(a) Commissioner Garbett; reported on the flay %m Council meetinJ,
rarticularly referring ti, the action taken on the -Theeler
Subdivision. Chairman iibrer stated the -ire Coirission is
deeply concerned over the hazardous conditions which exist
in this area, as mol as other parts of the Town, ar_2 that
nroner roads and access -Iust be the paramount issue in
future subdivision in this area.
ht the req¢est of the Commission, Chairmar.'-Iibner read

(b) Park Element in General Flan.
L Commissioner Garbett also reported the Council had
requested Mr. lestor Parrett, Town T'Ianning Consultant,
to direct a letter to the Commission setting, forth pre-
liminary recommendations for parks and that the Connission
begin discussion as soon as ,ossible.
Com^ission will a,,,ait word from Mr. '3arrett before any
discussion is undertaken.
2. Paths,- Commissioner ?arbett.
(a) Since the cross-section of the County design of the re-
constructed portion of Arastradero Road makes no provision
for paths and since paths in this area are a part of the
::aster Fath Flan, Commissioner 4arbett requested clarifica-
tion of the County's intent.
The City T'ienager advised no paths as such are planned in
this reconstructed portion, however, a portion of the
realignment of mrastradero, from Furissima to Page Mill
Roads, will come under the Town's jurisdiction, and
suggested the planning Commission request in writing that
provision be made for said paths.
(b) Commissioner Garbett referred to Mrs. D. 1.. Ginzton's
letter dated March 13t^ addressed to Chairman Hibner, com-
menting particularly on the 17ederal 31ighway Code, Section
319, Lands c_a in , in that this section might apply to
pathways. given though the contracts with the State Highv:ac
Department were signed before some of the quoted amendments
were made, none the less it seemed advisable to bring
this to the attention of the Commission.
Chairman Hibner will. study Mrs. Ginzton's letter and pose
a question to the City Attorney for his advice as to
v.Jhether the Town has the legal right to reauest the use of
Public funds, up to the 3%, for such uses as pathways,
trails, etc.
'p,'.d EIISIN E SS:
1. }review of Variance tplication.

for the above form, it was requested the item: be leletedfrom
the --nda and at such tine Commissioner Prentice is present,
the matter can be reviewed.
City Manager advised the Planning Commission that the terms of
Commissioners Prentice and =arbett expire as of this date.

The,operty is located on I"ircnda PoaD (sh,,,wn on man as

3, ani 4 and there is a Driveway easement over lot ;`5 to serve
lot - `C,. .11though the ordinances require that an eesement must
be deducted from the net acreage of a subdivision over £ive
lots, 71gnning Commission were of the opinion a Conditional
Uxcert, ion could be granted in view of an inspection made by
the iiap Committee. It was found the division mates the best
4W use of the land and there is a surplus of acreage beyond the
one acre minimum in a number of the lots; thus an exchange of
lot lines would serve no reel purpose. Frorerty is bounded
on the rear property line by the ^oothill expressway right of
way and noted no variance would be required for the house since
this was an existin6 structure before the County changed the
rear rroperty line.
In regard to paths, Mrs. Ginzton asked about the possibility
of a continuous path through the County Expressway Property is
ght of
way and was advised this is not possible since the
r resenbly fenced and there is no access between this property
and. the ..ounty right of way.
Check List was prepared, withthree additional conditions.
