Chairman Qilliam Perkins called the meeting to order at f:45 n.m. in the Council
Ctiamhers, Ton,n Hall, Los Altos Hills, California.
POLL CALL: Chairman Perkins, Commissioners Judith Carico, William Hahn.
Also nresent: Alexander o. Russell, City Engineers. Kenneth R.
Pastrof, Toon planner.
APPPovAL OF "PIHTFS: As Commissioner rarico received hrr informational nacket
late in t".e day, and Commissioner Hahn was not present at
the meeting, it ,!as the Variance and Permit Commission con-

Tan Planner Ken Pastrof reviewed the background of the nronerty location
and the reasons for the Variance reouest, fnc_isinn orimarily on the Steen

Commissioner Carico suggested nerhaps by shifting the l-ckino and doing array

to. He stated that variances should not he recommended for annroval on

Sommissioner Carico asked Staff if the nool could he located else!^here, either
to avoid the need for the Variance, or to lessen the degree of need for the
Variance. Ir. Pastrof resnonded that the lot was rather Steen and Presented
difficulties in siting the nool. Commissioner f.arico expressed concern that
some residents viewed Variances as a mere formality rather than as a burden
on those neonle charmed !aith the responsibility of nrotectinq the residents
and their Properties from indiscriminate nlanninq.

Commissioner Hahn asked .^r. Pastrof if the pmol could he moved, maintaining the

City Engineer Alec nussell pointed that the thirty foot setback arca contained
too -foot contour intervals and not five -fent intervals, and tits the property
rias much steeper than the Variance and Permit Commission envisioned.
!sten asked by Commissioner Perkins if he had any comments to make, the applicant,
Karl Tiefert, replied that he had none other than those that anoeared on his Var-
iance anDI.CatiOn and that he felt the Conditions of annroval were reasonable.
He noted that his engineer reported that according to soil samnles the reguosted
pool site was the safest location.
Commissioner Hahn recommended that the matter be returned to Staff to see if some
other pool site could be found on the nroperty that iouM be acrantahle to "r.
Tiefert and also satisfy the Code requirements, then returned to the Variance
and Permit Commission if a variance vias still necessarv. In the event of a re-
submittal, he reouested that the sethack lines he drawn on the toi:o map, and
Commissioner Perkins sugnested a clearer delineation of the contour lines.

2. LAMS OF RUSSELL, Hillwav, Peguest for Variances to ro,'e renuirements and for
Building Site Anproval.
Toren Planner Ken Pastrof hegan discussion by oivinq review of the background
of the property, located on Hillwav, adjacent to Shoup Park, Los Altos. The
applicant, "1rs. Rose Pussell, was reauesting a Variance to the rode require-
ments pertaining to private raads.
110TIOP!: Commissioner rariro moved that the Variance and Permit Commission
recommend annroval of a Variance to Section 0-4.691(i), Plumber of
Parcels Allowed on Private ponds.

Chairman Perkins asked how the motion addressed thp six requirements for a
Variance. Commissioner Carico stated that the lot was improved already, that
six lots already existed, and only six lots were to exist, that a seventh
lot was not being created. A seventh structure was not being created if
the Planning Commission recommended it he given a Conditional Use Permit as
a secondary dwellinq.

The Building Site Annroval renuest for the LAIMS nF PHSSELL was revie-ed and e-
laborated on by Town Planner Pastrof.
John Riley, Civil Engineer for the annlicant, snsaking from the floor, expressed
'1rs. Russell's wish to enhance her property by buildinn a new primary residence.
Item 46 of the Conditions of Annroval for the RSA stated the renuest of the City
of Los Altos that "lrs. Russell remove one-half of thn concrete bridge that crosses
the creek where the nronerty abuts Shoup Park and the City of Los Altos would re-
move the other half. 'Ir. Riley stated that '9rs. Pussell was agreeable. Commis-
sioner Carico felt it was not the Toy,^Fn's province to enter into this matter, that
it was between 'lrs. Russell and the City of Los Altos.
WITlNI: Commissioner Carico moved that Condition 46 of the Conditions of Appro-
val of a Building Site for LAHpS nF RUSSELL he deleted prior to anv
recommendations beinq mad? to Council.

Mr. Pastrof reported that Staff had been given nnlv one day to consider the Santa
Clara Valley !later District resnonse to Toi-m notification of the Building Site
Annroval annlication. He was directed to take the matter up at, the Staff level
rather than nursue discussion of it at the nresent me�tino.
' Commissioner Perkins asked if Condition �1, renuirien sewer connection for nes
and existing -ruct,wes, was feasible. City Ennineer Russell replied in the af-

The fact that the Santa Clara Va11ev I -later nistrict responded so late, and had

to the Commission and Staff. '^r. Bill Carlson, Division Engineer of the ',later
nistrict, sneaking from the floor, stated that the one hundred year flood water
level of Adobe tree!: prohibited further develonment of the LA,Ins OF RUSSELL, and
the present structures •,ould have to be removed.
