Chairman Schick called the regular meeting of the Variance and Permit
Commission to order at 6:19 pm in the Council Chambers of Town Hall,
26379 Fremont Road:
A. ROLL CALL:
Present: Commissioner Brown, Chairman Schick
Absent: Commissioner Phillips
Staff: City Engineer Alec Russell, Building Inspector/Planner
Ken Pastrof, Planning Secretary Kate Tenney
B. APPROVAL OF MINUTES: April 9, 1975
t There being no corrections, Chairman Schick declared the minutes of
4r April 9, 1975 approved as submitted.
C. REQUEST FOR BUILDING SITE APPROVAL:
1. LANDS OF WIRSHING, APH #336-20-n25, northwest corner of Hilltop
Drive and Colina Road, Paul Nowack, Engineer, BSA -6037-75
There being no comments from the Commission and no comments from
the audience, Commissioner Brawn moved, seconded by Commissioner
Schick, that the Lands 61irshinq, request for BSA, be approved
subject to the conditions and recommendations from Staff. The
notion passed by the following roll call vote:
AYES: Cormissioner Brown, Chairman Schick
NOES: ,lone
ABSENT: Commissioner Phillips
2. LANDS OF STEHART, APN #336-2n-008, Colina Drive, Frank Blomquist,
Engineer, BSA -6038-75, Lot 1
Mr. Grillo, 12143 Hilltop Drive, spoke against granting BSA Cor
Lands of Stewart (see Staff memo.;4/17/75,. Exempted Condition 3
a,b,c,)as he felt the possible driveway would be too close to his .
house. Mr. Grillo suggested an additional condition, that no
driveway be allmied withing 30' from his property and requested
that his continents be recorded in the minutes.
Mr. Allen Stewart, developer of the property, responded that the

owners had made no definite plans for a driveway.
Staff recommended to tlr. Grillo and to the Commission that the
subject of a driveway was better addressed at the Site Development
level.
Commissioner Brown agreed with Staff, that this was a subject to be
discussed at Site Development level.
Commissioner Bram moved, seconded by Commissioner Schick, that BSA
for Lot 1 of Lands of Stewart, BSA -6038-75, be approved subject to
the 13 conditions set forth by Staff. The motion passed by the
following roll call vote:
AYES: Commissioner Brown, Chairman Schick

3. LAPJDS OF STEWART, AN4336-20-008, Colina Drive, Frank Blomquist,
Engineer, BSA -6039-75, Lot 2
L Commissioner Brown stated his comment for Lot 1 applied to Lot 2.
�r Mr. Grillo asked that the records show his statement for Lot 1
applied to Lot 2.
Commissioner Broom moved, seconded by Commissioner Schick, that
BSA for Lands of Stewart, Lot 2, BSA -6039-75, be approved subject
to the 13 conditions set forth by Staff. The motion passed by the
following roll call vote:
AYES: Commissioner Brown, Chaimman Schick
NOES: None
ABSENT: Commissioner Phillips
4. LAIMS OF F9RTIS, APIJ 0175-46-015, east side of La Paloma,Robert
Foulk, Engineer, BSA -6036-75
'Jr. Fortis, owner, stated that Conditions 2 and 3 of the Staff memo
(4/15/75) had been agreed to and would be recorded. 'Jr. Fortis also
stated that Condition 1 had been authorized by himself.
Commissioner Brom moved, seconded by Commissioner Schick, that the
application for Building Site Approval for Lands of Fortis be
approved subject to the 9 conditions set forth by Staff. Motion
passed by the following roll call vote:

VARIANCE AND PERMIT COPINISSION - Anril 23, 1975
5. LANDS OF HORTON, AN: #182-25-008, southern side of Altamont Road,
John Humber, Engineer, BSA -6035-75
I,rs. Barbara McReynolds, 26045 "foody Road, spoke in opposition to
the approval of the BSA. She stated her map showed a water easement
through the Horton property and that the McReynolds needed access to
the property for repair of the pipe line which leaks yearly.
Mr. Allen Lambert, President of Gerrard Homes, stated that the
Hortons planned to replace the old Pipe so as to alleviate future
leaks.
City Engineer Alec Russell commented to the Commission that he
could find no recorded water easement nor could the Title Company
find such a record.
Mr. Steven f-,c^.eynolds, attorney for Mr. Thomas McReynolds, spoke
in opposition, requesting the Commission to require an EIR for
the Horton property.
The City Engineer stated to the Commission that as this was a
request for BSA and a single family dwelling, there was no
requirement for an EIR.
Commissioner Brown moved, seconded by Commissioner Schick, that
the application for BSA for Lands of Horton be approved subject
to the 12 conditions (#12 deleted) and that the applicant be
instructed to come to an agreement with Staff and the adjoining
property ainers (McReynolds and Pool) on the water easement
(Condition 6) before Site Development. The motion also directed
Staff to notify the McReynolds of any new developments for the
Lands of Horton. The motion passed by the following roll call
vote:
AYES: Commissioner Broom, Chairman Schick
NOES: None
ABSENT: Commissioner Phillips
NEW BUSINESS:
Commissioner Brown nominated Com»ssioner Schick as Chairman of the
Variance ar.d Permit Commission. The romination carried and Chairman
Schick was officially elected by the following roll call vote:
AYES: Commissioner Broom, Chairman Schick
NOES: None
ABSENT: Commissioner Phillips

There being no further business, Chairman Schick declared the meeting
adjourned to the next regular meeting of the Variance and Permit Comm-
ission dated 'lay 14, 1975.
