Vice -Chairman Hillestad opened nominations for the chairmanshin vacated
by Commissioner Brown. Commissioner Carico nominated Commissioner Perkins,
nominations closed, the Commission unanimously elected Commissioner
Perkins Chairman.
Chairman Perkins called the meeting of the Variance and Permit Cornission
to order at 7:48 pm in the Council Chambers at Tann Hall, 26379 Fremont
Road:

B. APPROVAL OF MUTES: July 23, 1975
There being no corrections, Chairman Perkins declared the P'inutes of
July 23, 1975 approved as submitted.
C. REOUEST FOn VARIANCE:
1. LANDS OF BRYAN, Lot 26, Tract 5098, P. Nowack, Engineer, VAR -7017-75
Hr. Bryan was requesting a reduction in setback of 20' along his
most northerly nroperty line and 15' along his nmst aoetPrly pronerty
line, for the installation of a swimming nmol.
According, to Section 9-5.1107 (b) of the Los Altos Hills Pinicipal
Code the Planning Cornission may recommend approval of a Variance
it all six conditions of said section anply.Staff maintained
that condition 1 did not apply as there was m alternate nool site,
and therefore, recommended denial.
Discussion ensued regardin, internretation or this section and
whether the Code Section applies to the subject nronerty. 'mr.
Pastrof stated there was another nool site on the property which
would have -ore sunlight and would not renuire a Variance.

Tlr. Bryan, applicant, stated the alternate pool site would require
removal of trees, which he was against.
Commissioner Hillestad moved, seconded by Commissioner Carico, to
continue Lands of Biyan to the next regular meeting of the Variance
and Permit Commission and during the interim the applicant and Staff
will work out an agreement. Motion carried unanimously.
2. LANDS OF BALLARD, 24752 Olive Tree Lane, Shahinian, Engineer,
VAR -7018-75

T.tr. Pastrof suggested to the Commission a recommendation to the
Council the feasibility of aquiring APN #336-35-087 (parcel 1
at the end of Olive Tree Lane). rim. Pastrof noted the area under
consideration could possibly be annexed and the Tom would benefit
from this aquisition so as to make Olive Tree Lane a Public road
4 in the future.
Commissioner Carico moved, seconded by Cormissioner Hillestad and
carried unanimously to recommend the City htanaeer research the
feasibility of aquirinp APN #336-35-087 for the Town and installing
a stop sip, at the end of Olive Tree Lane.
BUILDINC,, SITE APPROVAL:

Hr. Pastrof stated Staff had no further comments from the Staff
Mem submitted to Commission.
The Commission questioned the existing path easement and Commissioner
Carico moved, seconded by commissioner Hillestad and carried
unanimously to recommend to Council approval of Lands of Marcus
with the Staff conditions 1 thru 7 inclusive.
2. LAND OF WONG, Elena Road, (adjacent to Freeway), Harlan Heath,
Engineer, BSA -6050-75

11r. Pastrof stated Staff had no further comments from the Staff

The Commission questioned Staff on the frontage along Elena and
whether there was enough footage to allow Lands of :long access
from Elena. It was suggested that the Commission require a
pathway along the Freeway.
Discussion ensued regarding the 50' frontage along Elena and the
confusion between Old Elena Road and Llew Elena Road. The Commission
discussed the possibility of requiring a nathway alone the freeway and
any possible future link with adjacent subdividable property.
Ptrs. Fran Stevenson, Beaver Lane, stated she was in favor of the
pathway request along the Freeway.
ttr. Ding, agent for the applicant, stated he could not agree to
a pathway without consulting his client, but did question the
Commission as to the reason for requesting a Pathway from this
property owner and not from the property owners in the vicinity.
Commissioner Hillestad raved, seconded by Commissioner Carico and
carried unanimously to recormnd to Council approval for the Lands
of !long, with the Staff conditions 1 thru 8 inclusive and with an
added condition #9 to read: dedication of a pedestrian and
equestrian pathway, 10' in width, along the boundary of IS 280.
There being no further business, Chairman Perkins adjourned the meeting
of the Variance and Permit Commission at 7:55 pm.
