ROLL CALL Present: Commissioners SCHICK, PHILLIPS, SPENCER. sAb ent: Commissioner NONE. STAFF City Manager Crowe, City Engineer Russell, Assistant Planning Consultant Vlasic, Secretary Huffstetter. Commissroner Schrck state on Page z of the FeDruary 12, 1975, Minutes, under Lands of Hong, fourth paragraph,"Upon inquiry by the Commission", should be. changed to "At the inquiry of Commissioner Schick, at the request of the Town Historian, Mrs. Fava". Chairman Spencer stated the Minutes of February 12, 1975, would stand approved as corrected. Assistant Planning Consultant Vlasic state a var ante had been requested for the Lands of Overstreet, located at 232nD Encinal Court, for a pri- mary dwelling within 15 -feet of the rear property tine, which would al- lay the existing building to remain within 15 -feet of the rear property line and allow new construction to come within 25 -feet of the rear pro- perty line, and to construct a barn on an existing pad within 9 -feet of an access easement right-of-way line along the western property line. The staff, in the memo of February 20, 1975, recommended the variance as requested be granted, and the project be found categorically exempt from the provisions of the California Environmental Quality Act. Upon Commissioner Phillips' inquiry about the feelings of the neighbors, Assistant Planning Consultant Vlasic stated no objections had been re- ceived. The area under consideration is heavily treed and the nearest neighbor is 400 -feet away, so there would be no visual impact on any of the surrounding neighbors. Assistant Planning Consultant Vlasic reviewed the access roads to the property, stating they are private. Commissioner Schick submitted pictures to the Commission showing the present structure, which the owners want to use in the rebuilding of the primary residence. The pictures showed the present structure is not all brick. - 1 - %W VARIANCE AND PERMIT COMMISSION - February 26, 1975 Assistant Planning Consultant Vlasic stated the owners plan to remove all portions of the structure which are not brick, and possibly part of the brick section if it is shown it is not structurally sound. Discussion followed on the construction in the existing building, the roads onto the property and the creek which runs through the property. Upon Commissioner Schick's inquiry concerning the existing barn pad, As- sistant Planning Consultant Vlasic stated the owners plan to use the pad for the foundation of a combined garage and workshop. Mr. Overstreet, applicant, spoke on his requested variance for the primary dwelling and pad, reviewing his plans and reasons for the request, stat- ing the plans at this time are very fluid and could change to fit the situation. Commissioner Phillips stated he had reservations about voting for this request as the applicant's plans were so indefinite. Commissioner Schick stated she felt the brick portion of the existing structure would make a good addition to the new residence, but thought the back of the structure was in very bad condition. She could vote for the 15 -feet setback for the new construction to the existing structure, but questioned the 25 -feet setback for the existing brick part of the structure since it appears to be in poor condition. She is also against the 21 -feet setback request for the barn pad. Motion was made by Commissioner SCHICK, seconded by Commissioner PHILLIPS, this matter be continued for two weeks, to March 12, 1975, in order for the City Engineer to inspect the brick structure, and make a report to th,e Commission on whether or not it can be used in the reconstruction of the building, and to give all the Commissioners time to personally inspect the site rnJ the structures under consideration. Motion was carried by the follo:vng roll call vote: AYES: Commissioners SCHICK, PHILLIPS, SPENCER. NOES: Commissioner NONE. ABSENT: Commissioner NONE. Mr. Overstreet stated the Commissioners had his permission to go onto the private road and his property.
