ROLL CALL Present: Commissioners BRO1111, SCHICK, PHILLIPS, YOUNG, CARICO, PERKINS, SPENCER. Absent: Commissioner NONE. STAFF City Manager Crowe, City Engineer Russell, Planning Consultant Mader, Assistant Planning Consultant Vlasic, Secretary Huffstetter. Approved Minutes Of February 12, 1975 As Corrected Commissioner Schick stated on Page 3, of the February 12, 1975, Min- utes, on Pages 3 and 4, under each request for exemption from the subdivision moratorium, should be added, "The staff directed the Com- ` missioners to look at the land as a whole parcel, not the individual parcels outlined on the tentative map, in consideringwhether or not the tentative subdivison meets the requirements for exemotinn from the subdivision moratorium, as outlined in Resolution Ho. 79n," Commission Schick stated on Page lq, under Section 9-4.411 (j), and Page 11, under Section 9-4.411 (w), the vote of the Commission was omitted. The vote for Section 9-4.411 (j) was unanimous, while the vote for Section 9-4.411 (w) was anproved, with Commissioner Schick voting no. On Page 11, under Section q-4.682, the motion should read, "Motion was made by Commissioner SCHICK., seconded by Commis- sioner YOUNG, Section 9-4.602 (4) he approved with the following changes: under (a) change the 7,W) to 4,500, and under (e) change the 4,000 to 2,509 and the 7,000 to 4,500." Jn Page 12, under Sec- tion 9-4.602, the last paragraph should be changed to read, "Due to the lateness of the hour, motion was made by Commission SCHICK, seconded by Commissioner PHILLIPS, the public hearing on this matter be continued to Saturday, February 15, 1975. After noting the coming weekend was a three-day weekend, being 14ashington's 'irthday, Commis- sioner Phillins withdrew his second. Commissioner Schick also sug- gested meeting on Friday, February 14, Monday, February 17, and Tues- day, February 16, 1975. Motion was made by Chairman SPENCER, second- ed by Commissioner PHILLIPS, the public hearing on this matter be continued to Tuesday, February 16, 1975, at 7:30 P.M., in the Council Chambers. Motion was carried by the following roll call vote: AYES: Commissioners PHILLIPS, YOUNG, PERKINS, SPENCER. NOES: Commissioners BROIIM, SCHICK, CARICn. ABSENT: Commissioner NONE." - 1 - PLANNING COMMISSION - February 26, 1975 Commissioner Young stated on Page 3, fourth paragraph, under his com- ments, "low level" should be changed to "high level" and "high level" A' should be changed to 'Iy? level"; between the words "included subdi- visions" should be inserted the word "minor"; after the word "subdi- visions" s'iould be added "long range and medium planning". Commissioner Perkins stated on Page 1, under ""linutes" third line un- der his coas2rts, the word "which" should be omitted and the word "but" shoa.71; be inserted after the word "motion Commissioner Carico stated on Pane 11, under Section 9-4.411 (x), the following should he inserted before the motion by Commissioner Phil- lips, "[lotion was made by Commissioner CARICO, Section q-4.411 (x) be approved as submitted, with the followiina added, 'on subdivisions of five or more lots, unless the ground under Kerry Sieh's report shows t'iat it is not a hazardous location'. 'lotion died for lack of a second." Chairman Spencer stated the •+inutes for February 12, 1975, would stand approved as corrected. PUBLIC HEVN5 - 2 - of Public PLM111ING C011MISSIDi1 - February 26, 1775 Data Services, and Nr. Alexander, representatives for fir. Bellucci, appli- cant, concerning questions raised by Vie Commission about the Draft EIR on the Adobe Creek Conditional Use Permit Application. To date, no addi- tional information has been received. [Jr. Sam Halsted, Public Data Services, renresenting the Draft EIR for the applicant, distributed and reviewed conies of his firm's response to the Santa Clara f -later District's letter of January 21, 1975. The response in- cluded comments on the flood plain and hydrolooic impact. Pir. Halsted stated they were willing to increase the noise level impact, and request- ed the Commission declare there would be. no adverse effect from the noise level, stating that to do the type of study requested mould be too costly to the applicant. Hr. Halsted reviewed the traffic problems, then request- ed the Planning Commission make a judgement on the Revised Draft EIR. Discussion followed on the uses of the club facilities, traffic problems, noise levels, club membership, i.e. family vs individual, and future needs of the club and its facilities. Speaking from the audience concerning the requested conditional use were: R. T. Jones - in favor of the country club and the conditional use permit. Stacy French - in favor of the country club and the conditional use permit, and mould not want to see the club closed. Mr. Goodman - in favor of maintaining the area for recreation use, does not want homes built on this land. ` David Brown - in favor of the country club, it is well run, the pic- nicking has been a problem, but it is endinq, this land should not be subdivided. Dr. Emery Ilest - the roads are in bad condition and the traffic is a problem, lights on the tennis court mould create problems, how- ever the noise from the tennis courts can be tolerated. David Proft - The EIR and tonight's verhal and smitten reports do not address the noise and traffic problems and sanitary disposal facilities. He presented a petition with 41 signatures, stating, "The undersigned residents of the neighborhood of Adohe Creek Lodge strongly object to the conditional use (tennis and swim club) proposed by David Dellucci." Carol Fie - against the country club and the conditional use. permit and the peripheral activities that are not club -member orientated. Susan Ilhipple - in favor of the country club. R. T. Jones - some people -+ho signed the petition �,iere in favor of the country club. Stacy French - inquired about sanitary facilities for the club. Lola Carson - asked about the Fremont Hills Country Club's membership, traffic and noise problems. Motion was made by Commissioner SCHICK, seconded by Commissioner CARICO, the public hearing on the conditional use application by the .Adobe Creek Lodge be closed, and the application be voted on by the Planning Commis- sion. 4r' After discussion on the motion, Commissioner Schick amended the motion to only the public hearing be closed. Notion was carried by the following roll call vote: AYES: Commissioners BRO11A, SCHICK, PHILLIPS, CARICO, SPEICER. NOES: Commissioners YOL'NC, PERKINS. ABSENT: Commissioner HONE. Planning Consultant 'fader stated the Commission needed to make a decision on whether the revised draft EIR addressed in sufficient detail all areas concerning the environment relative to the conditional use permit applica- tion, and the requirements for the final EIR, and holy it is rrepared. Following _'isc:us�., motion was made by Commissioner CARICO, seconded by Commissioner PHILLIPS, this matter ': continued to March 12, 1975, at which time, the applicant is to submit written answers to all questions raised by the Commission, the public and the staff at the January 9, 1975, Planning Commission meeting, and the final EIR report is to be submitted to the Commission. At Commissioner Perkins's request, Commissioner Carico amended the motion to include written answers from the applicant on all questions raised by all agencies reviewing the draft EIR. Commissioner Phillips seconded the amendment. Motion was carried by the following roll call vote: AYES: Commissioners BRONN, SCHICK, PHILIIPS, YOUNG, CARICO, PERKINS. SPENCER. NOES: Commissioner HONE. ABSENT: Commissioner NOME. Commissioner Phillips requested the staff make a report on the sewage facilities and needs of the club and also an evaluation of a recreational club vs residential use of this land. Commissioner Perkins requested the staff submit a report on what the pro- cedures are in processing a conditional use permit. Motion was made by Commissioner CARICO, that at the time the final EIR is presented, the conditions for granting the conditional use permit also be submitted. Commissioner Carico withdrew the motion after City Manager Crowe stated the conditions for granting the conditional use permit could not be recommended by the staff until the final EIR had been reivewed. RECESS —chairman Spencer declared a short recess at MO O P.R., and reconvened the meeting at 9:25 P.11. HILLS city Tanager crane stated this item was referred to the Planning Commis- sion from the City Council. The City Council is considering amending the last sentence of paragraph 4, of the General Plan entitled "Recreation Area -Private", relating to Adobe Creek Lodge Complex of the Recreation Element to "The site is basically suited for recreation or residential use", and the Plan Diagram, which presently desiqnates the valley floor portion as "Recreation Area - Private" to "R (v-1) Residential Very Low to - 4 - PLANNING COMMISSIOPI - February 26, 1975 Low Density one acre or more/CU and Recreation Area -Private". Prior to any City Council action, state law requires the Planning Commission hold a public hearing on the matter, and make a recommendation to the City Council. Planning Consultant Mader noted the Plan Diagram of the General Plan shows both the R(v-1) Residential - very Low to Low Density and Recreational Area -Private zones for the Adobe Creek Lodge Complex. Speaking from the audience concerning the proposed zoning change were: Stacey French - in favor of keeping the recreational club, does not want residential development on this land. Elizabeth Dana - floor lands of Adobe Creek Lodge are subject to flooding and should not be used for residences. Nilliam Zoller - in favor of keening the recreational club, strongly against residential development on this land, questioned if this land had been designated as a historical landmark. David Proft - against the recreational club, wants residential devel- opment on this land. Larry Gillor - in favor of open space for this land and against resi- dential development. Millie Gallo - against the recreational club as it is a nonconform- ing use, wants residential development on this land. Mr. Goodman - in favor of keeping the recreational club and oven space, strongly against residential development of this land. Yetsus Supparris - in favor of recreational use for this land. Stacey Franch - inquired who wanted to develon this land. Mrs. Dianna Miller, Councilwoman - this proposed amendment was pre- sented by Councilman McReynolds, she is against it. Planning Consultant Mader requested the minutes note. corresnondence re- ceived concerning this matter. Correspondence was received from Elizabeth Dana, Sub -Committee Chairman, Citizens Advisory Committee, Santa Clara County Nater District, requesting only agricultural or recreational uses for the flat land of Adobe Creek; Perl T. Duhamel, requesting the present status of Adobe Creek Lodge be maintained; Frank and Josephine Duvenick, requesting Adobe Creek land remain zoned for recreational use only; Mrs. Betsy Bechtel, President, Committee for Green Foothills, reauesting the Adobe Creel: Lodge complex not be zoned to include residential use; "1ar- jorie Sutton, Chairwoman, Loma Prieta Chapter, Sierra Club, requesting open space use on the Adobe Creek Lodge. Planning Consultant Mader stated prior to approval of the amendment to the General Plan and the Plan Diagram, a draft EIP. would be needed, as a change in this land could affect environment. ABSENT: Commissioner NME. ,i PLANNING COJIJISSION - February 26, 1975 Upon Commissioner Carico's inquiry if the proposed amendment to the Goner - al Plan was not approved, ¢ould this prevent any future residential devel- AW opment of the Adobe Creek Land, Planning Consultant Mader stated the zon- ing on this property at the present time is for recreational use, but a request could be made at a future time for rezoning of this land. Motion was made by Commissioner YOU!i,, seconded by Commissioner SCHICK, this matter be deferred until after the decision is made on the Condition- al Use Application for Adobe Creek Lodge, which is currently under consid- eration by the Planning Commission. After discussion, Commissioner Yo;:n,) amended the motion, and Commissioner Schick seconded the amendment to add "and the staff to produce the back- ground information regarding the EIR on the effect of changing to resi- dential use". Following further discussion, Commissioner Young withdrew his motion. Motion was made by Commissioner YOUNG,, seconded by Chairman SPENCEP, to not recommend the amendment to the City Council. Following a lengthly discussion on the question of the Environmental Im- pact Report, Commissioner Carico amended the motion, and Chai man Spencer seconded, the change, "Environmental Impact Report, to Environmental As- sessment Norksheet". Motion was carried by the following roll call vote: AYES: Commissioners BROUN, PHILLIPS, YOUNG, CARICO, SPENCER. WOES: Commissioners SCHICK, PERKINS. ABSENT: Commissioner HONE. RECESS Chairman Spencer declared a short recess at 10:31 P.!I., and reconvened the meeting at 10:38 P.M. Commissioner Perkins left the meeting during the recess. Following E discussion on this section, and the recommended change by Commis- sioners Schick and Carico, Commissioner Phillins withdrew his motion. Motion was made by Commissioner PHILLIPS, seconded by Commissioner YOUNG, Section 6-1.2n5 (i) be approved, with the followinn change, after the word "corral", the following be substitutod, "with ade- quate drainage provisions to eliminate run-off on adjoining proper- ties." Motion was carried by the following roll call vote: AYES: Commissioners BROHN, SCHICK, PHILLIPS, Y01110, CAP,ICO,SPENCER. NOES: Commissioner PIONE. ABSENT: Commissioner PERKII!S. Section 9-4.601 (c) Commissioner Schick stated s)e and Commissioner Carico were recom- mending to the Commission Section 9-4.601 (c), relating to cul-de- sac roads, be changed eliminating the 900 -feet length, and inserting after "the maximum length of a cul-de-sac road shall", the following, "be determined by the topography and location of the land". Following discussion on the length of cul-de-sac roads, ingress, e- gress and turn-arounds, motion was made by Chairman SPENCER, seconded by Commissioner CARICO, the recommendation to Section n-B.6nl (c) by Commissioners Schick and Carico be approved. ABSEiT: Commissioner PER'CINS. - 7 - PLANNING COMMISSION - February 26, 1975 Section 9-4.601 (i) (1 and 2) Commissioner Schick stated she and Commissioner Carico were recommend- ing to the Commission Section 0-4.601 (i) (1 and 2) be changed to re- flect the change approved by the Commission in Section 9-4.601 (c). The change recommended is deletion of the reference to "five or more lots", and substituting "the number of lots as determined by our slope density formula", in both subsection (1) and (2) of Section 9-4.601 (i). (lotion was made by Commissioner BROI;WI, seconded by Commissioner PHILLIPS, Section 9-4.601 (i) (1 aid 2) be referred to staff for wording into the proper terminology, and be brought back to the Plan- ning Commission at the next meeting. City flanager Crowe stated the re -wording into proper terminology would cover Section 9-4.601 (i) (1) elimination, (2) modification, (3) no change, and adding (4) reference to maintenance agreements.
