we will use shutters on
the lights to keep it confined with the borders.
Decorative "stringer lights' used to decorate the ring's perimeter are only 25 watts.
Stage lighting is highly controllable and focused only at the stage.
Bright, "retail" style lighting, used to illuminate items for sale is confined within a covered
tent.

The objective of the plan for sound at this event is twofold:
1) Provide adequate sound coverage over the event area
2) Do not disturb the neighboring residences
To this end, we have devised the following plan:
We will use a JBL Vertech 4889 sound system, using "Line Array" technology. Line
array sound systems provide extremely focused and controllable sound patterns. We
can focus the speakers to broadcast clear sound inside the arena with very little
dissipation outside the boundaries.
The sound system will be checked and monitored on Friday, the day before the event.
This system has proven itself many times in areas where the sound needed to be
focused within a confined area. In 2005, we produced the largest picnic in Santa Clara,
with 4500 guests in Central Park. The park is adjacent to a residential neighborhood
and an elementary school. Please read the attached letter of commendation we
received from the school principal.
