MUTES Approval Minutes of January 22, 1975, As Corrected Comnissiceer Schick stated on the Minutes of January 22, 1975, under "Tarda of Strathdee", it should be added that she requested "the rna- terial sent to the Commission should indicate the lot was over 10 years old, and that was why the item was before the Variance and Per- mit Canmdssion." Chaimann Spencer stated the Piinutes of January 22, 1975, would stand approved as corrected. Assistant Planning Consultant Vlasic stated building site approval had been requested for the Imid of Guy, consisting of 0.63 net acre, located at the end of Deerfield Road. The staff, in their mem of February 5, 1975, recmu marded approval, subject to the conditions listed in the memo and the site be fond categorically exaipt fmm the provisions of the California Environ- mental Quality Act. She believed the requirement for a soils engi- neer's report should be at the discretion of the Town Engineer, if there was a reed, rather than an automatic requirment. During discussion, Cha=m- Spencer directed the staff to research as bD the language that provides for the Tam Geologist's review, and report to the Com- mittee so the Committee czn study the euaja:t and possibly make recommendation for changes. Cmmisawnar Schick inquired about reomuended condition 3, axwerning the Pathway COMMIttee's request for a 10 -foot pathway along the northern and western property lines, as this pathway would not connect to Deerfield Road. Discussion followed as to the correction Leheen the Guy property and Deer- field eerfield Road over a 25 foot right of way. The Pathway O=uttee should review and justify the pathway. Upon Cmmissicner Phillips' inquiry about the placement of a septic tank and drainfield on the lot, Assistant Planning Consultant Vlasic reviewed the re- port from the Santa clara Crnmty Health Department and their conditions for approval of this application. Mr. Ken Miller, adjacent property owner to the Lands of Guy, spoke concerning his possible loss of view if Mr. Guy builds, and the location of the septic tank and drainfield area. Motion was made by Casnissioner SCHICK, seconded by Commissioner PHILLIPS, the building site approval request for the Lads of Guy be approved, subject to the conditions listed in the February 5, 1975, staff memo, with the modification of condition 1, that this be at the discretion of the Town Engineer; with the modi- fication of condition 3, that the Pathway Comdttee show a need for the requested easerm over the Guy property when there is no pathway easerent over the 25 foot right of way; and the application be declared empt fran theCQR. Assistant Planning Consultant Vlasic stated building site approval had been requested for the lands of Burke, consisting of 1.010 acres, located on Mag- dalena Avenue, approximately 200 feet southeast of Stonebmok Drive. The staff, in their memo of February 6, 1975, recamended approval, subject to the conditions listed in the aero, and the site be found categorically exempt from the provisions of the California Envirornmntal Quality Act. Casnissioner Schick questioned recamnnded condition 1, concerning the Town Geologist's recasmandation, as she believed the requirement for a soils en- gineer's report should be at the discretion of the Town Engineer, if there was a need. She also inquired about the "non -vehicular access" along nmst of Magdalena Avenue, as noted on the map. Camtissiornr Schick was advised that Tract Map #2811 shows access is pro hibited to 14agdalena Road frau this parol except at the northwesterly corner of the property where there is a 55.46 foot access. Mr. Rich Bell, repre enting the applicant, stated that the conditions set forth in the February 6, 1975, staff memo are agreeable and he was aware of `, the "mrvehicuL r access" requirement. `, Motion was mile by Cacmissioner SCHICK, seconded by Cannissioner vHrrl.IvS, the building site approval request for the Lands of Burke, be approved, subject to the conditions listed in the February 6, 1975, staff memo, with the modi;icaticn of condition 1, that this be at the eiscretion of the Town Engineer, and the appli- cation be declared exempt fran the COPA. Assistant Planning Consultant Vlasic stated a variance had been requested for the Lands of Wang, located at 12852 Novnardy Tare for a tennis court, which would encroach 23 feet into the back yard set back and 10 feet into the nest side yawl set back. The staff, in the memo of February 6, 1975, recommended the variance, as requested, not be granted, as it is possible to move the proposed placement of the tennis court and reduce the amount of encroachnent required, including the rear yard set back and outside the existing 15 foot public Utility Easement. Two alternatives, which would reduce the encroach- ment, have been suggested to the applicant, and turned down by him. A map was available to each C=rdssioner, indicating the two alternatives. 6 City Engineer Russell reviewed the utility easements, stating he believed the easement should be left open and free fran struct res to ensure use and main.- tetance. Mr. morgan MCGilvray, President of the Normandy Lane Property-0wners Associa- tion, spoke at length in favor of granting the variance as applied for, stat- ing all the neighbors in the area had been contacted and were in favor of the tennis court as requested by Dr. and Mrs. Nbng. A three-page letter frau the Association, over signature of Mr. MCGi.lvray, had previously been distributed to the Cannission. Upon inquiry by the Camiission, Dr. Abng stated that at the time of excavation for the tennis court, the Town Historian is welcome to look for relics. Motion was made by Camassioner SCHICK, seconded by Canaissioner SPENCER, the variance, as requested by Ur, and Llrs. Wong, be granted, subject to the conditions there be no lights installed for the tennis court and the Town Historian be present when excavation for the tennis court is in progress, and that it be noted the Com- mission has made the necessary findings for the variance as stipulated in Section 9-5.1107(b) of the NSuucipal code. Notion was carried by the following roll call vote: AYES: Courdssioners SCHICK, SPENCER. NDES: Commissioner PHILLIPS ABSEW: Camissioner Tom.
