RESOLUTION NO. 5 9-0 4
A RESOLUTION OF THE CITY COUNCIL OF THE
TOWN OF LOS ALTOS HILLS
SUPPORTING THE ENCROACHMENT PERMIT APPLICATION
OF EDWARD RADLO TO CALTRANS
FOR EXISTING AMATEUR RADIO ANTENNAS
WHEREAS,the Los Altos Hills Emergency Communications Committee by
resolution dated September 7, 2004 has determined that the locations of Edward J.
Radio's Gap Voyager and Gap Titan amateur radio antennas (hereinafter"Antennas") in
the right-of-way of Interstate 280 constitute optimal locations for said Antennas from a
radio propagation standpoint; and
WHEREAS, the Los Altos Hills Emergency Communications Committee has
further determined that said Antennas can play an important role in Los Altos Hills
emergency communications preparedness plan, including giving the Town of Los Altos
Hills the ability to communicate with the State and County Offices of Emergency
Services; and
WHEREAS, the California State Department of Transportation(Caltrans) has
indicated that they are desirous of having Mr. Radio complete a Standard Encroachment
Permit Application to formally permit the placement of said Antennas in said right-of-
way to conform to State law, and has further indicated that affirmation by the Town of
Los Altos Hills as to the public benefit aspects of said Antennas would be an important
element in influencing Caltrans to act favorably upon said Permit Application; and
WHEREAS, in the Permit Application executed by Mr. Radio on August 29,
2004,the Town of Los Altos Hills is absolved of any liability for damage to property or
persons stemming from said Antennas or their operation with Mr. Radlo having agreed to
assume such liability himself.
NOW,THEREFORE,BE IT RESOLVED that the City Council of the Town
of Los Altos Hills hereby supports the Caltrans Standard Encroachment Permit
Application by Edward Radlo for his two existing amateur radio antennas and attests to
the public benefits inuring to the Town of Los Altos Hills and surrounding communities
arising from said antennas.
