Minutes of a Regular Meeting

Chairman Carico called the Study Session to order at 7:00 pm for the
consideration of By -Laws. At 7:45 pm Commissioner Schick moved, seconded
by Commissioner Brown, to continue the Study Session to the next regular
meeting of June 11, 1975. Motion carried by the following roll call vote:
AYES: Commissioners Brawn, Schick, Hillestad, Young, Chai man Carico
NOES: None
ABSENT: Commissioners Perkins, Phillips
Chairman Carico called the regular meeting of the Planning Commission to
order at 7:57 pm in the Council Chambers at Town Hall, 2637) Fremont Road:
A. ROLL CALL:

B. APPROVAL OF MINUTES: May 14, 1975
Commissioner Brown asked that on page 3, third paragranh, second line,
that the "Memo of April 18" be included in his motion.
Commissioner Schick asked the the words "26 + acres" be added to page
3, first paragraph, end of last sentence and—page 3, paragraph 10,
second line, after the words "...could not be built".
There being no further corrections, Chairman Carico declared the minutes
of May 14, 1975 approved as corrected.
Commissioner Schick moved, seconded by Commissioner Brawn, to change the
order of the Agenda, hearing items D-1 and D-2 before item C. Motion
carried by the folowing roll call vote:
AYES: Commissioners Brown, Schick, Hillestad, Chairman Carico
NOES: Commissioner Young

PLANNING COMMISSION - May 28, 1975
0. REQUEST FOR EXEMPTION FROM THE MORATORIUM:
1. LANDS OF MAURER, La Paloma near Fremont, 4 lots, Danforth Apker,
Engineer, T11-2023-75
City Engineer Alec Russells staff report noted that as this land
is extremely flat, and will require very little gradina, insofar
as the construction of the proposed cul de sac, running in a
westerly direction from La Paloma Road, and the drainage can be
adequately taken care of, it was suggested by Mr. Russell to the
Planning Commission that they recommend to the City Council, that
this particular parcel be exempt from the present Subdivision
Moratorium.
Commissioner Schick moved, seconded by Commissioner Hillestad,
that due to the Staff recommendations, Commission recommends to
Council the Exemption of the Lands of Maurer from the Moratorium.
Motion carried by the following roll call vote:
AYES: Commissioners Brown, Schick, Young, Hillestad, Chairman

City Engineer Alec Russell presented the Staff report, suggesting
that if the Planning Commission determines that the proposed lands
of Besseneyey and Macleod be considered exempt from the subdivision
moratorium, and the City Council concurs in this recommendation,
the subdividers, through their engineer, will present to the Town
a subdivision map, which will be considered further by the Sub-
division Committee. Mr. Russell went on to say that as the land
in parcel "B" is generally flat in nature, except in the laver
southeast corner of the parcel, and parcel "A" will be made available
to the Town of Los Altos Hills, it was suggested by Mr. Russell that
the Planning Commission consider a favorable recommendation to the
City Council, stating that the Lands of Westwind Farms be exempt
from the Subdivision Moratorium.
Commissioner Schick moved, seconded by Commissioner Hillestad, that
the Commission recommend to Council to exempt Lands of Westwind
Farms from the Subdivision Moratorium. Motion carried by the
following roll call vote:
AYES: Commissioners Schick, Brown, Hillestad, Young, Chairman
Carico
NOES: None

The Commission recessed for 15 minutes before the Public Hearing.

C. PUBLIC HEARING: Continued from May 14, 1975
1. LANDS OF BELLUCCI, ADOBE CREEK LOOCE, CU -8004-74
Chairman Carico explained to the audience the order of procedure for
the Public Hearing.
Planning Consultant Tcm Vlasic went over the list of conditions and
the reasoning behind them. After discussion between Commission and
Staff, Chairman Carico declared the Public Hearing for Adobe Creek
Lodge open to the public.
Mr. William Zoller, attorney for the applicant, spoke of the changes
in the Conditional Use Permit application stating that Mr. Beilucci
is in basic agreement with the conditions proposed by Staff, except
condition #23, which is a minor problem concerning one particular
family living in a mobile home. Mr. Bellucci requested an extension
of time be given to this family for extenuating circumstances.
Speaking in favor of the CUP application.
Robert Jones - 25005 La Loma, spoke as a member of the Club, stating
he felt the Club was an asset to the Community.
Mary Stutz, 25310 Elena, stated the Lodge has not hurt the Teem and
would rather see the Country Club remain than see a subdivision.
Mr. Hineman, 680 Benvenne, Los Altos, spoke as a member of the Club
and in favor of the Club as an asset to not only Los Altos Hills, but
Los Altos.
Bob Stutz, 25310 Elena, spoke in favor of the application, adding that
an 8:00 pm closing time for tennis and swimming was a little early.
Irma Goldsmith, 27330 Elena, spoke to Mr. Wineman's comments.
Speaking in opposition to the CUP application:_
Alma f=lood, 12151 Stonebrook, reminded the Commission of the reason for
incorporating.
David Proft, 26271 Moody, opposed the granting of the CUP application,
but suggested some conditions to diminish the possible noise.
There being no further comments from the audience, Chairman Carico
declared the Public Hearing closed and called a short recess.
The Commission reconvened at 9:10 pm and began to discuss the Conditions
proposed by Staff.

1. The Conditional Use Permit is for a non-profit tennis and swim club.
Except as conditioned ;ierein,the non-profit club characteristics,
facilities, activities, site etc., shall be as described in the
CONDITIONAL USE PERMIT STATEMENT OF APPLICATION, dated April 1, 1975
as revised May 21, 1975, and as shown on the Area Description Map
dated April 1, 1975 submitted in support of the STATEMENT OF
APPLICATION.

2. The Conditional Use Permit shall be issued in the name of the Los
Altos Hills Country Club, a non-profit corporation, and shall run
with the Life of the corporation or until the CUP is amended or
cancelled. The CUP shall not become effective until all of the
following have been completed:
a. Proof has been provided to the satisfaction of the City Attorney
that the non-profit corporation has been extablished pursuant
to the provisions of California non-profit corporation law;
and a copy of the By -Lotus have been filed with the Town;
A copy of the Articles of Incorporation will be submitted to
the Town before said Articles are filed;

3. Only those buildings, structures and facilities described in the
CUP STATEMENT OF APPLICATION and shown on the Area Description
Map shall be permitted. No other buildings, structures or facilities
shall be erected or installed without amendment to this CUP, except
those required by the Santa Clara County Health Department and Ko$
Alto$ Fife/DonArtmont. Los Altos County Fire Protection District.

vehicles and no more than 2000 persons on the property at any given
time.
5. The 64+ acres designated as permanent open space on the Area Des-
cription Map shall be maintained in permanent open space and no
grading or structures other than are approved as part of the CUP
or as part of an approved trail and path system and are of a minor
nature shall be permitted. Any uses within the open space area

On or about one year from the effective date of the CUP, at the
time of the first annual review, the Planning Commission , at a
regularly scheduled public hearing, shall review the hours of
operation and may, based on information presented, as necessary,

last paragraph of Condition 6 with changes]
7. Requested conditions of approval of the Santa Clara County Health
Department, contained in the Department's letter of December 3,
1974 or modifications therof approved by the Department shall be
complied with in a timely manner. In this regard, Within/tdrde/
Oodtds/of prior to the effective date of the CUP the applicant
shall submit a plan and time schedule for compliance with the
Health Department's requirements. Written proof, to the satis-
faction of the City Manager shall be provided verifying approval
of the compliance with all Health Department conditions, verifi-
cation of compliance shall be provided to the satisfaction of the
City 'tanager. Upon verification, the City Manager shall record
in the appropriate CUP file at Town Hall that conditions have
been complied with.

As the hour was after 11:00 pm, Commissioner Young moved, seconded by
Commissioner Schick, to continue the Public Hearing on Adobe Creek Lodge
to the next regular meeting of June 11, 1975. Motion carried unanimously.
Chairman Carico adjourned the meeting at 11:05 pm to the next regular
meeting of the Planning Commission scheduled for June 11, 1975.
