MINUTES OF A REGULAR MEETING
Wednesday, August 11, 1976

Chairman Hahn called the meeting to order at 7:00 P.M. in the Council Chambers,
Town Hall, Los Altos Hills.
ROLL CALL: Chairman Hahn, Commissioners Stewart and Rydell.
Also present: Kenneth Pastrof, Town Planner; Alexander Russell, Town Engineer;
Ethel Hopkins, Secretary.
CONSENT CALENDAR: Minutes of July 28 Meeting
The Minutes of the July 28 Meeting were corrected by Chairman Hahn as follows:
On page 1, Item No. 1, Lands of Utter-Sensenbrenner, the letters "BSA" should be
added to the second line of the heading. The beginning of line two of the heading
t should read "File #BSA 6072-76.
MOTION: It was moved by Chairman Hahn and seconded by Commissioner Rydell to
approve the Minutes of July 28 as amended by the Variance and Permit
Commission. Motion passed with aye votes from Chairman Hahn and
Commissioner Rydell. Commissioner Stewart abstained because he had been
absent from the July 28 Meeting.

Town Planner Ken Pastrof gave the following background information on the property:
The property has frontage on two roads, Elena and Robleda Roads, with the property
line terminating at Duval and the freeway underpass. Interstate 280 runs adjacent
to the property. The applicant may build one dwellin9,under the present request,
on the 4.30 acre site. The total number of units to be accommodated on the parcel
ap
will be four units when subdivided. The Town is asking that the owner locate
the one dwelling that will be granted with the building site approval so that
it will not be disturbed with later construction. If the owner builds on the
Elena side of the property, one of the conditions asks that he take the Kristie Lane
entrance. If he builds on the lower portion (Robleda) side of the property, the
driveway must be located 240 feet from the freeway because of poor line -of- sight
from Duval.
The pathway request was not included in the staff report because it had not been
received by the time the staff report was written. Pathway request was for a

Type lA Path to run the entire length of the property along Interstate 280, and
a Type 2A Path within the road right-of-way from Elena Road to the Rudolph property
which borders the Hom parcel, and a Type IA path along Robleda opposite Duval Way.
In the discussion period that followed, Commissioner Stewart asked if there was a
path that continued to the corner of Robleda along Elena after the Hom property
terminated on that corner. Mr. Pastrof said that there was a path and that it had
been brushed out several weeks ago. Mr. Stewart also wanted to know if there were
pathways along the fence on the Hansen property which borders the Hom land.
Mr. Pastrof said that the Town was beginning to collect a series of easements to
provide a path. There was further discussion on paths in the area, when and
if they had been acquired, and when the paths on the Hom property would be acquired.
Chairman Hahn opened the meeting to a public hearing.

Commissioner Stewart questioned if the pathway along Elena should also be delayed
until subdivision of the property occurred.
Ms. Fiksdal Pathwa Committee Chairwoman addressed the Commission stating that

to acquire the pathway until the property is subdivided.
Chairman Hahn closed the public hearing, and discussion continued among Commissioners
and Staff as to when would be the best time to acquire the three pathway requests
that it had been decided were needed on the property: the Type 1A path along Inter-
state 280, the 2A path along Elena within the road right-of-way, and the Type IA
path along Robleda along the right-of-way.
MOTION: It was moved by Chairman Hahn and seconded by Commissioner Rydell to add
the following condition as Condition 11 on BSA 6074-76: A ten (10) foot
easement shall be required for a Type IA Pathway along Interstate 280,
a Type IIA Pathway shall be required along Elena within the road right- tA,y
of -way, and a Type IA Path shall be required along Robleda
right-of-way. a) Pathway along Interstate 280 deferred until the final �t nuf�s
inspection of the proposed dwelling; and b) Pathway condition along of
Robleda and Elena to be deferred until future subdivision application. p�zfy;
Motion passed with aye votes from all present.
Ms. Fiksdal Pathwa Committee Chairwoman asked if, because the Robleda and
Elena pa way a een a rred until su division application, would the Pathway
Committee make the request again at that time. Mr. Pastrof stated that the
Committee should make the request again at that time because the subdividing would
require a fresh map and a different action.
MOTION: It was moved by Commissioner Stewart and seconded by Chairman Hahn, to
recommend approval of Lands of Hom, File HBSA6074-76 with Conditions as
amended by the Variance and Permit Commission.
Motion passed by roll call vote where all present voted aye.

MOTION: It was moved by Commissioner Stewart and seconded by Chairman Hahn to
file a categorical exemption under the Environmental Quality Act with
the Santa Clara County Clerk for the Lands of Hom, File #BSA 6074-76.
Motion passed by unanimous roll call vote.
NEW BUSINESS:
Chairman Hahn addressed the Commission with an explanation of an additional
section to be added to the List of Approved Conditions sent by Variance and
Permit and Planning Commission Members to the City Council. Chairman Hahn
noted that this section, Comments from the Commission, would carry specific
Commission recommendations that could not be included as conditions but that
expressed the thoughts of Commissioners relative to the item they were considering.
He particularly referenced the Lands of LaPera where a statement by Commissioner
Perkins was listed as a Condition, but was deleted by Council because it was not
a specific Condition. He stated that such a statement could now be sent to the
Council under the heading "Convents from the Commission."
ADJOURNMENT:
4 There being no further new business or old business, Chairman Hahn adjourned the
meeting at 7:40 P.M..
