Commissioner !!illestad'scorrection concerned the flinutes of °/11/75, page 1, relating to the c':arne of the subcommittee stud_vinn the ABA= Regional Housing Element as follows: ".^.eview the ARAO Housing Report with the view toward producing a critique report as they would apply and affect Los Altos Hills an'' sections of the region." There being no further corrections, Commissioner Hillestad moved, seconded by Commissioner grown and unanimously carried to annrove the Minutes of October 22nd (Commissioner Proft abstaining), and the Minutes of Sept. 10, �, 1075 as corrected. Clens, Engineer: To+•!n Planner Ken Pastrof noted the Staff Renort prepared on the ahove request: dated November C,, 1975, stating there was no additional information to add to the report, and requested Commissioners to direct questions to Staff concerning the !written renort. Commissioner Young asked haw parcels "D" and "E" on the Fxemntion Hap orould he served, since it appeared there was no road access. Mr. PastroF resnonded that the applicant's agents honed to have those parcels served by ;tool Road, either throur" an agreement with the present ovner of the road, or by Purchase and subsequent dedication to the Tarn. Parcel "F" would also be served in ,.lis manner. Parcel=_ "A.", "9" and "C" appeared to have access, thougN h . Pastrof noted ".,hat the legal easement was not clear. Commissioner YounO also raised the question of slope stability on Parcels "A", "R", and "C". �Ir. Pastrof stated that the discussions held to date on this property concerned themselves with whether the nroperty warranted consideration for exemption From the moratorium as it related to the concerns of the To�'n renarding excessive cuts and grading. Mr. Pastrof agreed with Commissioner Young that the map befnre Commission showed only the driveway configuration and did not indicate how much grading would be done to obtain access to the kaw pt:rcels. Sneakinn from the Floor: Plr. John Clear•:, Engineer for Applicant, addressed the Commission, statins that the amount of nrading was not shown on the map since there were no final nlans. Said cuts could he kent to three feet on the typical section. Mr. Clens also noted that he had been involved with this nrooerty For nearly eight years, during which time the lot configuration had been reduced from 45 to its present 7-3 parcels. After Nr. Clegg's presentation, questions were addressed to him concerning c!ho 'would drvelon the lots; the v,idth of t'oon Drive, and its owner of records. sh Y+er tha lets MUld be further suhdividahle, and certain lot configurations. Mr. Clegg resounded that the development of the lots !would be optional td th the purchaser as to !d,o would develop the parcel once approved; that the deed and conservation easements would limit any furt@er Subdivision. He stated that huildinn sites and conservation easements would come un during the tentative man stage where details would be !corked out, The owner of record of !loon Drive was a Mr. C. J. Moon, and that noone had been able to locate him since 105,. 1'm. Pastrof resnonded to other questions asked by Commissioners nertaininn 4W to alternative roads if the owner of Moon nrive did not consent to the planned access, and grading and cuts on some of the parcels. Mr. Ceorqe Esch, Attorney for the developers, addressed commission, stating that the developer was millinq to place deed restrictions on the lots so they would not he further suhdividable, and they would he td1linn to work with Vie City Attorney and Staff in this regard. City Engineer Alex Russell stated that he did not consider the man as pre- sented the best use that could be made of the property', that as far as he COO(! . see, the parcels were not "estates", but were nieces of property that could be further suhdividable. After further discussion, Commissioner Rrown moved, seconded by Commi3s'Xrer Schic!< that the request for exemption from the subdivision moratorium, SADDLE hVIN,TAI°I ESTATES, Am 13'-07-097, he denied without prejudice. Commissioner Yam^ requested that the concerns of the Town as listed in the resolution calling for a subdivision moratorium be read into the Record as fol lows• 1) 'xcessive gradinn wMc'a results in accellerated eros ow. 2) excessive removal of trees:. anti 3) The creation of lots which do not afford sites which provide space suitable for the variety of uses normally associated E( with residential uses in the Toi.-,n. 4r Commissioner Young thounht that there was only one item which could possibly result in the denial of the annlication which was "the creation of cut and fill ban![s over which driveway accesses to lots are difficult to achieve." Commissioner Dro!,n also called to the Commission's attention his concern over the excessive removal of trees. She then onened the floor for comments and discussion from Commission menhers. Commissioner Proft questioned Item 4 on page f, paragraph 2 as presented. After suggestions were received, it vas Commission's concensus that the entire second paragraph be numbered Item 5, with :iordinq and punctuation changes reading as follows: "G. The housing concept shall require that ALL citizens have a complete and denocratic freedom of choice as to their life-style; a housing spectrum providing maximun housing where services are available, as well as low Henswt" housing whare services are not immediately available, thereby meeting all of the citizens needs without denying freedom of choice. There is a viahle place for lent -density housing in given areas." OTHER COH'IMS", Commissioner Young felt the Report should come out stronely onnosed to any attempt by AMC to make itself responsible for local planning. Ile agreed raith Commissioner Schick that the first paragraph should state "The Planning Commission", and not "The Town..." Hr•never, after discussion, it was Commission concensus to eliminate the first two sentegces in their entirety, and that the remaining paranranhs be r.umhered 1, 2 and 11, respectively. romMSion concensus jnas that number V be renamed "CO'!rLUSIOi'S Vn PECOf4TE,)ATIMS." Under this heading, naranraph A, Cor. issioner Young moved, seconded by Commissioner Schick and unanimously carried, to begin the nara- nraph with, "The Planning Commission recommends that, the City Council condemn unequivocally any planning function nertair,inq to housinn by ABAG." The rest of the naranraph to read, " This report cannot be endorsed because the need or place of ABAG in Local Housinn has not been demonstrate!." The Commission anreed with Chairman Carico's sungestion that numher VI be eliminated and that naranraph he marked "E" under number 1!, kith the addition of the words, "The Planning commission recommends that Council...." At the end of the repnrt, it ,as suggested that it be noted that the under- scoring !within the renort !was by the Planninn Commission for eno"sis only. The Commission so agreed. Commissioner Brorm suggested that the quotation marks in the first naranraph of pane 1 he cleaned up, and the Secretary was so directed b/ the Commission. There being no further comments, Chairman Carico directed the Secretary to retype the renort with the channes so noted. Commissioner Schick moved, ( seconded by Commissioner Proft and unanimously carried to accept the Report �r with the noted additions, corrections and deletions, and that Staff he direct^.d to furward the corrected Report to the Cit? Mpg tir^ pate C.'•a,�-e; Chairman Carico noted that, because the next regular meeting Fall on the eveninn before Thanksgiving when it would be difficult to get a ouorum, Staff had scheduled a meeting for November 25th for a Public Hearinn. She requested that the Comnissioners be polled to determine whether there would he a quorum present for that meeting. All Commissioners indicated they wo-Od be able to make the meeting on the 25th with the exception of Commissioner Schick and Chairman Carico, who were not sure.
