Chairman Lucy Hillestad called the Adjourned Meeting of the Variance r. Permit
Commission to order at 6:30 PM in the Council Chambers of Toon Hall:
A. ROLL CALL:
Present: Commissioners Proft, Younn, Chairman Hillestad
Staff: City Engineer Alex Russell, Town Planner Ken Pastrof, nenuty City
Clerk Norma Hislop
R. APPROVAL OF 11INUTES: Movember 17, 1975
Commissioner Proft requested that it be noted in the Minutes that he had
abstained from approval of the Minutes of Movemher 12th because of absence.
There being no further corrections to the Minutes of November 17th, they
4W were unanimously approved as corrected above.
C. ROILDIMB SITE APPROVALS - PURLIC HEARIHGS:
1. LANDS OF MARSHALL, File 4RSAF063-75, J. Hammond, Enqineer:
Town Planner Ken Pastrof stated that he had no additional information to
his Memo dated November 13, 1975.
In response to questions from Commission Members, Mr. Pastrof noted that a
Soils Report was being requested on subject property and would answer the
questions relating to drainage in the area. He also noted that because of
the leach line restrictions that this site may not be able to accommodate
all the normal amenities cF other lots.
Discussion continued regarding placement of the driveway, dedication of
rinbt-of-wav easement and road improvements. Commissioner Young requested
t!iat it be noted for the record that he felt a study should be made of the
potential of requirinq dedication of all rights to a private road from the
develoners of narcels as they come up so that in the future, the problems of
obtaining access and widening roads mould be alleviated.
In resnonse to Chairman Hillestad, Mrs. Marshall, Applicant, said she had no
questions regarding the Staff Report, and that she was familiar with the
conditions recommended.

Chairman Hillestad moved, seconded by Commissioner Proft to recommend
approval of the request for building site approval for LANDS OF MARSHALL
subject to Conditions 1 thru B as contained in the Staff Report of November
18, 1975. 61otion carried unanimously by roll call vote.
2. LANDS OF SUIFT, File #BSA6059-75, Jay Harmond, Engineer:
There being no further information to add to the Staff Report on subject
property dated Movember 21, 1975, Mr. Pastrof responded to Commission
questions with regard to drainage in the area and hog, the run-off would be
handled. In answer to Commissioner Proft's questi(,n, Mr. Pastrof explained
the leach line location.
Commissioner Young asked that Or. Pastrof include in his Report the in-
formation that a geology or soils report was not required by the Town
Ceologist when this was the case.
fir. Pastrof also explained the pathway easement requested for the subject
property. lir. Swift, Applicant, addressed the Comniccinn, stating that he
o:ould prefer not to have equestrian uce of the proposed pathway, but would
have no objection to bicycles or pedestrians.
Mrs. Cindy Hettinger, Pa0way Committee representative, discussed the
reasons for this pathway request and discussion ensued regarding easements

After further discussion, Commissioner Young moved, seconded by Chairman
Hillestad to add Condition #7 to the list of conditions as follows:
°7. Dedication of a pathway easement on the easterly boundary of property
adjacent to the freearay, 10' in width, for equestrian, pedestrian and
bicycle purposes only, and excluding power driven vehicles." [lotion carried
unanimously by roll call vote.
Chairman Hillestad moved, seconded by Commissioner Proft to recommend
approval of the request for building site approval, LANDS OF SYIFT, subject
to Conditions 1-6 as contained in the Staff Report dated November 21st, with
the inclusion of Condition µ7 (above), and that the property be declared
exempt from the requirements of the CEQA categorically. Motion carried
unanimously by roll call vote.
3. LANDS OF PABST, File #3S.A6057-75, F. Pisano, Engineer:
Mr. Pastrof noted that the applicant had submitted plans to the Health
the
Department showing adequate drain line room, and that in compliance with
Ordinance, the City Engineer was requiring a thirty foot dedication for
road purposes, but no in -lieu fees were being required.

^1r. Pastrof responded to the concerns stated above, noting that if this
buildinn site approval were nranted, the Commission would have to exempt
the property from that section of the Municipal Code pertaining to private
roads, and that the Health Department had investinated the property and had
given approval.
Speakinn for the Applicant, Mr. Frank Pisano, Engineer, addressed the
Commission, and said he agreed with the Staff Report. He asked about when
the conditions would have to be met, and when the fees involved would have
to be paid. Mr. Russell clarified the policy of the Tonin concerning these
matters. Hhen Mr. Pisano stated that the fees imposed ewould be a hardship
for the applicant, Mr. Russell noted that the applicant could appeal the
matter w6n it came before Council for action.
After further discussion, Commissioner Proft moved, seconded by Chairman
4WHillestad to recommend approval of the request for building site approval,
LANDS OF PABST subject to conditions 1 thru 10 as outlined in the Staff
Report dated November 21, 1475; that the property be nranted an exemption
from the renuirements of Section 9-4.601 relatinn to private roads since
the property was a lot of record prior to the Toedn's incorporation- and that
the property be declared categorically exempt from, the requirements of the
California Environmental Quality Act. Motion carried unanimously by roll
call vote.

Mr. Pastroff requested continuance of Items 4 and 5 (above) until the next
neetinn, statins that Lands of Swyryd was currently being reviewed by the
Town Geologist, and a nen map had been submitted on Lands of Mishiguchi.
Commissioner Young moved, seconded by Commissioner Proft and unanimously
carried to continue these requests for building site approval to the next
Regular Meetinq of the Commission on December 10, 1975.
