HomeMy WebLinkAbout05/14/1975PLANNING CONMIISSION Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California Minutes of a Regular Meeting Wednesday, May 14, 1975 cc: Reel 35 - Side 2, Tract 1, 074 -end, Reel 35 - Side 1, Tract 2, Ont -095 Chairman Perkins called the regular meeting of the Planning Commission to order at 7:35 pm in the Council Chambers of Town Hall, 26379 Fremont Road: Before the Roll Call, Chairman Perkins welcomed the new Planning Commissioner, Lucy Hillestad, and asked the City Manager to swear her in. A. ROLL CALL: Present: Commissioners Brown, Schick, Young, Carico, Hillestad, and Chairman Perkins Absent: Commissioner Phillips Staff: City Manager Robert Crave, City Engineer Alec Russell, City Planner/Building Inspector Ken Pastrof, Planning Consultant t Tom Vlasic, Planning Secretary Kate Tenney Press: Dave Fuller, Palo Alto Times B. APPROVAL OF MINUTES: April 23, 1975 There being no corrections, the minutes of April 23, 1975, were approved as submitted. C. REQUEST FOR CONTINUANCE: 1. LANDS OF MORGAN: Lots A,B,C, Tract 36n9, TM -2913-75, John Riley, Engineer. As the applicant could not specify a date at which he would be Prepared, Commissioner Schick moved, seconded by Commissioner Young and carried unanimously, to continue Lands of Morqan until further notice by the applicant. D. REQUEST FOR EXEMPTION FROM THE MORTIORIUM: 1. LANDS OF DOYLE, Josefa and Elena, John Riley, Engineer, TM -2n24-75 City Engineer Alec Russell presented the Staff report, recommending approval of the 4.0 gross acre parcel into two (2) parcels. Commissioner Schick moved, seconded by Commissioner Carico, that `✓ the Lands of Doyle, request for exemption from the Moritorium, be recommended to Council for Approval. Notion carried by the foll- owing roll call vote: `. LANDS OF CROI•!, on circle of Hilltop Drive, Paul Nowack, Engineer, TM -2022-75 City Engineer Alec Russell presented the Staff report, noting that there was presently a home, garage, and other small buildings and that there would be little grading except for the driveway and house pad. Staff recommended approval of applicants request for exemption from the Moritorium. Commissioner Young requested that in the future all applicants requesting exemption from the Moritorium submit maps titled as such, rather than titled Tentative Map. Commissioner Brown moved, seconded by Commissioner Young, that Commission recommend to Council that the Lands of Crow be exempted from the Moritorium. notion carried by the folloering roll call vote: E AYES: Commissioners Young, Brown, Schick, Carico, Hillestad, Chairman Perkins NOES: None ABSENT: Commissioner Phillips As the Commission was ahead of schedule for the Public Hearing on Adobe Creek Lodge, CU apolication,a short.recess was called: E. PUBLIC HEARING: LAMS OF BELLUCCI, Adobe Creek Lodge, CU -8004-74 a) Public Hearing on the Environmental Impact Report for Adobe Creek Lodge: Associate Planner Tom Vlasic presented the Staff report. At the direction of the Planning Commission, the Conditional Use Permit application and related proposed Final EIR had been re -noticed for Public Hearing before Commission on May 14, 1975. Mr. Vlasic reviewed the various elements of the latest memo concerning the EIR and answered the questions of the Commission before the Public Hearing was opened to the audiance. Mr. Vlasic clarified to the Commission the meaning of the EIR and its mitigating measures, adding that acceptance of the EIR did not bind Commission to transferring the mitigating measures to the CU application as conditions. (2) PLANNING COMUSSION, May 14, 1975 Commissioner Schick questioned the traffic analysis, stating the figure of 27 homes was inappropriate as 27 homes would never be built. Discussion ensued concerning proposed club membership, non- profit percentage status of 5% to 10%, enforcement of clubs non-profit status, consequences of non-acceptance of the EIR, and Spangle and Associates latest memo of May 8, 1975. Commissioner Brawn moved, seconded by Commissioner Schick, to include the memo of May 8, 1975, from Spangle and Associates, as part of the Final EIR without limitation. Motion carried by the following roll call vote: AYES: Commissioners Brown, Young, Schick, Carico, Hi,llestad Chairman Perkins NOES: None ABSENT: Commissioner Phillips Chairman Perkins opened the Public Hearing for Lands of Bellucci, Adobe Creek Lodge, and called for speakers in opposition to accepting the EIP.. Mr. Donald Spencer, Sherlock Road, spoke in opposition, stating the EIR was not complete as it did not deal adequately with parking, hours of operation, the dimensions of the existing buildings, and the management of the proposed operation. Mary Stutz, Elena Road, spoke neither for nr mainst but questioned the weekly traffic analysis. Nr. Tom McReynolds, 26045 Moody Road, stated he has a water easement on the property and that he felt this should be discussed before action is taken. Mrs. Gallo, 25720 La Lanne Ct., commented on the traffic analysis. As there were no further comments from the audience, Chairman Perkins declared the Public Hearing closed and directed staff to respond to the questions posed by the audience. Commissioner Schick again questioned the use of "27" homes in analysis, stating that 27 homes could not be built, therefore, the figure should not be used. Commissioner Schick moved, seconded by Commissioner Carico, that all such references of the number 27 homes throughout the EIR will be deleted. Motioncarried by the folloving.roll call Vote: AYES: Commissioners Brown, Schick, Carico, Hillestad NOES: Commissioner Young, Chairman Perkins ABSENT: Commissioner Phillips (3) t PLANNING COMMISSION, May 14, 1975 �r Chairman Perkins questioned Mr. Vlasic on the repercussions of this motion. Mr. Vlasic stated that the validity of the EIR is seriously damaged. After further consultation with Staff, a short recess was called. After re -convening, Commissioner Schick moved, seconded by Commis- sioner Young, to rescind the previous motion of deleting all such references to the number 27 homes. Motion carried by the follauing roll call vote: AYES: Commissioners Carico, Schick, Young, Hillestad, Brawn, Chairman Perkins NOES: None ABSENT: Commissioner Phillips Commissioner Schick moved, seconded by Commissioner Young, that for the purpose of analysis of the environmental impact of the proposed project there is comparison to various hypothetical densities of residential development including a comparison with a maximum density of 27 homes. Twenty-seven homes are considered excessive and there is no implication intended that 27 dwelling `, units could actually be accommodated on the project site. Any proposal for residential development would have to be evaluated in light of Town regulations and the Los Altos Hills General Plan. The motion carried by the following roll call vote: AYES: Commissioners Young, Carico, Schick, Brown, Hillestad, Chairman Perkins NOES: None ABSENT: Commissioner Phillips The Commission directed Staff to include the last motion as a third paragraph on page 1, of the Proposed Final EIR. Commissioner Young moved, seconded by Commissioner Brown, to accept the Environmental Impact Report and all its various elements as submitted to date, as of 10:45 pm, Play 14, 1975. Motion carried by the following roll call vote: AYES: Commissioners Broom, Young, Carico, Schick, Hillestad Chairman Perkins 140ES: None ASSENT: Commissioner Phillips Because of the Lateness of the hour, Commissioner Schick, seconded by Commissioner Brown, and carried unanimously, to continue the Public 4earing of the Conditional Use Permit application for the Lands of Bellucci to the next regularly scheduled Planning Com- mission meeting of May 28, 1975. (4) e PLANNING COMMISSION, May 14, 1975 40 Commission directed Staff to prepare a list of possible conditions pertaining to the CUP application of Adobe Creek Lodge. F. NEW BUSINESS: 1. Election of Officers: a) Chairman: Chairman Perkins declared the chair open for nominations . Commissioner Young nominated Commissioner Perkins Commissioner Brown nominated Commissioner Carico Commissioner Schick moved, seconded by Commissioner Perkins, to close the nominations. Voting was done by secret ballot with Secretary Kate Tenney counting votes. The Secretary showed Commissioner Carico as the elected Chairman of the Planning Commission. b) Vice -Chairman: Chairman Carico declared the chair open for nominations for Vice - 4 Chairman. l7 Commissioner Perkins nominated Commissioner Young Commissioner Hillestad nominated Commissioner Schick Commissioner Perkins moved, seconded by Commissioner Brown, to close the nominations. Voting was done by secret ballot and the Secretary showed Commissioner Schick as the elected Vice -Chairman of the Planning Commission. It was the concensus of the Commission to dispense with the election of a Secretary as it was not necessary. There being no further business, the meeting was adjourned to the next scheduled regular meeting of the Planning Commission, May 28, 1975.
