MINUTES OF A REGULAR MEETING
Wednesday March 28, 1979

Acting Chairman vanTamelen called the meeting of the Variance and Permit Commission
to order in the Council Chambers of Town Hall at 7:00 p.m.
ROLL CALL:
Present: Commissioners Kuranoff, Dochnahl and vanTamelen
Absent: Commissioner Lachenbruch
Also Present: City Engineer/Planner John Carlson, Secretary Ethel Hopkins
APPROVAL OF MINUTES:
The Minutes of the March 14th meeting were corrected as follows: The motion on
page two under Lands of Faroudja should read 'Motion Seconded and Carried:
Vote: AYES: Commissioners vanTamelen and Kuranoff, NOES: Commissioner Lachen-
�, bruch, ABSTAIN: None.' There being no further corrections to the Minutes,
Chairman vanTamelen declared the Minutes of March 14 approved as amended.
PUBLIC HEARINGS:
1. LANDS OF JAISWAL, File #VAR. 7057-79, 13571 Hill Way, Request for Recommendation
of Approval for Variance in Setback to Construct a Garage (Continued at the
request fo the applicant to the meeting of April 11)
2, LANDS OF SNEDIGAR, File #BSA 6112-79, Fremont Avenue, Civil and Construction
Consultants, Inc., Engineers, Request for Recommendation of Approval of
Building Site Approval Request
Mr. Carlson presented pertinent information to the above request as detailed in
his staff report of March 28. Thereafter the hearing was opened to the public
discussion.
Gordon Snedi ar,71348 Churton Avenue, Los Altos, discussed the disposition of
t e present ome on t e property, the size of the proposed new dwelling, location
of the access and driveway, removal of trees, the fees charged on the list of
conditions, and finally, requested that the Building Site Approval request be
approved so that he would not be delayed with work on the property.
Commissioner Kuranoff noted the need for more information from the applicant
on his request to move the present building from the property, as well as a legal
interpretation from the City Attorney on Section 8-5.03 of the Municipal Code,
LL specifically, whether a variance was required of the applicant to move a building.
46r' Thereafter the public hearing was closed, and the following motions passed:
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner vanTamelen
and seconded by Commissioner Kuranoff to add as Condition 5: Prior to the

final building site approval, the Owner/Applicant shall obtain a permit to either
remove the existing structure from the site or demolish it.
The Variance and Permit Commission discussed with the applicant the reasons for
charging fees on the Building Site Approval. It was noted that the original
subdivision, Tract 281, had occured before the incorporation of the Town, and
no fees had been charged. Commissioner vanTamelen suggested that the applicant
address his request for the deletion of the fees to the City Council. She also
requested that this information be sent on to the City Council in the form of
"Comments from the Comnission."
MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by Commissioner Dochnahl
and seconded by Commissioner Kuranoff to recommend approval of the Lands of
Snedigar, File #BSA 6112-79, with conditions as amended.
The applicant was instructed by the Commission to work with staff on the request
for a permit to move the existing building on the property. John Carlson promised
to obtain, in writing from the City Attorney, clarification on the ordinances per-
taining to the moving of buildings.
C OLD BUSINESS:
It was determined that Commissioner vanTamelen would respond to the Council re-
quest for six statements from the Commission on why the variance should be granted
to the Lands of Faroudja, File #VAR.7056-79, and that these statements would be
provided before the mailing for the next City Council meeting.
ADJOURNMENT:
There being no further new or old business, the meeting of the Variance and
Permit Commission was adjourned by Chairman vanTamelen at 7:35 p.m.
