Ginzton, Vice -Chairman, Los Altos Hills Pathways Committee, letter dated July 19, 1966,° „ Deferred to end of Agenda.. VARIANCES 1, Carson M. Kel (V-263-66) - Request for Reduction in Setback Requir�te-tContinued from July 11th meeting.) City Clerk reported that the two previous objections from K„ E Phillips and Mr. and Mrs. A. D. MacDonald have been rescinded, however, two new letters of objection have been received from Mr., and Mrs, Le B, Nelson and R. W, Hei.msoth and read by Chair- man Hibner, Mro D. M, Fleming was present acid reaffirmed his objections as stated at the July 11th meeting. Above residents reside on Esperanza Drive, Mr, Carson was present and stated his plans to Put new siding on the cottage, change the color and make the roof of the garages one level; however, he could not commit himself to a limitation of its. existence in view of the unforseeable future.. Following discussion on the objections of the neighbors and the perpetuation of the structure, the Planning Commission considered the variance on its own merits since the request was for a reduction in setback and not an appraisal of the buildings, VARIANCES: Carson (Cont'de), RECOMMENDATION; That the application of M. Kat Carson (V-263-66) be rejected. MOTION: Sherlock; SECOND: Minckley Mr. R. Ewart, realtor, appealed to the Commission on behalf of ":r, Carson. The Question was calleda VOTE' Passed unanimously. Chairman Hibner advised Mr� Carson of his right to appeal to the Co':ncil. USE PERMIT: 1, Roman Catholic Orphanage Asylum(UP-264-66) - Request for Relocation of Present Dormitory Facilities (Mt,. Helen Chi1dreri School), In view of unforesecn requirements, Mre B. P„ Oliver, represent- ing the Board of Roman Catholic Orphanage, requested the application be withdrawn, without prejudice, for the present t imQ . DIVISIONS OF LAND; Tentative Mapo (Item #2 was reviewed firsts) 2. Dusenberry, Arthur W. (326-66) 2 lots - Riley & Floyd. Mr, A, :4. Dusenberry and Dr, K. Bewley have requested a re- location of lot line to add Oa235+ acre to a substandard lot existing before the incorporation of the Town, and noted on Mac as Parcel 4*1, Burke Circle (a private road). Chairman Hibrier cointed out that the addition will total exactly two acres if added to the adjacent Bewley property, and, if there is any thought of future subdivision into one acre to{;s, more acreage :mould be needed in order to provide for dedication, He also pointed out there would be a condition- al exception of more than five homes on a private read, No Check List was prepared, P.P.COMMENDA'PIONs 'Phat the Tentative Map of A, We Dusenberry and Dro Kay M. Bewley be approved, with permission to file a Parcel Map. MOTION PRENTICE, SECOND: Ashby, 'VOTE. This plan is acceptable to the• Fire Chief,. It was the opinion of the Commission and the interested partici that this plan had merit, how._ver, Engin�_,r Flo stated In, new concept of a. through street deviates from the cul -d -sac road, on which basis the lots in Unit 1 have been sold,. It was pointed out that it is the oroper function of the Planning Commission t:o plan and require a road pattern for the promotion of the public health, safety and welfare cf the community and that the proposed through road should no lona�r Lie objectionable since it would be a windino, neighborhood street with a 40' right of way., which would not attract huavy through traffic, RECOMTiENDAT1 ON : 'That the tentative Map of Champagne. F-ights Unit 02 dated June 1966 be rejected, without prejudice, in that the cul -de --sac as shown is not accuptableo MOTION, Ashby; SECOND. Prentice; VOTE. Passed unanimously. It was suggested that Engr. Ho submit a revised map in accord- ance with Commissioner Hinckley's study. Chairman Hibnc:r thanked Commissioner Minckley for his detailed study with the thought there, should bo more neighborhood plan lines, Commissioner Ashby was excused at 9.35 P. M. Ginzton, Vice -Chairman, Los Altos Hills Pathway- Committe,, regarding right-of-ways on excess State-ommed properties bordering the Freeway.
