Chairman Young called the meeting to order at 6:30 p.m. In the Council Chambers Town Hail, Los Altos Hills, California. A. ROLL CALL Chairman K. Young, Commissioners D. Proft and T. Schick. Also Present: R. E. Crowe, City Manager; K. R. Pastrof, Town Planner; D. Pennington, Secre. D. Russell, City tary. Chairman Young added an agenda Item: B. CONSENT CALENDAR Approval of the Minutes of the meeting of December 10, 1976. Commissioner Proft moved, seconded by Chairman Young, that the minutes be approved as submitted. The motion passed by the following vote: AYES: Chairman Young and Commissioner Proft. NOES: None ABSTAIN:Commissiner Schick Commissioner Schick asked that the record reflect that she abstained from voting because she was not present at that meeting. B. PUBLIC HEARINGS: LANDS OF SAVIANO. File VAR 70242475 Commfssloner Proft stepped down, and dfd not take part in the discussion because of.a possible c6nflict'of interest. Mr. Pastrof gave a brief synopsis of the Staff Report. He added that the Saviano's engineer had made a mistake in his original calculations and so a revised map had been submitted to the Town on January 12, 1976. This map showed one corner of the tennis court would encroach about 15' into the westerly setback, and about 20' Into the southeasterly setback. It was calculated that 15.2% of the court would be located in the setback area. Chairman Young asked if these changes had been called to the attention of the property miners. Mr. Pastrof advised that the revised map had been available in the Town Hall office for anyone's perusal since Mon- day. Commissioner Schick questioned whether the Commission could be held legally accountable because the revised map was not called to the attroperty r. eproperty ownersrounding were senntpa not ceathat a variance applrof icplied that ati n had the been filed; they were not sent maps. Fie noted that the application stated the property had been walked with the nearest neighbor to the south. He asked if the property had been re -walked with that person using the revised map, and he received a negative reply. Mr. and Mrs. Savlano stated they would like to have at least sixteen feet between the house and the tennis court because they wished to Install a small pool later on in that area. Mr. Wayne Abraham, 12630 Corte Madera, expressed concern that there would be noisy tennis play in the late evening or early morning hours, and that there would be more cutting Into the bank. Mr. Russell advised that all cutting and filling for the tennis courts had been accomplished. Chairman Young closed the Public Hearing. He moved to continue with this Item until 7:20 p.m. Commissioner Schick seconded the motion, which ca rrled. CONDITIONS The Conditions in the Staff Report of January 8, 1976 were read. Chair- man Young suggested, and Commissioner Schick agreed, that certain of the conditions be amended. The amended Conditions are setforth below, with the amendment(s) underlined. 4 1. There shall be no night lighting of the court structure for tennis play purposes other than that which Is required for safety. 4. All fencing for the court shall be of such a design as not to present a walled facade and shall be colored to blend with the surroundings. Chairman Young proposed that an additional condition be Included, and Commissioner Schick concurred: 6. Play shall not take place between the hours of sunset and 9:00 a.m. ACTION Chairman Young moved that the Variance and Permit Commission recommend that the City Council approve the application of the LANDS OF SAVIANO, Variance 7024-75, with the Staff Conditions as amended and added to; and further recommends that the plan, which shows a ten foot distance between the house and the tennis court, be adopted. Corrin issloner Schick asked for guidance on the legality of the Commission making a recommendation when there was at least one Immediate neighbor who had seen the original map, but not the revised one. Mr. Crowe advised that it was up to the Commission to decide whether it wished to have the revised map referred to the neighbors for review and to 4W continue the matter; or to take action without referral. Chairman Young expressed concern that the neighbor who had walked the protio andperty mightwbehthe thinkingginal map that ton lghth theave an Commissioncwasn consideringto the the plan, the original variance application. 2 _ VARIANCE AND PERMIT COWISSION MINUTES - January 14, 1976 LANDS OF SAVIANO - Continued `• RECOMMENDATION TO COUNCIL - MOTION Chairman Young withdrew his original motion, and moved that the follow Ing be adopted: That the application of the LANDS OF SAVIANO, Variance 7024- 75, be continued to the next regularly scheduled meeting of the Variance and Permit Commission, and that the Staff be directed to bring to N. Philbrlck's attention the revised map submitted by the applicant on January 12, 1976. The motion was seconded by Commissioner Schick and passed by the following vote: AYES: Chairman Young and Cormissioner Schick NOES: None ABSTAIN: Commissioner Proft Commissioner Proft resumed his position on the podium. LANDS OF SMITH - Setback Variance to Allow Construction of Swimming Pool. Mr. Pastrof gave a brief synopsis of the Staff Report. He advised that the house was built prior to the Town's requirement for a soils report, so the area may or may not be stable. The City Engineer had found no trace of movement in the lawn, house or wall area. PUBLIC HEARING Chairman Young opened the Public Hearing at 7:40 p.m., and called upon the applicant. Mr. Smith had no objection to the Conditions shown In the Staff Report of January 8, 1976. Speaking on behalf of his parents, the Raymond Andersons, 14423 Miranda Court, the younger Anderson stated that they had some concern about the area's soil stability, but no strong objection to the Town granting this variance. Chairman Young closed the Public Hearing at 7:45 p.m. CONDITIONS The Conditions listed in the Staff Report were read, and the follow Ing actions taken: CONDITION 1 Chairman Young moved, seconded by Commissioner Schick, that Condition 1 of the Staff Report of January 8, 1976 be deleted and that the follow Ing condition be substituted: The registered soil engineer shall examine the site to determine any potential hazard due to slippage and shall submit a report to the City Engineer, as well as a design of the swimming pool structure. The motion passed unanimously. CONDITION 3 Chairman Young moved, seconded by Commissioner Proft, that this condition stand as written. The motion passed on the following vote: AYES: Chairman Young and Commissioner Proft NOES: Commissioner Schick i - 3 - VARIANCE AND PERMIT COMMISSICIJ MINUTES - January 14, 1976 L LANDS OF SMITH - Continued RECOMMENDATION TO COUNCIL - MOTION Commissioner Proft moved, seconded by Chairman Young, that the Variance and Permit Commission recommend to the City Council that it approve the application of the LANDS OF SMITH, Variance 7023-75, with Condition One as amended by this Commission, this date, and Conditions Two and Three as written In the Staff Report of January 8, 1976. The motion passed by the following vote: AYES: Chairman Young and Commissioner Proft NOES: Commissioner Schick LANDS OF SWYRD Staff advised that the applicant's agent had asked for a continuance of this hearing se that he could compile necessary information. MOTION: Commissioner Schick moved, seconded by Commissioner Proft, that the application of LANDS OF SWYRD, BSA 6005-73, be continued to a date which will be determined In the future. The motion passed unanimously. LANDS OF ROSSI Mr. Pastrof explained that the knoll selected for the building site was a State designated Historical Point of Interest. He advised that the State Code specifically says the demolition, and reconstruction of buildings is permitted to be categorically exempt, except those that have historical, archeological, or architectural significance. He asked for an extension of time so that he could consult with State agencies and the City Attorney to ascertain whether an Environmental Impact Report had to be made on this property. Chairman Young recognized Mr. Ray Rossi. He said he objected to the delay but was resigned to it. MOTION: Commissioner Proft moved, seconded by Commissioner Schick, that the application of the LANDS OF ROSSI, BSA 6064-75, be continued to the next regularly scheduled meeting of the Variance and Permit Commission. The motion carried unanimously. C. NEW BUSINESS None D.
