MINUTES OF A REGULAR MEETING,
Wednesday, November 10, 1976

Vice -Chairman Carico called the meeting to order at 7:05 P.M. in the Council
Chambers of Town Hall.
ROLL CALL:
Present: Commissioners Carico and Young.
Absent: Commissioner Perkins
Also Present: City Manager Crowe, City Planner/Engineer John Markl, Secretary
Ethel Hopkins
APPROVAL OF MINUTES: Minutes of October 27, 1976
MOTION SECONDED AND CARRIED: It was moved by Commissioner Young and seconded

rr by Commissioner Carico to approve the Minutes of the October 27 meeting of the
Variance and Permit Commission.
Motion passed by the consensus of the Commissioners present.
ELECTION OF OFFICERS:
MOTION SECONDED AND CARRIED: It was moved by Commissioner Youna and seconded
by Commissioner Carico that Commissioner Carico be elected Chairman of the
Variance and Permit Commission and that he himself be elected as Vice -Chairman.
Motion passed by the consensus of the Commissioners.
PUBLIC HEARING:
1. LANDS OF HARRIS, File #VAR. 7008-74, 12243 Tepa Way, Vaughn Shahinian &
Associates, Engineers, Request for Recommendation of Approval for Approval
for Variance for Tennis Court. (Continued from the meeting of October 27.)
Before making the motion for recommendation for approval of the variance, Commissioner
Young noted that this application for a variance was made some two years ago and
at that time was refused because of problems with creek flooding. Since that time,
remedial measures have been taken on this problem.
I MOTION SECONDED AND CARRIED: It was moved by Commissioner Young and seconded by
Commissioner Carico to recommend approval of the variance request for the Lands
of Harris, File #VAR. 7008-74 subject to the conditions of the City Engineer's
memorandum dated November 3, 1976.
Motion passed with the approval of both Commissioners present.

Commissioner Young stated that in justification of granting this variance, that
although the Harris property is considerably larger than most in the Town,it is
subject to an easement taken by the Federal Flood Control District and it would
be a hardship on the applicant if this variance should be denied. It in no way
follows, however, that variances will be granted indiscriminately in the future.
Commissioner Carico questioned the applicants, Dr. and Mrs. Harris, regarding
Condition 4 on the list of conditions. After reading the condition aloud, she
assured the applicant that according to discussion at the previous meeting, no
more than two or three trees would be needed for appropriate landscaping, asking
if the Harrises had any objections to this condition.

NEW BUSINESS:
Chairman Carico introduced Mr. John Markl, the new City Planner/Engineer and
expressed the Commission's welcome to him as a member of the Town Staff.

at 7:13 P.M..
