HomeMy WebLinkAbout01/24/1979VARIANCE & PERMIT COMMISSION 44r Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, January 24, 1979 Reel 76, Tr. 1, Side 1, 001 to 245 Chairman Stewart called the meeting of the Variance & Permit Commission to order at 6:35 PM in the Council Chambers of Town Hall. ROLL CALL: Present: Commissioners Stewart, Lachenbruch and Dochnahl (substituting for Commissioner Kuranoff). Staff: City Engineer/Planner John Carlson and Deputy City Clerk, Susan Buttler. APPROVAL OF MINUTES: MOTION SECONDED AND CARRIED: Moved by Commissioner Dochnahl, seconded by Commissioner Stewart and passed by the following roll call vote to approve the Minutes of October 11, 1978. AYES: Commissioners Dochnahl and Stewart. NOES: None. ABSTAIN: Commissioner Lachenbruch. PUBLIC HEARINGS: 1. LANDS OF MA, File BSA #6104-77, Page Mill Road, Paul Nowack & Associates, Engineers, Request for Recommendation of Approval of Building Site Approval. Mr. Carlson provided a brief introduction and advised of a ten foot pathway dedication surround- ing the property. Commissioners discussed with the City Engineer the path dedication as pro- vided within the property line, the corner dedication being made to the Town to smooth the curve and the necessity for collecting road -in -lieu fees when the only public right-of-way involved is outside the Town limits. Mr. Naegle, Applicant's Fngineer, stated that the corner dedication had been requested by Staff. Mrs. Gottlieb, Chairman/Pathway Comni_ttee, advised of the reasoning for the 10' pathway request separate from tihe rig of -way as a safety precaution due to vehicular hazards of this area. Commissioners then addressed the connection this path provided and their desire not to infringe on the property owner while safely maintaining a separation from the travelled way as well as the Town's inability to require a path easement on the County owned right-of-way. PASSED BY CONSENSUS: To delete Condition 7 (b) Road -in -lieu fee of $2,268.42 due to the fact that this that does not abut a public street within Los Altos Hills. MOTION SECONDED AND CARRIED: Moved by Commissioner Dochnahl, seconded by Commissioner Lachenbru, an carried unanimous y to recommend approval of LANDS OF MA, File BSA #6104-77, subject to i/.ie conditions as amended. LANDS OF LOVE, File BSA #6103-77, Hilltop Drive, Paul Nowack & Associates, Engineers, Request for Recommendation of Approval of Building Site Approval. The City Engineer detailed the complexities of this request, citing the earlier Council decision approving two lots and necessitating the Site Approval now befox the Commission. Commissioners questioned the legal processes that had occurred, right -of --Way dimension errors on the map, noise/visual impacts from the freeway, drainage problems, the close proximity of an earthquake fault and access problems to the subject site. Mrs. Love, Applicant, advised of the many months spent determining the legality of the lot and her feeling that the previous Council action had resolved the questions now being posed. Commissioner Lachenbruch answered that, due to the problems listed above and with severe constraints resulting from proposed over -development, further review of the Council's position with advice from the City Attorney as to restrictions that might be placed for mitigation were needed before any further Commission action. PASSED BY CONSENSUS: To continue the LANDS OF LOVE, File BSA #6103-77 for further review and recommendations from the City Attorney, and to schedule consideration before the full Planning Commission at their next meeting of February 14, 1979. 40D BUSINESS: None.
