HomeMy WebLinkAbout07/23/1975 (2)PLANNING COP*4SSION Town of Los Altos `sills 26379 Fremont Road Los Altos Hills, California minutes of a Regular meeting Wednesday, July 23, 1975 Reel 38, Side 1, Tract 1, 204 to end - Side 2, Tract 1, 001 to 416 Chairman Carico called the Study Session to order at 7:45 pm in the Council Chambers at Town Hall, 26379 Fremont Road: The objective of the Commission was to develop a list of guidelines to be attached to Conservation Easement Deeds as appropriate. As Section 9-4.604 (d) of the Los Altos Hills rtonicipal Code is somewhat ambiguous, Chairman Carico instructed the Cormdssion to list their concerns, these to be utilized at a future date as they pertain to each individual property, (ie: Conservation Easerents). In his memo of 7-3-75 re Conservation Easements, City Engineer Alec Russell proposed a list of tentative restrictions for the Commissioners to use as a catalyst for their own concerns. The ensuing discussion covered the Philosophy of Tam restrictions on Private property vs property timer rights and whether or not the Cormission wanted a flexi`_,le list of concerns to be dealt with at the time of each proposed Conservation Easement or a set list of conditions and restrictions to be selected for the Deed of Conservation Easement as they apply. (The following are the concerns voiced by the Commission, these to be voted into a list of guidelines for adoption at the August 13, 1975 Planning Commission meeting:) 1. tree and vegetation removal 2. cutting and/or brushing of vegetation 3. fencing 4. grazing and/or confining of hoofed animals S. excavating and/or filling 6. construction of structures 7. pathway easements 8. all other easements 9. fires The above mentioned concerns and the Staff's proposed conditions, as amended, will be submitted to the Commission for their review and subsequent adoption and thereafter be on file at Tam Hall. * Chainman Carico called the regular Planning Commission meeting to order at 9:00 pm in the Council Charbers at Tann Hall, 26379 Prerunt ^.gad: PLANNING C(RMSSION - July 23, 1975 A. ROLL CALL: Present: Commissioners young, Schick, Brown, Proft and Chairman Caries Absent: Commissioners Ilillestad, Perkins Staff: City Engineer Alec Russell, City Planner/Building, Inspector Ken Pastrof, Planning Secretary Kate Tenney B. APPROVAL OF 11INUPES: July 10, 1975, June 26, 1975, and Rules of Procedure Due to the lateness of the hour for Public Hearing, Commissioner Schick moved, seconded by Chairman Carico, and carried unanimously to carry the approval of the Minutes of July 10 and June 26, and the Rules of Procedure to after the scheduled Public Hearing. C. PUBLIC DARING: 1. LANDS OF DDYLE, (cont. from July 10, 1975), Josefa Lane, John Riley, Engineer, Ul-2024-75. (ref: Staff memo, Ken Pastrof, June 20, 1975 and July 10, 1975, (supplemental)). Chairman Carico opened the Public Hearing, recognizing, I!r. John Riley, Engineer for the applicant. I^r. Riley stated that due to the uncertainty of the restrictions re Conservation Easements, the applicant had removed the CE from the pronosed Tentative Subdivision Ilap• Commissioner Schick questioned Staff on the dedication of the 30' right-of-way easerrent and the type of path to be installed. There was notable concern from the Commission as to the cost and durability of a natural vs a Type I1 (a) (crushedrocJo pathway. As the app- licants Engineer, P7. Riley, had stated his opposition to installing a fording device (culvert) across the creek for the pathway. It was suggested that a "Texas" fording device be used as an alternative to a culvert (concrete path) . The Commission wanted the path to be utilized by bicyclist (which would be impossible with a type II (a) nath) up to Foothill College and for grade school children. Commissioner Schick suggested use of "Neary's Fine" material as a solution (def: 1/4 " minus rock, a by-product of aggregate base material),this finely crushed rock would make the path usable for bicydlist. The Commission questioned Staff concerning maintenance problems for the half-public/half-private road (Josefa). The City Engineer noted that it was common within the Town and that the Tann would probably be responsible for maintenance. - 2 - PLANNING COPMLSSION - July 23, 1975 (Lands of Doyle, cont.) Discussion ensued regarding the purose and advisability of a Conservation Easement, whether the Town could actually protect the creek by requiring the Conservation Easement, and, again, the responsibility of maintenance. As here is no existin^ -at:iway easer, .nt `^*:wee; the Yam and Foothill College, it e%,s suggested that either the pathway easement required from Fir. Doyle becomes void if the connecting, easement to Foothill College is not secured from the College (within 5 years) or if Foothill denies access in the future said easement would revert to the owner. Commissioner Young moved,s,conded by Commissioner Schick, to delete the Conservation Easementrmm the list of conditions to be approved by Commission. Fbtion caxrie-' ',y the following roll call vete: AYES: Commissioners Brown, Schick-, Young„ and Chairman Carico NOFS: Commissioner Proft ABSENT: Commissioners Hillestad and Perkins Comnissioner Schick moved, seconded by Commissioner Brown, to recommend approval to Council for the Lands of Doyle, T71-2024- 75, with the proposed conditions by Staff in their memo of June 20, 1975, amended as follows: Conditions 1, (2 deleted) 3, 4 and 5 - as submitted by Staff,(for purposes of clarification, the secretary will delete condition 6 as stated by Staff and amended by Commission, condition 6 to read:) 1) Dedication of a twenty (20)foot vehicular easement along the entire length of Josefa as depicted on 71-2024-75. 2) Dedication of a ten (101) foot path easement along the entire length of Josefa and from the easterly boundary of Josefa to approximately the 325' bench mark as depicted on 71-2024-75. 3) Pathway along Josefa, parallel to roadway, to be a native path, minimum width to be three (31) feet depending on topography with respect to roadway improvements and proximity to the bank 4) of the creek. Pathway from easterly boundary of Josefa to 325' bench mark to be constructed of "Neary Fines" material, six (6') in width, four (411) inches in depth. Construction to include "Texas" fording device in the vicinity of the creek. 5) Easement, including pathway, from Josefa to 325' bench mark, shall revert to the control of the property owner of Parcel 'A' should Foothill College ever enjoin the use of the path- way connection along the easterly boundary of Parcel "A'. 6) This condition (path construction) shall be deferred until the final inspections of each of the structures, due to disruption that may accompany construction. Each structure will, however, f have their respective path requirements met by the date of the final inspection. - 3 - PLANNING M?ffSSION - July 23, 1975 (Lands of Doyle, cont.) 7) Improvement plans shall be submitted and approved by the City Engineer prior to final approval by the City Council including, but not limited to: drainage, mad standards and length, culvert design for driveway, emergency vehicular turnaround (ref: LAFPD, Stu Farwell, 6-15-73 and 5-20-75), pathway standards and improvements. Condition 7 ani 8 (a) as submitted by Staff (condition 8 N) deleted). Incorporate restrictions on need of Easement (Conservation) within the Lands of Newman, FPI-3009-75. The following conditions and uses are recommended to the City Council as being prohibited in order to serve the general purpose for which the easement is dedicated: Lot 1 1. No permanent structures shall be allowed within the Conservation Easement (a fence to be considered a structure except for perimeter fences enclosing the easement). (motion carried unanimously) 2. Dumping of materials and refuse, including composting. (notion carried unanimously) 3. Public Utilities right-of-way as required by Purissima Hills County Plater District shall not be included as part of the Conservation Easement between lots 1 and 2. (motion carried unanimously) 4. Construction of both underground and overhead utility lines, including service lines. (motion carried uunrtim ously) S. (motion carried unanimusly) 6. Removal of undergrowth other than poison oak, if such removal will cause erosion problems, this to be determined by Staff. (motion carried unanimously) Lot 2 (Conditions 1 thru 6 as applied to Lot 1, also apply to Lot 2, with two additional conditions added) (Notion carried unanimously) 7. Removal of live trees with a circumference of more than ten (10") inches measured between the natural ground line and the first branch. (motion tarried unanimously) 8. Grazing or confining any domestic hoofed. animals because of possible erosion. (motion carried with Commissioner Proft opposed to Condition 8) Lot 3 (Same conditions as apply to Lot 2, with the excention of Condition 3, which is to be deleted) (motion carried, with Cormissioner Proft opposed to Condition 8) for The Commission directed Staff to revise Condition 6 of Lands of Doyle for clarification before it is submitted to Council. (the Chairman shall attest to the revision) commissioner Schick moved, seconded by ^uairman Carico, to agenda the approval of the Flimsies of July 10, 1975 and June 26, 1975 to the next regular meeting, of August 13, 1975.
