ROLL CALL: Present: Commissioners Carico, Hillestad, Chairman Perkins Absent: None Staff: City Planner Ken Pastrof, Planning Secretary Rate Tenney B. APPROVAL OF P4JMT ES: August 13, 1975 There being no corrections, Commissioner Carico moved, seconded by L Commissioner Hillestad, and carried unanimously to approve the minutes `, of August 13, 1975 as submitted. C. LANDS OF BRYAN, Lot 26, Tract 5098, Paul Nowack, Engineer, VAR -7017-75 (ref: file letters 9/19/75 and 7/22/75, Ken Pastrof, City Planner) Nr. Pastrof gave a brief synapsis of the events that have transpired since this applicant applied for a Variance. Discussion ensued re the alternate Pool sites as proposed to Por. Bryan by the Staff at the meeting of September 2, 1975. Ph•. Scott Bryan, applicant, stated he was against the proposed sites for reasons of privacy and tree removal and gave the Commission snan- shots of his property. Mr. Bryan introduced a letter from his pool contractor, Mr. Leon Finegold, which supported Tmr. Bryan's argument for the pool site as shoom on the Variance application. Commissioner Carico stated that the applicant had had control of the property since it was created and felt the application did not comply with the six conditions of Section 9-5.1107 (b) of the Los Altos Hills Municipal Code, namely conditions 1,2, and 3, therefore, as the facts do not apply to the subject case she moved to deny the request for Variance for Lands of Bryan. BUILDING SITE APPROVAL: 1. LANDS OF LEE: Natoma Road past Tripoli, John Riley, PpRineer, APN #182-20-012, BSA -6054-75 (ref: Staff memo, 9/19/75, Ken Pastrof, City Planner) Discussion ensued concerning the conditions of the Fire Department requiring, a fire hydrant to be installed and a 20' wide emergency access easement off Almaden court. The applicant had requested these conditions (7 thru 10) be deferred until the time of Sub- division. Pk. Lee, applicant, added that a 2" main existed and that it should be sufficient to supply one building site. Commissioner Hillestad moved, seconded by Commissioner Carico, to recommend to the City Council approval of Lands of Lee , ASA -6054-75, for Building Site Approval with the Staff conditions 1 thru 14 with conditions 7 thru 10 deferred to the time of subdivision. LANDS of PRIFIY,Moody Road between Buena Vista and Moody Court, Paul Nowack, Engineer, APN #182-30-024, BSA -6053-75 (ref: Staff memo, dated 9/19/75, Ken Pastrof, City Planner) The Commission questioned Staff on potential problems of grading, foundation design and additional land use. Commissioner Carico moved, seconded by Commissioner Hillestad, to recommend to the City Council approval of Lands of Prifty, BSA -6053-75, for Building Site Approval with the Staff conditions 1 thru 11, and that since this site is already created, it should be "categorically" exempt and a notice of determination to this effect shall be cormleted. motion carried by the following roll call vote: AYES: Commissioners Hillestad, Carico, Chairman Perkins NOES: None ABSITT: None E. NEW BUSINESS: 1. Commissioner Hillestad moved, seconded by Commissioner Carico, to 40, recommend to the City Council that the following words be deleted 2 _ 4W VARIANCE, AND PERIIT COMSSION, September 24, 1975 6 M ('New Business, cont.) from the Los Altos Hills Kmicipal Code: "...Planning Coimiission held immediately following the meeting of the Variance and Permit Commission. Each action of the Variance and Permit Commission, together with any action thereon by the Planning, Commission, shall appear on the Consent Calendar of the..." and change 'Planning Commission" in line 8 to "Variance and Permit Commission". t4otion carried unanimously. 2. Mr. Pastrof requested from the Commission some thought and direction concerning the pathways needed along TIoody Road. Mr. Pastrof stated that due to the steep hillsides in the area it would be difficult to construct paths along the Town side of `body, but that it might be possible to obtain an agreement with the County for a pathway along the County side of Moody Road.
