HomeMy WebLinkAbout25-04 II) • RECORDED WITHOUT FEE UNDER GOVERNMENT CODE SECTION 6103 RECORDING REQUESTED BY AND WHEN RECORDED,MAIL TO: TOWN OF LOS ALTOS lULLS 26379 FREMONT ROAD LOS ALTOS HILLS,CA 94022 ATTENTION: CITY CLERK RESOLUTION NO. 2 5-0 4 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ORDERING THE VACATION OF A PORTION OF THOSE EASEMENTS FOR PATHWAY PURPOSES ON 11885 FRANCEMONT DRIVE AND 11888 FRANCEMONT DRIVE WHEREAS, Pathway Easements over Parcels 1 and 2 as shown on that certain parcel map which was filed for record in the Office of the Recorder of the County of Santa Clara, State of California in Book 757 of Maps at Page 25 and 26, and were granted to the Town on that certain parcel map which was filed for record in the Office of the Recorder of the County of Santa Clara, State of California in Book 606 of Maps at Pages 14— 15 on October 2, 1989: and WHEREAS, the Planning Commission and Pathway Committee of the Town resolved pursuant to California Streets and Highways Code Section 8320, that the vacation of a portion of those Easements for Pathway Purposes over Parcels 1 and 2, as further described in Exhibit"A", conforms with the Town's General Plan; and WHEREAS, the City Council of the Town of Los Altos Hills set and conducted a duly noticed public hearing pursuant to Chapter 3 of Division 9, Section 8320 et seq., of the Streets and Highways Code to consider the proposed vacation. 1 i 0 NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: 1. The foregoing recitals are true and correct and are included herein by reference. 2. The specific facts supporting the statements and findings in this Resolution are set out in detail in the June 2, 2004 and December 18, 2003 staff reports. 3. The City Council of the Town of Los Altos Hills, pursuant to California Streets and Highways Code, Division 9, Chapter 3, Section 8320, et seq., hereby orders the vacation of a portion of those Easements for pathway purposes over Parcels 1 and 2, as further described in Exhibit A hereto, having determined and found that the Easements are unnecessary for present or prospective public purposes. 4. This Resolution shall become effective on June 2, 2004 and shall be recorded by the City Clerk in the Santa Clara County Recorder's Office shortly thereafter. 5. From and after the date this Resolution is recorded in the Santa Clara County Recorder's Office, the Pathway Easements as described in Exhibit "A" shall no longer constitute public easements and the land subject to the Easement shall revert to the Property pursuant to Streets and Highways Code Section 8351.
