ROLL CALL: Present: Commissioners Carico, Young and Rydell. Also Present: Town Engineer Alexander Russell, Secretary Ethel Hopkins APPROVAL OF MINUTES: Minutes of August 25 and September 8, 1976 Commissioner Rydell stated that the approval of the August 25 Minutes would be suspended until the Commissioners who attended the meeting could be contacted for their approval. `, MOTION SECONDED AND CARRIED: It was moved by Commissioner Carico and seconded by Commissioner Rydell to approve the Minutes of September 8, 1976. Motion passed by the following vote: AYES: Commissioners Rydell and Carico NOES: None ABSTAIN: Commissioner Young abstained because he had not been present at the meeting of September 8th. ELECTION OF OFFICERS: It was explained that the chairmanship and vice -chairmanship of the Variance and Permit Commission was based on a rotational system with the chairmanship going to whoever had served longest on the Commission serving as chairman and next as vice-chairman. NOTION SECONDED AND CARRIED: It was moved by Commissioner Young and seconded by Commissioner Carico to nominate Commissioner Rydell as Chairman and Commissioner Carico as Vice -Chairman of the Variance and Permit Commission. Motion passed with all Commissioners present voting affirmatively. PUBLIC HEARING: 1. LANDSOF ANAYA, File #BSA 6077-76, Intersection of Olive Tree Lane and B andor Way, G en D. Hagey, Engineer, Request for Recommendation of Building t Site Approval. v Town Engineer Russell addressed the Commission regarding the subject property, noting that the parcel had been created more than ten years ago. LANDS OF ANAYA:(Continued) site approval was being requested in order to build a residence. He noted that the property is steep and that several of the conditions on the BSA took note of that steepness. Commissioner Carico asked if Mr. Cotton, the Town Geologist had recommended the foundation referred to in the conditions. Mr. Russell stated that Mr. Cotton had determined what should be in the soils report, but that the specific items on the foundation design had been determined by staff. Commissioner Rydell opened the hearing to the public. Joe An a 214 Ponce Street Belmont, Applicant stated that he was in the process o o to Flog a so s report. At Commissioner Young's suggestion that a soils engineer design the foundation for the lot, Mr. Russell stated that a soils engineer need not design the founda- tion for the lot, but should set forth the criteria for the foundation. Commissioner Rydell asked, referring to Condition 7(a) of the staff report, asked if this type of condition had been in previous BSA's. Mr. Russell stated t that it had been required in problem lots or steep lots. Commissioner Rydell � W closed the public hearing. MOTION SECONDED AND CARRIED: It was moved by Commissioner Young and seconded by Commissioner Carico to recommend approval of the Lands of Anaya, File #BSA 6077-76 with Conditions as set forth in the City Engineer's Memorandum dated October 6, 1976. Motion passed with all Commissioners present voting for the motion. 14DTION SECONDED AND CARRIED: It was moved by Commissioner Carico and seconded by Commissioner Rydell to file a categorical exemption for the Lands of Anaya, File #6077-76, with the Santa Clara County Clerk. Motion passed with all Commissioners present voting affirmatively. 2. LANDS OF JOHNSON, File #BSA6073-76, Lot 5, Tract 1947, Canario Way, Paul E. NowRkI ssoNates, Inc., Engineer, Request for Recommendation of Approval of Building Site Approval. Engineer Russell noted that the parcel under discussion was located at the north end of Canario Way and Viscaino Drive above the Little League Park. He noted that the parcel was steep but that it had contour intervals rather than being precipitous. He noted that water tended to course along one side, noting that he had discussed this with the engineer. The concern was how to take care of the water ways and the septic tank drainfield. It was finally concluded that an underground drain line would be established. He noted that the driveway would be difficult to install, noting that it would be relatively steep and must come up and cross the proposed house location. He referred the matter of Lands of Johnson to the Commission for comment and discussion. MINUTES OF THE VARIANCE AND PERMIT COMMISSION - October 13, 1976 Page Three PUBLIC HEARING: (Continued) 2. LANDS OF JOHNSON: (Continued) Chairman Rydell opened the meeting to a public hearing after a few brief remarks concerning the history of the property and questions on whether the neighbors had commented on drainage. Up to this point they had not was the reply given to Mrs. Carico's question on this. Claire Lewis 12723 Can ario Wa addressed the Commission, stating that she had no -.o Jections to t e ui rng p ons for the lot under discussion, but wanted to stress the problems they had had with drainage. She stated that two drains had been installed on either end of her property to take care of water runoff from storms, but that they tended to get filled up with mud and overflow. She noted that she had a wide stream of water running across her property. Engineer Russell concurred with Mrs. Lewis' statement of her problem with water. He stated, however, that one of the main causes for the water runoff had been poor maintenance in the past. He noted that maintenance is much improved in the present but couldn't state that this would not reoccur in the future. The only way to alleviate the problem is connecting with the storm drain to the creek that parallels Purissima, and this would be expensive. Both Commissioners Young and Carico expressed concern on how to handle this 6W problem so as not to create further flooding on the Lewis property. Lero Peters Develo er for the A licant noted that the 15 inch pipe that was to a insTa e on t e an s o o ER was an adequate system to control the water runoff and meet future needs. He spoke against further measures, noting that if he had known that his lot was picking up all -the water runoff, it would have made development of the property prohibitive. He questioned the necessity and effectiveness of further measures to protect against water runoff. Commissioner Carico still felt that measures needed to be taken to mitigate against water overflow from storms. Commissioner Young concurred in her judgement on this. Commissioner Carico questioned further if there were any pathway re- quests but received the reply from Mr. Russell that there were none. Commissioner Rydell closed the public hearing. MOTION SECONDED AND CARRIED: It was moved by Commissioner Carico and seconded by Commissioner Young to add as Condition 10 on the List of Conditions for BSA 6073-76, Lands of Johnson, the following condition: A catch basin shall be installed on the private driveway immediately adjacent to the southerly boundary line of the lot to intercept all the surface water flowing on the property and that the catch basin be connected either to the existing storm drain on Canario Way or to the 15 inch line required to be installed within the private land. All present voted in favor of the Motion. L MOTION SECONDED AND CARRIED: It was moved by Commissioner Carico and seconded `r by Commissioner Young to recommend approval of the Lands of Johnson, File #BSA 6073-76, with Conditions as amended by the Variance and Permit Commission. LANDS OF JOHNSON: (Continued) MOTION SECONDED AND CARRIED: It was moved by Conmissioner Young and seconded by Commissioner Carico to file a notice of a categorical exemption with the Santa Clara County Clerk for the Lands of Johnson, File 06073-76. All Commissioners present voted affirmatively for this motion. 3. LANDS OF McREYNOLDS, 26045 Moody Road, File #VAR. 7034-76, John Riley, Englneer, Request for Recommendation of Approval of Variance from Setback Regulations. Town Engineer Russell began the discussion of the subject variance with noting that the structure under discussion was shown as a garage on the map by Mr. Bromfield that was before the Commission. The map was dated 1932. The structure was constructed prior to the time that setback requirement were made a part of the building ordinance of the county. Mr. Russell noted that a variance was being requested by the applicant so that he could add on to his house to make it a more desirable place to live in. He noted the problems of the property, that it was elevated from bordering properties, or that other properties were raised sharply above it. The subject house needing modification was built in 1913 or 1914. Commissioner Rydell opened the meeting to the public. Mr. MCReymo�ldssAApplicant noted the problems that made this variance request a necessi y`t�e no; a 5e problems of tight living conditions that a variance to build on to his present house would alleviate. He requested that Commission act affirmatively on his request. Commissioner Young asked if the State Historical Society had been interested in his property, and if any problems would be created by approving this. Mr. McReynolds stated that no problems would arise from this variance approval. Commissioner Rydell closed the public hearing. MOTION SECONDED AND CARRIED: It was moved by Commissioner Carico and seconded by Commissioner Young to recommend approval of the Variance request for Lands of McReynolds, File #VAR.7034-76. The Commission had found that the appli- cant had effectively addressed the six conditions for the variance request approval in Section 9-5.1107 of the Municipal Code. All present voted for the Motion. ADJOURNMENT: There being no further old business or new business, Chairman Rydell adjourned the meeting at 7:40 P.M..
