Spain Thursday, August 72, 1958 at 7:35 P. M. at the Town Hall, 26379 West Fremont, Los Altos Halle ROLL CALL: PRESENT: Commissioners Case, Holm, Taatau, Chairman Spain ABSENT: Commissioners Dawson, Hayes, Mellquist, Williams MINUTES: July 192, 1958. ACTIONa Adopt minutes of July 192, 1958 as presented: CORRESPONDENCE: 1, Devuty City Clerk - Proposed draft of data to be used on rubber stamp for suoaivisions. Discussion deferred to New Business. 2. L. Cedric %Shea - Letter dated July 282, 1958 conveyed his apc1= .ogy or sing at sent at the time of the hearing of Toyon Tract 7857: Filed. 3. Robin D. Faisant - Letter from the City Attorney, dated July 202, gave s opinion relative to the two existing residences in the Toyon Subdivision. The Chairman requested that copies of the letter be forwarded to the Council and members of the Planning Commission, and a copy be attached to Toyon Subdivision folder. 4. Division of Highways - Letter signed by R. A. Hayler; District ineer, and dated August 62, 1958 presented copies of resotttions adopting the route of the Junipero iaerra Freeway; and requested that they be notified of any contemplated subdivisions, applications for building permits, etc. that would be in conflict on or near the' route. Map of the route was attached. The Chairman requested that the City Clerk secure from the Highway Commission a map showing the parcels of land within the Town limits that will be affected by the freeway. Chairman Spain also request- ed that each of the Planning Committee receive a copy of the letter. OLD BUSINESS: 1. La Pointe, Roland (V-33-58). Use permit for removal of excess dirt on the Maude Schroll property, located on Page Mill Road. Mr. Is Pointe was present. 8-12-58 -2 - La Pointe.- cont'd, In compliance with the recommendation of the meeting of July 19m, tar 1958, Commissioner Cgse reported for the Map Committee, answering questions regarding the future use of the property, the amount of fill to be:removed, the rate at which fill is to be removed, where it is to be used, types of,rigs to be used for hauling, the routes, type of duet control planned, flood potential if the fill is re- moved, and future pl4ns for -the -dam. Chairman Spain read a letter addressed to Commissioner Meilquist, dated August 7m, 1958 from Wallace Stegner. The letter stated that Mrs. Schroll's attorney knew nothing of any existing signed contract between Mr. La Pointe and Ars. Schroll. Mr. La Pointe stated that authority.,was given him. by Mrs. Schroll, also stating that she had signed the application tor the permit. After checking the application, it was noted that Juanita La Fointe had signed the Af£adavit, rather than Roland La Pointe.' Mr. Gardner,Buliis, Honorary Counsel for the Town, was asked if this aptlicdtion was a legal document. Mr. Bullis stated that it was not. A potitioii; ebataining'deventy-tWo`(72) names, requesting that the permit for the removal of dirt from the Maude Schroll property be denied, listing five_(5) reasons. Several of the signers of the petition were present ,and,voiced their objections. After deliberation and discussion, the following recommendation was made. R C019=ATION: That the application of Roland La Pointe for Use permit (V -33-5Q for.the removal of excess, dirt on the Maude Schroll property on. Page Mill'Road be denied. Mr. Gieseker and Mr. Buitrage were present. Chairman Spain read the correspondence from the agencies granting approvals. - - It was decided that the.cul de sac rokd (50' right of way and 18' paved sectioA should be de3lCated but not accepted until it is - brought to Town standards. 8-12-58 -3- Gieeeker - cont'd. 4, RECOMMENDATION: That the revised tentative map of R. Gieseker (15-56) 4 lots be approved subject to non access on Fernhill, Camino Her- mosa, and Ravensbury :venues, the dedication of the 10' strip adjacent to Aernhill,�.vdtue publid dedication of the cul de sac, and the aWrovals.of all agencies. MOTION:. Holm; SECOND: Tantau; VOTE: Passed unanimously NEW BUSINESS: - 1. Subdivisions: Bonn. Norman (116-58) - 2 lots. Engr. Nolte. Approval of tentative map. Mr. Henry V. Seward, realtor, Los Altos Properties, represented. Mr. Bonn. It.was noted that on the map that a well was listed as source of water supply. The area is served by the Robleda Water District. Mr. Longmire., engineer; suggested that the.10'x 20 foot portion of land at the entrance of Yuba Avenue of parcel one be dedicated to the Town in case of future widening of the road, and that if this dedication causes the parcel to less than the minimum 1 acre that a variance be granted. RECOMMEiDATION: That the tentative map pf Norman Bonn (116-58) 2 lots be app proved with the addition of the 10' x 20' portion of land at the entrance of parcel one at Yuba Avenue and subject to the correction on the map regarding the water supply and the ap- provals of all agencies. MOTION; Tantau; SECOND: Case; VOTE: Passed unanimously OLD BUSINESS: Variance: Keller, John J. (V-30-58). Reduction of,side setback to 1' for carport. Mr. Keller was present. A drawing of the subdivision in which Mr. Keller's property in located was presented as traced from the County Assessor's Book of Maps. This drawing showed that all the lots were narrow and all property owners had had to apply for variances. Statement approving the granting of this variance was signed by all the adjacent property owners. 8-12-58 60 -4 - Keller - cont'd. RECOMMEND:.TION: That the variance of John J. Keller (V-30-58) for the reduction of side setback to 1' for a carport be approved. MOTION: Case; SECOND: Tantau; VOTE: Passed unanimously FRELIMINARY DISCUSSION: :Carr. Non. 12.77 acres. Engr. MacKay & Somps. Mr. Carr and Mr'. Donald MacKay were present. Map of eleven (11) lots was presented and discussed. Several suggestions were made, but no majpi problems were noted. ORDINANCES: 1. Gradiordinance: The Chairman stated that this was listed on t e en a y error and will be on the Council's Agenda at its next meeting. 2. Zoning Ordin ce: There,was an informal discussion of portions of e proposed raft. Chairman Spain asked that each member of the Commission study the proposed draft and .direct any suggestions to the Committee appointed by the Mayor to review the proposed draft.
