ROLL CALL: off and Stewart Present: Commissioners Carico, Lachenbruch, Rydell, vanTamelen, Kuran Absent: Commissioner Dochnahl rt Crowe, City Engineer/Planner John Carlson, Also Present: City Secretary Etheler Hopkins CONSENT Items removed from the Consent Calendar were: 1) Lands of f January File #TM 2099-79, Tentative Map to be Accepted for Filing, and 2) Minutes of January 24 and February 14. ewart MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved ni g itemsonthetConsentnd seconded by CommissiorerLachenbruch to approve the remaining Calendar, namely, the Minutes of the Adjourned Planning Commission meeting of January 31 and the Minutes of the Joint Planning Commission -City Council meeting of January 31. The Minutes of January 24 were corrected as follows: Page 2, item 1. Lands of second motion Steers, File #Tf4 2087-78: The Minutes should reflect that Commissioner Lachenbruch mo stepped down as a Commissioner on the discussion on this item. Page 2, from the bottom, delete the parenthetical "(Commissioner Lachenbruch abstaining)'; and on page 3, delete Commissioner Lachenbruch's name from the "Motion Seconded on page 2, change and Failed" items. It should be noted that Commissioner Lachenbruch did not vote on the Lands of Steers motions for the reason cited above. Also, the word "side" to 'wide' in the third line of the third motion from the bottom of the page. LANDS OF ARASTRA LIMITED PARTNERSHIP, File #FM 3068-78: (continued) Joe Louis Louis & Diederich Eng ineering 480 North First_ Street, San Jose, dis- cussed the improvement plans for the above development. Commissioners discussed with Mr. Louis their feelings concerning the inadequate compliance on his part of conditions required on the tentative map checklist, specifically Conditions 1(b) and (c) and Condition 3. Commissioner Lachenbruch requested that native species of trees and plants be used for the proposed landscaping and that he receive a copy of the final soils report for review. Commissioner Stewart requested that Mr. Carlson work with the project engineer regarding the type of curb and gutters used in the subdivision; he specifically asked that the rolled -Hillsborough -type curbs and gutters be used if possible. MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart, seconded by Commissioner van Tamelen and passed by unanimous roll call vote to continue the request for Planning Commission approval of driveway plans for the Lands of Arastra Limited Partnership, File #FM 3068-78. Mr. Carlson requested clarification on the kind of landscaping plan desired by the Commissioners, and it was the consensus that what was desired was a plan similar to that presented by the Lands of Hightower for the landscaping of O'Keefe Lane. Commissioners also instructed Mr. Louis to consult with former Town Planner L John Markl if necessary to gain a more thorough understanding of the specifics ta/ needed to complete the conditions of the tentative map approval. 2. LANDS OF STAMSCHROR-SILUER, File #CU 8029-78, 25231 LaRena Lane, Report on Compliance with Conditions of Use Permit for Secondary Dwelling: Mr. Crowe discussed with Commissioners the compliance of applicants Stamschror and Silver with conditions of their use permit. He also related that an agree- ment had been negotiated with these applicants regarding their compliance with the conditions of the use permit. Commissioners questioned whether the applicants had adequately complied with Conditions 1(a), (b), and (e), and Conditions 2, 4, and 5; and whether the compliance with legislated conditions was -a matter that was negotiable between the applicant and the Town. Commissioners were particularly concerned that the 220 volt wiring had not been totally removed. Neither had the driveway been totally removed and landscaped as requested by the conditions. They requested that proof be given as to a recorded covenant (Condition 4), that any information on whatever brief was filed with the court be supplied to the Planning Commission, as well as copies of any agreement worked out between the applicants, the City Manager and/or the City Attorney and the applicants' attorney. A question was also raised as to whether the City Attorney or staff could change the conditions of the use permit, and whether the present use permit could be revoked. `y The matter of the compliance with conditions of the Stamschror-Silver use permit was continued to the second meeting in March or the first meeting in April so that all appropriate information could be supplied to the Planning Commission. At 9:00 p.m. a recess was called. The meeting resumed at 9:10 p.m. PLANNING COMMISSION MINUTES - February 28, 1979 Page three 4W OLD BUSINESS: 3. LANDS OF LARRY DAWSON, File #Tht 2094-78, HMI Inc., Engineers, Review of Geo ogic Features and Set acks from Fault Zones as Requested by City Council Commissioner Stewart explained that the subject subdivision had been referred back to the Planning Commission by the City Council so that a review of the geologic conditions, which somehow had been overlooked at the time of the tentative map discussion, could be accomplished. Eccles, Terratech, Inc., 326 Commercial Street San Uose, discussed the Dennisocation an importance to t e su division of the various geological features on the Lands of Dawson. Michael Kern, Re ist2red geologist, assisted Mr. Eccles in the discussion of the geo ogica ea tures on t e property by reviewing the mapping of the fault trace. Bill Cotton Town Geologist, discussed his review of the geological report prepared by Terratech and the recommendations made. Commissioner Lachenbruch requested that geological reports by Mr. Cotton be included in the material received by the Planning Commission. tJen StrofaDawsoutcontinued9onRtheeadjacentda Road glandsoofdTracyher Courte fault trace on the Lands In response to Mrs. Struthers'question, Mr. Carlson noted that the fault trace had been shown on the tentative map and on the site development plan. Commissioner Stewart requested that this information be checked and confirmed at the next Planning Commission meeting, also that Mrs. Struthers be informed on this matter. Discussion having been concluded, it was proposed by Commissioner Stewart and the consensus of the Commissioners that the following memo be sent to the City Council: The Planning Commission, after discussion with Town Geologist William Cotton and the developer's Soil Engineer Dennis Eccles at their meeting of Febru- ary 28, stated they were satisfied that the tentative map for the Lands of Dawson, File #TM 2094-78, is accurate, that the Monta Vista fault lines are sufficiently defined, that the shadowed blue areas are the boundaries of the setback, and that the Franciscan sheer zone is accurately shown. Buildings are to be placed outside these areas. Condition 2(e) of the list of conditions for the Lands of Dawson adequately addresses the geologic conditions of the site. 4. Commission Assignments for Recommended Action Items: Commissioner Stewart asked that committee chairpersons for action items provide a report as soon as possible on when they estimate their work can be completed. He asked that they also include with their report any request on professional help or staff help that will be needed to complete the assignment. PUBLIC HEARINGS: 1. LANDS OF HOM, File #TM 2084-78: (continued) MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and seconded by Commissioner vanTamelen to continue the Lands of Hon, File #TM 2084-78. NEW BUSINESS: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and seconded by Commissioner vanTamelen to set the date of the public hearing for the above item for the meeting of March 28, 1979. 2. Setting of Dates of Public Hearing for the Meeting of March 14: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and seconded by Commissioner vanTamelen to set the date of March 14 for public hearings on the followinq items: Planning Commission Hearings: LANDS#OF CU CALIFORRNIA WATER SERVICE, FilLANDS OF HILLESTAD, File #2095-79 (Items for the March 14th meeting of the Variance and Permit Commission were determined at the meeting of February 14.) . .. . _ r..••...;i Mcorion of March 21: Commissioner uaricu will ,=N�=�=�� ••� •- --- on meeting of the City Council. 4. Planning Commission Packet Information: Planning Commissioners discussed with Mr. Carlson ther iwishes to have the file backup information included with the staff report and conditions sent to them in the Planning Commission packets. Generally they commended Mr. Carlson on his efforts to reduce the size and amount of duplication needed to prepare staff reports. However, it was the express desire of the Planning Commissioners to have provided them slope density forms for sub- divisions, the geologic reports from Mr. Cotton, and significant letters from the Health and Fire Departments. 5. Tennis Court Liohting Ordinance: Mr. Carlson reviewed for Commissioners his proposal for an ordinance on tennis court lighting. Commissioners discussed the ordinance proposal with specific comments made concerning the restrictive nature of the proposal, that the question of lighting really concerned the intensity of the light in question, and that security lighting should be shielded and the intensity greatly diminished as it neared the property line. Commissioner Stewart suggested that the matter of tennis court lighting could be handled by a variance. Mr. Carlson was asked to take into consideration the kw comments made and revise the ordinance proposal accordingly. Slope Density Information for Subdivision Committee Meetings: Commissioner Lachenbruch requested that he be provided slope density information for the Subdivision Committee meetings on preliminary and tentative maps. 7. Citv Council Reng Representatives at PlanniCommission Meetings: Commissioner Lachenbruch proposed that a City Council member attend the Planning Commission meetings so as to be better informed about Planning Commission matters generally. Discussion on this centered on the fact that this had been discussed several times at joint meetings with the City Council and the City Council had not felt the need for such attendance or did not want to be biased with previous discussion when considering recommendations of the Planning Commission. Commissioner Stewart stated that he would write a memo to the City Council requesting that a Council representative attend Planning Commission meetings.
