MINUTES OF A REr,ULAR MEETING
Wednesday, August 25, 1976

Chairman Hahn called the meeting of the Variance and Permit Commission to order
at 7:03 P.M. in the Town Hall, Los Altos Hills.
ROLL CALL:
Present: Commissioners Stewart, Schick, and Chairman Hahn.
Also present: Town Planner Ken Pastrof, Secretary Ethel Hopkins
APPROVAL OF MINUTES:
Chairman Hahn requested that the following correction be made to the Minutes of
August 11, 1976:
On Page 2, on the Motion to add Condition 11 to BSA 6074-76, on line 5
of the motion, the next to the last word in the line should be changed
to "within". The phrase should read "...and a Type IA Path shall be
required along Robleda within the right-of-way."
MOTION: It was moved by Chairman Hahn and seconded by Commissioner Stewart to
approve the Minutes of August 11, 1976 as amended.
Motion passed with aye votes from Commissioners Stewart and Hahn.
Commissioner Schick abstained.
PUBLIC HEARING,:
1. LANDSOF MANUEL Elena Road, Paul Nowack, Engineer, File #BSA 6075-76. Request
for ecommen an on of Building Site Approval.
Town Planner Pastrof reviewed pertinent information on the Lands of Manuel, most
of which was included in his staff report to the Variance and Permit Commission
of August 19, 1976. He noted that Mr. Manuel is requesting building site approval
to build a single home on approximately ten (10) acres of land. Mr. Manuel's
property had already been discussed in connection with the Elsie Wright subdivision.
Access was to be gained off Elena Road by the 30 foot public right-of-way corridor
received by the Town at the time of the Wright subdivision. Mr. Pastrof called
attention to the applicant's engineering detail for what the property would be
like when subdivided. The dwelling now proposed with the BSA would be on Lot 2
and would be on a knoll that looks toward the freeway and toward the ravine.
He noted that an additional 10 feet of right-of-way for access to Lot 2 would
�r be achieved through the Wright property.

Mr. Pastrof noted that the applicant is contesting Condition 9, specifically the
20 foot right-of-way easement. The applicant is contesting the path request
because it would come extremely close to the first home he is building on Lot 2.
Mr. Pastrof noted the possible links with an equestrian trail on the Elsie
Wright subdivision, and noted that possibly the Lands of Henry would provide
another link -up with the easement being requested. At any rate, the applicant
was asking that paths along the property be delayed until time of actual
subdivision application is made because so many other links must be picked up
to make paths usable.
Discussion followed among Commissioners Schick and Stewart over whether to obtain
a pathway easement that could only be used at a future date, possibly a hypothetical
time since this easement request was based on only the probability that all surround-
ing land is subdividable, or whether to honor the applicant's request and modify
Condition 9 to delete the troublesome 20 foot path easement request.
Chairman Hahn opened the hearing to the public.
Mr. D. H. Walker 1771 Wed ewood Drive San Jose, spoke for the applicant and
against t e oot easement, saying t at t e applicant desires privacy and was
dead set against the removal of trees and the cut or fill necessary to accommodate
a 20 foot easement for a path that would come very close to his home. He stated
440 that this easement was injurious to Mr. Manuel when he would be very willing to
try to accommodate requests for pathways in the future.
Chairman Hahn closed the public hearing.
MOTION: Commissioner Schick moved, seconded by Commissioner Hahn to substitute
the following condition for Condition 9 on BSA 6075-76, Lands of Manuel:
"The pathway requirement shall be a ten (10) foot, Type IA path along
the eastern boundary of the property line along Interstate 280.
a) Improvements to be deferred until other links are obtained."
Motion passed with aye votes from Commissioners Schick and Hahn.
Commissioner Stewart voted against the motion.
Mr. Paul Nowack a lict's engineer, stated that he was in a dilemma because of
on itions an aanFire Department requests afire hydrant before getting
a building permit, and Mr. Nowack stated they can't put the fire hydrant in until
the road was started, which in turn could not be achieved until the permit for
building was obtained. It was noted that there was a fire hydrant near that could
be reached by snap -together 6.inch pipe. Mr. Nowack stated he was requesting
30 days delay on complying with Conditions 5 and 6 until they could net the
road started.
Discussion followed on the Fire Department's request on Condition 5,6 and 8, with
Commissioner Stewart making a motion on deferring Condition 5 and 6 and then
Withdrawing it.
MOTION: It was moved by Commissioner Schick and seconded by Commissioner Stewart
that Condition 8 be deleted, and that Conditions 5 and 6 be deferred
until the Lands of Manuel comes forth for subdivision.
Motion passed with aye votes from all Commissioners present.

MOTION: It was moved by Commissioner Schick and seconded by Commissioner Hahn
that a recommendation of approval be given to Lands of Manuel, File #BSA
6075-76 with Conditions as listed, amended and changed.
Motion passed with aye votes from Commissioners Schick, Stewart and Hahn.
MOTION: It was moved by Commissioner Schick and seconded by Chairman Hahn that
a categorical exemption be filed for the Lands of Manuel, File #BSA 6075-76.
Motion passed with aye votes from all Commissioners.
ADJOURNMENT:
There being no further new or old business, Chairman Hahn adjourned the meeting
at 7:54 P.M..
