HomeMy WebLinkAbout06/23/1976VARIANCE AND VERMIT COMMISSION Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETIHG Wednesday, June 23, 1976 Reel 52, Side II, Track 1, 153 to 441 Chairman William Hahn called the meeting to order at 6:30 P.M. in the Council Chambers, Town hall, Los Altos Hills, California. ROLL CALL: Chairman Hahn, Vice -Chairman Stewart, Commissioner Rydell. Also present: Kenneth R. Pastrof, Town Planner, Ethel Hopkins, Secretary. City Engineer Alexander Russell arrived at 6:40 p.m.. APPROVAL OF MINUTES: May 12, 1976 and June 9, 1976 Chairman Hahn noted that since the membership of the Variance and Permit Commission had changed, he had contacted former members by letter seekinq their approval of the Minutes of the meetings of April 28, Flay 12 and May 26. He had tl received no response. He noted that he would approve or change minutes by con- sidering them separately. He had been present at the May 12 meeting. MOTION: Chairman Hahn moved, seconded by Vice -Chairman Stewart, for adoption of the May 12, 1976 Minutes. Motion passed with aye votes from all present. Commissioner Rydell requested that on the Minutes of June 9, 1976 he be noted as an excused absence since he had been out of toi.m when the packets were dis- tributed and was unaware that he had automatically replaced Commissioner Schick. MOTION: Vice -Chairman Stewart moved, seconded by Chairman Hahn,to correct the Minutes of June 9 to reflect Commissioner Rydell's absence was an excused absence. Motion passed with aye votes from all Commissioners. KOTION: Chairman Hahn moved, seconded by Vice -Chairman Stewart, to approve the Minutes of June 9, 1976 as amended. Motion passed with aye votes from all Commissioners. PUBLIC HEARINGS: 1. LANDS OF TIEFERT, 10490 Albertsworth Lane, Request for recommendation of approval of Variance to Setback Limitations for Swimming Pool Site Town Planner Ken Pastrof noted that at the meeting of May 26, Staff was 4 instructed by the Commission to look again at the applicant's property to see if Mr. Tiefert's pool could be accommodated with no variance or with a lesser degree of variance than was first requested. LANDS OF TIEFERT (Continued) noted that the topographic map was in error; the ground on this property is much steeper than is indicated on the map. The original soils report on the property, he noted, stated that any structures built on the property be built on virgin soil. Placing the pool on the area designated on the Building Site Approval and marked out at the time of site develop- ment would necessitate increasing the amount of fill the pool would be situated on. Even with the present proposed location, one of the con- ditions is that a soils engineer come out and review the site at the time of excavation; and if the soil is not adequate, a,caissonsor pierswill be placed at the bottom of the pool site. (06 raef,0n made /Ililu Chairman Hahn opened the discussion to the Commissioners. Chairman Stewart wanted it clarified as to how much fill was actually being discussed, and Mr. Pastrof stated that he could not determine exactly how much of the pool would be on fill, but that the closer the pool was to the house, the less amount of fill would be required on the downhill side. Chairman Hahn noted again that;the proposed pool was to be cot'into existing ground with the basic weight of the water on existing ground and not on engineering fill placed when the house was built. He asked the City Engineer if this proposed construction would be adequate, and Mr. Russell agreed that the proposed location and design would be adequate and safe to kow contain the lateral force excerted by the water on the downhill side. There was further discussion on the placement of stairs that already existed on the setback area of the property, and disposal of an existing planter at one end of the proposed pool area. Chairman Hahn then onened the discussion to the public. Mr. Carl Tiefert 10490 Aibertsworth Lane, spoke in favor of granting the variance for is poo s te, not ng that. the proposed location for the pool would be the safest for possible earth movement since it was located in natural around and not in fill area, and that closer to the house than was being proposed would have necessitated a large retaining wall that would have been unsightly as well as expensive. Commissioner Stewart asked Mr. Tiefert if he would have objections to decreasing the variance from 17 feet to 13 feet and to relocating the stairs. Mr. Tiefert said he had no objections. Chairman Hahn closed the public hearing. He called the attention of the Commission to the fact that the neighbors concurred in the granting of the variance. He sought the concurrence of the Commissioners as to whether this request met the six conditions for granting a variance and if an exception should be made in this case. LANDS OF TIEFERT (Continued) MOTION: Commissioner Stewart moved, seconded by Chairman Hahn, that the applica- tion for variance to Section 9-5.504(b)(2) be granted to Lands of Tiefert, File VAR 7027-76, with the conditions as recowtended by Staff, and that the applicant be granted an encroachment into the setback area of thirteen feet rather than seventeen feet as originally requested. Motion passed with aye votes from all Commissioners. OLD BUSINESS: Minutes of April 28 and May 26 Chairman Hahn again determined that the Minutes of the April 28 and May 26 meetings be voted on separately. None of the Commissioners attending the April 28 meeting were present, and no reply had been received requesting any change or noting approval. MOTIOt: It was moved by Chairman Hahn, seconded by Commissioner Rydell, to accept the Minutes of April 28 as submitted. Motion passed with aye votes from all present. Chairman Hahn noted that he was present at the May 26 meeting and had reviewed kw the minutes. NOTION: It was moved by Chairman Hahn, and seconded by Commissioner Stewart, to approve the Minutes of the May 26 meeting. Motion passed with aye votes from all present.
