MINUTES OF A REGULAR MEETING
Wednesday, March 14, 1979

The meeting of the Planning Commission was called to order at 7:50 p.m. by
Chairman Stewart in the Council Chambers of the Town Hall.
ROLL CALL:
Present: Commissioners Lachenbruch, Rydell, vanTamelen, Dochnahl, Chairman Stewart
Absent: Commissioners Carico and Kuranoff. (Both absences were excused absences.)
Also Present: City Manager Robert Crowe, City Engineer/Planner John Carlson,
Secretary Ethel Hopkins
CONSENT CALENDAR:
The Minutes of February 28 were corrected as follows: Page four, add to the end
of the motion to continue Lands of Hom,"because of insufficient information for
the staff reQort." Also on Page four, Item 4 under "New 8 sines;" remove the
comma after ..the Also
reports from Mr. Cotton..." an � add and from any
consultants that might be on the subdivision.'
MOTION SECONDED AND CARRIED: It was moved by Chairman Stewart and seconded by
Commissioner Rydell to approve the Minutes of February 28 as amended. All
Commissioners voted for the motion except Commissioner Dochnahl who abstained
because of his absence from the February 28th meeting.
OLD BUSINESS:
1, LANDS OF PARNAS CORPORATION (formerly Lands of Arastra Ltd. Partnership) File
#FM 3068-78, Page Mill Road, Louis & Di ederich, Emmneer, Request for Planning
Commission Approval of Improvement Plans
Joe Louis, Louis & Diederich, 480 North First Street, San Jose, discussed his
reasons for incomplete plans and asked that Commissioners give partial consent
to the proposed improvement plans. More information would be supplied at a
later date as the work progressed.
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Chairman Stewart and
seconded by Commissioner Lachenbruch to continue the Lands of Parnas Corporation,
File NFM 3068-78,until the engineer conforms to all the requirements of the con-
ditions of the tentative map approval, including complete mitigating drawings for
the swale.
Chairman Stewart asked that the Town Geologist, the Soils Engineer, and also the
Town Engineer provide a written response to the mitigating drawings for the swale
area, and that this reponse be submitted to the Planning Commission for their
approval and recommendation. Technical arguments were to be dealt with by staff.

Other matters to be completed before Planning Commission review of the subject
request were: (1) Town Geologist review and comment on all supplementary soils
and geological reports, and (2) Environmental Design Committee review and comment
on the landscape plans. Responses on these items wereto be included in the in-
formation presented to the Commission when this matter is next discussed.
PUBLIC HEARINGS:
1. LANDS OF CALIFORNIA WATER SERVICE, File #CU 8032-79, Eastbrook/Magdalena,
Request for RecommeR—ation of Approval of Negative Declaration and Conditional
Use Permit for Water Pumping Station
John Carlson discussed the subject request as detailed in his staff report for the
March 14th meeting. Thereafter, the hearing was opened to the public.

MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Dochnahl and
seconded by Commissioner Rydell to recommend approval of the Negative Declaration
for the above request.
4W Commission discussion continued on whether a pathway should be requested on the
pumping station site and how it should be located, given the forty foot public utility
easement along the freeway side of the property.

Paul Nowack, Paul Nowack and Associates, Los Altos, discussed ways of accommodating
tR—eproposed pathway.
Commissioners began a review of the conditions for the request, and the following
changes were made:
Condition 2.A: PASSED BY CONSENSUS: To amend Condition 2.A to read: Landscaping
screenino shall be provided within and along the perimeter of the
entire parcel, excluding the public utility easement. A landscape
plan, prepared by a landscape architect, shall be reviewed and
approved by the Environmental Design and Site Development Committees.
Condition 3.1, PASSED BY CONSENSUS: To add Condition 3.1: This Conditional Use
#40 Permit shall conform to any restrictions of the Williamson Act.
Condition 3.J: MOTION SECONDED AND PASSED UNANIMOUSLY: To add the following as

easterly property line and along the Interstate 280 property line.
MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by Commissioner Dochnahl
and seconded by Commissioner Lachenbruch to recommend approval of the Lands of
California Water Service, File #CU 8032-79 with conditions as amended.
2. LANDS OF HILLESTAD, File #TM 2095-79, Chaparral Road, Paul Nowack & Associates, Inc.,
2 Lots, Request for [Fe—comendation of Approval of Negative Declaration and Tentative
Map
Mr. Carlson presented the Negative Declaration on the above request for Planning
Commission review. Commissioners noted the need for screening on cut slopes, and
the need for a thorough consideration of the drainage from the Lands of Hillestad
and the adjoining Lands of Horton. Thereafterthe hearing was opened to the public.
Paul Nowack, Engineer, discussed the drainage patterns for the Lands of Horton
anT HTTTe s—t—ad _,_a_nU recommended that the solution to the drainage problems in the
area be worked out to the satisfaction of the City Engineer.
MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by Commissioner vanTamelen
,W and seconded by Commissioner Dochnahl to recommend approval of the Negative Declara-
tion for the Lands of Hillestad, File #TM 2095-79, with the following mitigating
measures:
1. Storm drainage improvements to carry water from Chaparral Way
ta Moody Road.
2. Landscaping for erosion control.
3. Landscaping for screening of artificial slopes.
Mr. Carlson continued review of the above request as detail�,d in his staff report
dated March 8, noting that the parcel under discussion has building iite Approval
to build one residence. The request before the Commission was to subdivide the
parcel into two lots.
Extensive discussion among Commissioners centered on the need for a traffic
circulation study for Chaparral Way, a drainage study to encompass the drainage
area of the Lands of Hillestad and Horton, the need for reconciling the plans
approved for the installation of the driveway on the Lands of H(Y�iixi�ne
driveway actually installed, the problems of erosion on bend areas of the driveway,
and the stability and slope of the driveway. The hearing was opened to the public
discussion.

given Lands of Horton, asked also for an easement on the Lands of Horton to carry
storm drainage waters to the central swale, and questioned the need for a circulation

Don Hillestad, Owner, discussed the reasons for the variation in plans and the
aitgel r0oa construction, and stated that his geologist had vouched for the adequacy

MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Chairman Stewart and
seconded by Commissioner Dochnahl to continue the Lands of Hillestad, File
#TM 2095-79, until circulation and drainage plans are completed and staff
recommendations are available on the matter.
After the passage of the motion, Commissioners asked that the following information
also be addressed: 1) the adequacy of the road itself; 2) how the road came to
be built and under what standards; 3) why the Site Development Committee did not
review the plans for the road; 4) the slope of the driveway; 5) whether the
hairpin turn in the driveway has a 40 foot radius; 6) why grading had been done
for a driveway for Lot 2 of the subdivision when it had not been authorized by
the building site approval plans; 7) the 1977 circulation study requested by the
City Council in 1977; and finally, 8) why the road had not been built to the
approved plan of the BSA. It was suggested that these items be listed in a letter
to the developer for his response. The Developer was also to get together with
the City Engineer to discuss the conservation easement on the parcel.
Paul Nowack, noted that the sewer had been left on an optional basis, and asked
tTFat so—me space be left for a gazebo in the flat area where the open space is
proposed. He also suggested that a storm drainage easement be requested on the
Lands of Horton to carry water to the swale area. It was recommended by the
Commission that Mr. Nowack discuss these matters with the Town Engineer.
The public hearing was closed, and a recess was called. The meeting resumed
at 10:10.

Commissioner Lachenbruch felt that some landscape lighting should be allowed;
Commissioner vanlamelen felt that landscape lighting should be allowed, i.e.,
if no draperies were used and lightinq illuminated the landscapinc. Consensus was
that Commissioners should write out their comments on the proposed ordinance
and submit them to the Planning Secretary for distribution before the meeting
of the 28th. The secretary was directed to write each Commissioner before the
next meeting to remind them to turn in their comments.

concern expressed in Item 2 of the report, and that the Secretary send a copy
of the report to Walt Gregorwich for his review.
