APPROVED VARLWE REQUEST FOR LAPIDS OF City :lanager Crowe stated this item had been continued from the meeting of February 2C, 1975, in order for the City Ennineer to make a report on the condition of the existing brick structure at 232911 Encinal Court. City Ennineer Russell reviewed the renort suhnitted to the Commissioners, stating the brick structure auneared to be basically sound, hoeever there were several items that needed to be corrected, including replacement of several roof truss members, wall connection details analyzed and strenq- thened where needed, correction of cracks in the brick wall around the window and door openings, and he recomnended removal of the add-on section on the southerly side of the, nresent structure. City Ennineer Russell slated a reviei,r of the existing nad, at the pro- posed garage/workslop site, consists of broken concrete and brick, and he recommended the variai-._e requested for the pad not be granted, as there are other locations on the lot where the garaqe/workshon could be located. Discussion followed on the add-on part of the brick structure, and the condition of both the brick and add-on structure. Jr. Overstreet, applicant, stated he did not want to use the add-on part of the structure, but did want to be. able to use that area of land in the %W remodeling of the brick structure. VARIANCE AHD PERMIT C041ISSI011 - March 12, 1975 Mr. Larry Steiner, architect for the applicant, reviewed the plans for the remodeling of the brick structure, and why the variance was requested, stating the remodeling plans cover only the areas of the land that Pres- ently have a structure on them, and would not include any areas in the set back that are presently free of structures. Commissioner Phillips reviewed the variance as he understood it, stating he felt the 25-feet encroachment should be approved, but only for the area presently built on. Following a general discussion on the concrete and brick pad, its location and condition, Mr. Steiner, architect, reviewed the reasons for reno^sting the variance for the pad, stating it is not adequate struc- t, , ;ly, and the plans call for constructing a new pad at the same locaik>n. Motion was made by Commissioner PHILLIPS, seconded by Commissioner SC"iCl:,the variance requested for encroachment into the back ,yard of 25-feet be granted, subject to the condition it is only for the land where structures presently exist, not for any land Presently vacant of structures. Motion was carried by the following roll call vote: AYES: Commissioners PHILLIPS, SCHICK. NOES: NONE ABSENT: Commissioner SPENCER Mr. Hilliam Smith, engineer for the applicant, spoke on the plans for garage/workshop, and the problems in using another area of the lot, i.e. septic tank and drainfield. City Engineer Russell pointed out the applicant could request a lot line change between lots 2 and 3, as both lots were large enough so they would still meet minimum lot size requirement under the Town's slope-density requirements. City Manager Crowe stated a variance had been requested for the Lands - 2 - VARIANCE AND PERMIT COi'.'IISSION - "larch 12, 1975 of Smith, at 12423 Hilltop Drive, for an existinn tennis court which encroaches 30 -feet into the bac!: yard and 15 -feet into the side yard, built about 3 years ago. Ilr. Smith, applicant, stated he had been informed by the City Manager last August he would have to apply for a variance since his tennis court encroached into the set back areas. Mr. Bram Whittaker, neighbor to "Ir. Smith, spoke against the granting of the variance, stating the tennis court has become more and more offansive to him and his wife and it was an invasion of his privacy. Commissioner Spencer joined the meeting at 7:5n p.m. Discussion followed on the tennis court, when it was constructed, the landscaping plan submitted by Mr. Smith for visual buffering of the tennis court and the feelings of the neighbors concerning the tennis court. Mrs. Smith, applicant, stated only one other neighbor, besides Mr. Whittaker, had not signed the petition circulated concerning the variance for the tennis court, and the Ilhittakers had seen the tennis court being built and had used it many times. Motion was made by Commissioner SCHICK, seconded by Commissioner PHILLIPS, the variance, as requested, be approved, subject to the condition the landscaping plan submitted by t1r.
