MINUTES OF A REGULAR MEETING
Wednesday, September 8, 1976

Chairman Hahn called the meeting of the Planning Commission to order at 8:05 P.M.
in the Council Chambers, Town Hall.
ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Commissioners Carico, Perkins, Rydell, Stewart, Young,. Schick
and Chairman Hahn.
Also present: Town Engineer Alexander Russell, Secretary Ethel Hopkins
CONSENT CALENDAR:
There were no Minutes for consideration. Commissioner Perkins, addressing himself
to the remaining item on the Consent Calendar, Lands of Bahl, File #TM 2041-76,
asked if this tentative map application did in fact comply with existing ordinances.
Town Engineer Russell stated that if Lands of Bahl did not comply with existing
ordinances, it would not have been presented.
MOTION: It was moved by Commissioner Schick and seconded by Commissioner Carico
to accept the application for Tentative Map for Lands of Bahl, File
#TM 2041-76.
Motion passed with aye votes from all present.
PUBLIC HEARING:
1, LANDS OF CASSARA, Voorhees Drive, Paul Nowack, Engineer, Request for Recommendation
o pprova o entative Map, File #TM 2038-76. (Continued from Meeting of
August 25, 1976.)
Chairman Hahn listed the items of information the Commission should have before them
on Lands of Cassara: The Planner's Staff report, memorandum from the City Engineer
dated August 31, 1976, a draft of the August 25 Planning Commission Minutes, a copy
of the September 8 memorandum from the City Attorney, and a copy of Mr. Paul Nowack's
letter agreeing to a time extension on Lands of Cassara.
Chairman Hahn stated that he had spent considerable time researching Parcel Map
File #PM 273-M44 and talking with the City Manager. He felt that he needed more
time to consider the information he had reviewed as well as the City Attorney's
memorandum. He stated his wish to extend discussion to the September 22 meeting,
but stated that the matter would have to be presented to the City Council to ask
Q for an extension of time on the matter.
�r Discussion followed among Commissioners with Commissioner Perkins stating that he
felt the issues on the Lands of Cassara needed to be clarified. Commissioner Schick
stated that no one had contacted Mrs. Voorhees on Voorhees Drive, and that Voorhees
Drive was the hang-up on the matter.

Town Engineer Russell asked that Commissioner Perkins enumerate the questions
he wanted answered on this property.
Mr. Paul Nowack En ineer for thea licant, reiterated that everyone on Voorhees

delivered his opinion when he wrote his letter agreeing to a time extension,
and stating that Voorhees Drive was in excellent condition. The property, he
stated, was a simple issue except for theprivate road; and the Commission
would have lots of opportunity to consider this issue again. He would not
oppose granting more time, but would appreciate the Commission going ahead on
the matter.
MOTION: It was moved by Commissioner Hahn and seconded by Commissioner Schick
to postpone Lands of Cassara, File HTM 2038-76, until September 22.
Motion passed by the following aye votes: Commissioners Perkins, Rydell,
Schick, and Chairman Hahn.
No votes were cast by Commissioners Carico, Young and Stewart.
Commissioner Perkins voiced concern that an important segment of the community
was being dealt with with ordinances that were totally inadequate to do the work.
`y MOTION SECONDED AND FAILED: It was moved by Commissioner Perkins and seconded
by Commissioner Carica that the Commission address itself to a discussion
of this particular subdivision to a study session which would last not more
than one hour.
Motion failed by the following vote:
AYES: Commissioners Carico and Perkins
NOES: Commissioners Rydell, Stewart, Young, Schick and Hahn.
Discussion on the Lands of Cassara was concluded by the City Engineer reminding
the Commission that they will be required to make a decision on September 22,
and again asking whet specific questions the Commissioners wanted clarified.
None were forthcoming. Mr. Hahn stated that he hoped staff would review the
Lands of Cassara in the light of the City Attorney's memorandum. He thanked
Mr. Cassara and Engineer Paul Nowack and ended the discussion.
OLD BUSINESS:
Commissioner Hahn raised for discussion the August 25 Memorandum sent by Commissioner
Perkins to the City Council requesting immediate changes in the slope density require-
ments in Ordinance 232. He stated that he was informed that the change would have
to go through the regular process of changing an ordinance. He noted that an
Ad Hoc Committee had been formed to study the problem of slope
density.
4 Commissioner Perkins again stressed the need for a change in the slope density
requirements on Ordinance 232. He denied that the Ad Hoc Committee would consider
this particular issue and stated again that the need for the change he requested
was urgent.

OLD BUSINESS: (Continued)
Engineer Russell stated that the Ad Hoc Committee was charged with a task of
answering two questions: 1) Should the ordinance (232) state that every lot
within a subdivision be within the minimum lot area requirement; and 2) should
we revise the ordinance in such a way so that every lot within the subdivision
shall comply with the slope density requirement for every lot.
Commissioner Carico stated that she was bothered by the private road issues
in Ordinance 232. Chairman Hahn finished the discussion and moved on to
further old business.
Commissioner Schick stated she felt the City Manager should be present since
the Town Planner is no longer available. Mr. Russell stated that Mr. Crowe
had gone home ill.
MOTION: It was moved by Commissioner Schick and seconded by Commissioner Carico
that the Planning Commission go on record that the City Manager should
attend the Planning Commission meetings.
Motion passed by unanimous vote.
NEW BUSINESS:
Chairman Hahn again raised the issue of Ordinance 232. When should a study
session be held? After discussion, it was concluded that Commissioner Schick's
suggestion that each member study the ordinance, write down the points he
questions and suggestions for their solution, and submit them in writing to
Chairman Hahn, would be the procedure followed. Chairman Hahn would then schedule
a study session.
ADJOURNMENT:
Discussion was concluded, and Chairman Hahn adjourned the meeting at 9:15 P.M..
