Conditional Use Permit application for Adobe Creek Lodge.

Commissioner Schick requested the following statement to be read
into the record:
During the course of this hearing, I will not take additional time to

substantiate my recommendations when made for the following reasons;
For a CUP, our Municipal Code states the proposed use shall be
reasonably compatible with land uses normally permitted in the
surrounding areas and not adversely affect the surrounding areas.
Section 9-5.1107 also states "Every conditional use permit granted
may be subject to such conditions as are deemed necessary to protect
the public health, safety, and general welfare and secure the
objectives of the General Plan." My forthcoming suggestions are
based on these objectives along with all the documentation received
by this Commission.
6) For the period of one year from the effective date of the CUP,
the maximum hours of club operation shall be as follows:
a) Tennis --daily from 8:00 am to 8:00 pm;
b) Swimming --daily from 10:00 am to 8:00 pm;
c) Food and beverage service in Supper Club and Tally -Ho -Restaurant -
daily from 10:00 am to 12:00 midnight, except for Fridays and
Saturdays where the hours may be ln:n0 am to 2:nO am.
On or about one year from the effective date of the CUP, at the time
of the first annual review, the Planning Commission, at a regularly
scheduled public hearing, shall review the hours of operation and
may, based on information presented, as necessary, modify hours of
operation to ensure that objectives of the general plan and zoning
ordinance are being met. The Commission may, at the request of
the applicant, extend the hours of operation if it appears such
extension is consistent with the policies and objectives of the
Tarn.

8) Conditions of approval requested by the Los Altos County Fire
Protection District in the District's letter of November 25, 1974
or modifications thereof approved by the District shall be adhered
to. Within six months of the effective date of the CUP the appli-
cant shall provide verification to the satisfaction of the City
Manager that these conditions of approval have been complied with.
Upon verification, the City Manager shall record in the appropriate
CUP file at the Town Hall that conditions have been complied with.
Commissioner Schick recommended to change condition 8 to read:

Protection District in the District's letter of November 25, 1974

of the City Manager that these conditions of approval have been
complied with. Upon verification, the City Manager shall record
in the appropriate CLIP file at Town Hall that conditions have
been complied with.

shall cause to be completed a thorough evaluation of on-site
circulation and parking related to estimated peak period on-site
traffic conditions (including maintenance and/or improvement of

of the City Engineer and shall include a comprehensive plan add-
ressing interior circulation that will ensure rapid traffic move-
ment away from the primary entrance to the club and ease of access
to adequate parking areas with minimum conflict with Pedestrian
traffic. The evaluation and circulation/parking plan shall require
L implementation of the plan.
Commissioner Schick recommended a consolidation of Conditions 9,11
and 12 to read:
Prior to the effective date of the CUP, the applicant shall cause
to be completed a thorough evaluation of on-site circulation and

County and Fire Marshall. The approved evaluation and circulation/

priate, the Council shall require implementation of the plan prior
to the effective date of the CUP.

A question arose as to the wording "prior to" and"within six months".
The question was directed to the City Attorney who responded that
as a general proposition that which is to be done as a condition
of the Use Permit would be completed before the benefits under
the permit are exercised. He went on to say that the history of
the Use is already established and that could be used as a basis
for the traffic evaluation.

10. Within six months of the effective date of the CUP the applicant
shall have completed a thorough engineering evaluation, to the
satisfaction of the City Engineer, of traffic movement limitations
resulting from cars waiting to enter lodge property during peak
periods. As part of this evaluation specific corrective measures
shall be recommended. Particular attention shall be paid to the
potential need for provision of a left turn lane at the primary
entrance to the club. The results of the evaluation shall be
presented to the Planning Commission, and as appropriate the Comm-
ission may require that corrective actions be implemented.
Chairman Carico recommended that Condition 10 be changed to read
Prior to the effective date of the CUP the applicant shall have
completed a thorough engineering evaluation, to the satisfaction
of the Traffic and Public Safety Committee and the City Engineer,
of traffic movement limitations resulting from cars awaiting to
enter lodge property during peak periods. As part of this eval-
uation, specific corrective measures shall be recommended and
implemented, at the cost of the applicant, prior to the effective

date of the Conditional Use Permit. Adequate on-site parking
and turn - around areas must be provided. .411 roads leading to
or from parking lots (including those located on the ancient
landslide mass) must be capable of simultaneously carrying two-
lane traffic for safety and fire hazard protection. Owner shall
install a left-hand turn stacking lane at main entrance capable
of handling a minimum of eight cars (widening road where necessary).
This to ensure safety, expeditious traffic movement and no delay
to emergency vehicles. Traffic control facilities and resources
shall meet the approval of the Los Altos Rills Chief of Police,
Sheriff of Santa Clara Cnunty and the Fire Marshall.
The question of "prior to" vs "within six months" arose and was
directed to the City Attorney. Mr. Gillio advised the Commission
to set requirements that could be achieved in conjunction with the
effective date of the CUP, as it would be easier to implement at that
time rather than at a later date.

11. (condition 11 was deleted and consolidated into condition 9)
Until the plan referenced in condition 8 above is prepared
and approved by the Planning Commission, development of any new
far on-site parking facilities shall not be Permitted. Particularly
the proposed 20 new paved spaces shown on the Area Description Map
immediately west of the primary entrance shall not be permitted
unless found by the Commission to be appropriate as a result of the
interior circulation/parking evaluation.
12. (condition 12 was deleted and consolidated into condition 9)
Traffic control measures shall be taken to the satisfaction
of the City Engineer to control vehicle speed on site.
13. Within three months of the effective date of the CUP calculations
shall be submitted in support of the hydrologic data contained on
pages 23 and 24 of the Final EIR for the subject CUP. These cal-
culations shall be provided to the satisfaction of the Santa Clara
Valley Mater District and the City Engineer.
Commissioner Brown recommended to change condition 13 to read
Prior to the effective date of the CUP, calculations shall be
submitted in support of the hydrologic data contained on pages
23 and 24 of the Final EIR for the subject CUP. These calculations
shall be verified to the satisfaction of the Santa Clara Valleu
Mater District and the City Engineer.

14) The City Manager shall be notified of all special club events
and "outside activities". Such notification shall be made at
least ten days prior to the event unless this is impossible due to
scheduling problems. In any event, notification shall not be
received at Los Altos Hills Town Hall any later than 72 hours
prior to the event. Notification shall be in writing and shall
include the following information:
a) Number of persons expected to attend;
b) Character of event, facilities to be used, etc.;
c) Estimated hours of event, starting and stopping times, expected
peak arrival and departure hours;
d) Person in charge of event coordination, traffic control, etc.,
who can be reached if problems arise;
e) Any other pertinent information to the event.
The Town as appropriate shall evaluate such events to ensure the
activity does not conflict with Town policy. When problems are
encountered the City Manager shall request a meeting with club man-
agement to resolve concerns. If resolution of concerns cannot
be accomplished to the mutual satisfaction of the City Manager and
the club management, the matter shall be brought before the Planning
Commission.
Commissioner Hillestad recommended the deletion of the first t•m
sentences and inserting the follrnaing paragraph:
The non-profit club will notify the Town at least 72 hours in
advance of special club events and outside activities, and make
all necessary arrangements for officers approved by the Town, to
direct traffic and on-site circulation, including crowd control
and security during the course of, and two hours preceK�iog,. and
one hour subsequent to such event. A minimum of one officer will
be required for 150 to 300 persons, and additional officers for
any over 300 persons attending such special events. The non-profit
club will take care of the expenses incurred in such matters.
Commissioner Schick recommended that condition 22 be deleted and
consolidated in the last paragraph of condition 14 to read:
Within 8 months of the effective date of the CUP the City Manager
shall present the Planning Commission with a summary of outside
activities that have occurred and any related problems that have
not been resolved. The Planning Commission may, as a result of
these presentations, aimend the CUP.

4Ir adopted: 14) (as ammended to read:) The non-profit club will notify the Tam at
least 72 hours in advance of special Club events and outside
activities, and make all necessary arrangements for peace officers
approved by the Town, to direct traffic and on-site circulation,
including crowd control and security during the course of, and
two hours prece.diog. and one hour subsequent to such event. A
ndnimum of one peace officer will be required for 150 to 300 persons,
and additional peace officers for over 300 persons to be determined
as required by the Town. The non-profit club will take care of the

16) The Noise Abatement Committee shall, during the first year of
operation of the club, monitor use of the facility and report to the
V Planning Commission, at the time of each annual review or sooner if
necessary, on:

~' a) Specific problems re noise generated from the facility which
is incompatible with surrounding residential uses;
b) Recommendations for noise attenuation, if necessary, to ensure
that noise levels are compatible with noise generally prevailing
for adjacent residential uses.
Based on findings of the Noise Abatement Committee the Planning
Commission may, as appropriate, amend the CUP to include noise
attenuation measures.
Commissioner Hillestad recommended to add the following:
c) Provide air-conditioning in Supper Club and Tally -Ho to retain
sounds within the structures and also maintain proper temperature
and air circulation.
City Attorney Frank Gillio was questioned on this matter, re the
legality of the Town in requiring the club to install air-conditioning.
Mr. Gillio noted that in fact this was covered in the first paragraph
of condition 16.
Commissioner Young recommended a more general approach to the noise
problem, suggesting that the Commission limit the noise to within
the boundaries of the property. The,,loist Abatemznt Committee should
monitor the noise from without the property line.
Commissioner Schick recommended to add the following under item
16 (c) to read:
The club will install pads, covering all exterior perimeters of the
tennis courts to mitigate sound impact.
Chairman Carico recommended condition 16 (b) be amended to read:
Recommendations for noise attenuation, if necessary, to ensure
that noise levels are compatible with noise generally prevailing
for adjacent residential uses, with emphasis based on mitigating
measures to ensure lessened noise from tennis courts.
Commissioner Broom recommended that the first paragraph of condition
16 be amended to read:
The Noise abatement Committee shall, during the first eight months
of operation of the club, monitor use of the facility and report
to the Planning Commission, at the time of each annual review or
sooner if necessary, on:
Commissioner Bram recommended an added paragraph for condition 16

The Pathway Committee shall reserve the right to request a link
from the laver path to Windmill fieadows area at the first annual
review of the CUP.

18) Within one year of the effective date of the CUP the applicant
shall cause a landscaping plan to be prepared. The plan shall
address, but not be limited to, landscaping_ of the tennis activity
center and the picnic activity center, and the interior pedestrian
circulation system. The landscaping plan shall be prepared and

commissioner Brrnon recommended a consolidation of conditions 18 and
19 to read:
Prior to the effective date of the CUP, the applicant shall prepare
a landscaping plan. The plan shall address, but not be limited
to, relatively dense surrounding landscaping of the tennis activitigs,
the old picnic activity center, the interior pedestrian circulation
system and the property lines to the north, northeast and east.
The landscaping plan shall be prepared and implemented to the
satisfaction of the Environmental Design Committee and the Noise
Abatement Committee. A bond shall be posted with the Town
guaranteeing the implementation of the landscaping plan. Such
landscaping shall be completedwithin six months of the effective
date of the CUP.
adopted: 18) (as amended and recommended to Council) Prior to the effective
date of the CUP, the applicant shall prepare a landscaping plan.
The plan shall address, but not be limited to, relatively dense
surrounding landscaping of the tennis activities, the old picnic
activity center, the interior pedestrian circulation system and
the property lines to the north, northeast and east. The land-
scaping plan shall be prepared and planted to the satisfaction
of the City Engineer, the Environmental Design Committee, and the
Noise Abatement Committee. A faithful performance bond shall be
4W posted with the Town guaranteeing the implementation of the
landscaping plan. Such landscaping shall be completed within one
year of the effective date of the CUP. The planting shall be
subsequently maintained by the Club.

20) As possible the proposed new tennis courts shall be moved as
far west as is feasible.
Chairman Carice recommended the deletion of Condition 20 as is
and substitution to read:
a) The (2) two tennis courts in Area A may be upgraded to regulation
size.
b) Four (4) regulation size tennis courts may be constructed in
area C (the purpose is to mitigate potential flood and noise impact
by spreading the impact over a wider area.)
c) The non-profit club may, upon showing need at a later date,
obtain permits for not more than (6) six additional tennis courts
to be constructed in area C. The total number of tennis courts
kw not to exceed (12) twelve.

City Planner Ken Pastrof answered ouestions proposed by the Commission
pertaining to the Staff report and the pathway easement. Staff, in
t their memo of June 6, 1975, noted that the Newman property had
V undergone considerable revisions since its first application and
subsequent exemption from the Moratorium by Council, 2/19/75.

Since changes were of a minor nature, it was the opinion of Staff
that a Subdivision Committee meeting not be scheduled to consider
the original vs the revised map. Staff's opinion was to approve
the subdivision with the conditions of the Staff memo of June 6.
Mr. Alan Lambert, developer, questioned condition 6, stating that
since the path easement would need brushing yearly, it was not
necessary for the applicant to brush once, as it is very costly
for both the applicant and the Town to maintain.
Por. Stutz, Chairman of the Pathway Committee, proposed a revised
pathway, which the applicants representative, Mr. Lambert, had
unofficially agreed to outside of Chambers.
Staff felt that this new pathway easement was inaccessable to horses
and most hikers, stating that there would be no way to cross the
creek on the north and easterly sides of the proposed subdivision.
Staff also reminded the Commission of the high cost the Town would
incur, to maintain this pathway.
Commissioner Schick moved, seconded by Commissioner Hillestad, to
except the revised Tentative Subdivision Nap for lands of Newman,
4 Monte Lucero #4, and recommend approval to Council, with the
�r conditions so imposed by Staff with Condition 6(A) deleted. Motion
carried by the Following roll call vote:
