STUDY SESSION: Consideration and adoption of By -Laws
Chairman Carico called the Planning Commission meeting to order at 8:15
pm in the Council Chambers at Tarn Hall, 26379 Fremont Road:
A. ROLL CALL:

B. APPROVAL OF MINUTES: June 11, 1975
Due to revisions in the Minutes of June 11, 1975 Chairman Carico, with
the consensus of the Planning Commissioners present, with the exception
of Commissioner Perkins, deferred the approval of the Minutes to an
adjourned meeting on June 26, 1975.
C. PUBLIC HEARING:
1. Owlwood Farms, Conditional Use Permit, 24970 O'Keefe Lane, Frank
Ugie, Owner, CU -8007-75

Mr. Pastrof noted that Staff had no further comments to add to the
Staff memo presented to the Commission.
Hr. Frank Ugie, applicant, had no comments.
Commissioner Young asked Staff if they had received any complaints
concerning this CUP, Staff responded they had not.
Commissioner Schick questioned Staff re Condition 15, asking if
this dealt with the non -conforming structures on the Uqie property
and whether or not the applicants understood that some of the
structures were non -conforming.

Staff responded that the applicants were aware of this and that
Council would determine what disposition will be after January,
1976.
Commissioner Young moved, seconded by Commissioner Hillestad, to
approve the application for CUP, Owlwood Farms CU -8007-75, subject
to the conditions recommended by Staff and subject to any directions
from the City Council regarding non -conforming uses during the
period of the Use Permit. Motion carried by the following roll tali
vote:
AYES: Commissioners Brown, Young, Hillestad, Schick, Perkins,
Chairman Carico

2. Lands of Doyle, Josefa Lane, Tentative Subdivision Nap, John Riley,
Engineer, TM -2024-75

'lr.. Pastrof noted that Staff had no further comments to add to the
Staff memo presented to the Commission.
Mr. John Riley, Engineer and agent for the applicant, agreed to all
the conditions recommended by Staff with the exception of the
Condition concerning the path way accross the creek bed. Mr. Riley
objected to the fording device required, stating that the horses
could use their legs as a fording device, thereby saving the applicant
a great deal of money.
Chairman Carico opened the Public Hearing to the audience.
Bob Stutz, Chairman of the Pathway Committee, spoke of the path
requirement.
Mita Steiniker, Josefa Lane, questioned the extension of the paved
pathway.
Mary Stutz, Elena Rd., spoke on the original conditions of the Path-
way Committee concerning Lands of Doyle.
John Steiniker, Josefa Lane, spoke in opposition to the paved path-
way, stating it invited motorcycles.
Bob Johansen, Josefa Lane, questioned the access road.
Discussion ensued regarding the pathway and road access across the
Conservation Easement.

Commissioner Perkins stated t"at some questions had to be resolved
concerning the pathway, private vs public access road, and the
Conservation Easement.
Commissioner Young asked Staff to formulate rules to protect and
define Conservation Easements, and this to be submitted to Commission
for review.
Commissioner Perkins moved, seconded by Commissioner Brown, to
continue TM -2024-75. Lands of Doyle, to the next regular meeting
of the Planning Commission of July 9, 1975, due to the concerns
of the Commission and with the consent of the applicant. Notion
carried by the following roll call vote:
AYES: Commissioners Brawn, Schick, Hillestad, Young, Perkins,
Chairman Carico
NOES: None

3. Lands of Nestwind Farms, Altamont Road, 3 lots, 4 acres, Paul Nowack,
-Engineer, TM -2023-75

Mr. Pastrof noted that Staff had no further comments to add to the
Staff memo presented to the Commission.
Penny King, representative of the applicant, agreed to all of the
conditions as set forth by Staff.
Discussion ensued concerning the road access to the barn, (to lot 4)
via Byrne Park Reserve, condition 11 re: the need for a CUP for
the guest cottage and whether that could he applied prior to the
recordation of the Final Map, and landscaping.
Commissioner Perkins moved, seconded by Commissioner Hillestad, that
a satisfactory solution be obtained from Council concerning the
would-be non -conforming use of the guest cottage located on Lot 2
and that this be attached to condition 11 as 11(a). Motion carried
by the following roll call vote:
AYES: Commissioners Brown, Hillestad, Schick, Perkins, Chairman
Carico
NOES: Commissioner Young
ABSENT: None
Commissioner Schick moved, seconded by Commissioner Perkins, to
approve the Tentative Subdivision Map with the conditions as set
�r forth by Staff and with Condition 11 amended as above and condition
3 amended to read: Adequate road access to Lot 4 from Altamont
thru Byrne Park Reserve, as conveyed to the City by Nature Conservancy,

permitting said roadway to be used by the General Public, including,
but not limited to, fire and emergency services. Notion carried by
the following roll call vote:
AYES: ALL
NOES: None
ABSNET: None
Commissioner Schick moved, seconded by Commissioner Brown, to continue
the meeting of the Planning Commission past the designated hour of
adjournment time of 11:00 pm to hear the Lands of Maurer. Notion carried
by the following roll call vote:
AYES: ALL
NOES: None
ABSENT: None
4. Lands of Maurer, La Paloma near Fremont, 4 lots, Danforth Apker,
Engineer, TM -2023-75

Mr. Pastrof stated that Staff had no further comments to add to the
Staff memo presented to Commission.
Mr. Steven Apker, Engineer for the applicant, stated he was satisfied
with the conditions as proposed by Staff. Mr. Clarence Macrer,
applicant, stated his appreciation to the Commission and Staff for
the time extension.
After Staff answered the Commissioner's questions, Commissioner
Schick moved, seconded by Commissioner Hillestad, to approve the
Tentative Subdivision Map for Lands of Maurer subject to the
Conditions as set forth by Staff, 1 thru 11 inclusive. Motion
carried by the following roll call vote:
AYES: Commissioners Brown, Hillestad, Young, Schick, Chairman

ABSENT: Mone
ABSTAIN: Commissioner Perkins
There being no further business, Chairman Carico adjourned the Planning
Commission meeting of June 25, 1975 at 11:40 pm to the adjourned meeting
of June 26, 1975 in the Committee Room at Town Hall.
