RECOMMENDATION: That the Planning Commission:
Approve the requested Site Development Permit, subject to the recommended conditions
in Attachment 1.
BACKGROUND
The subject property is a 2.54 acre parcel located on the south side of Old Trace Lane.
Surrounding uses include single-family residences on adjacent parcels to the west, south,
and east and across Old Trace Lane to the north. Existing development on the property
includes a main residence, detached garage, pool and pool house. The applicant is
proposing to construct a 60' W x 115' L tennis court south of the main residence.
CODE REQUIREMENTS
As required by Sections 10-2.301 and 10-2.1306 of the Site Development Ordinance, this
application for a tennis court has been forwarded to the Planning Commission for review
and approval. The Zoning and Site Development sections of the Municipal Code are
used to evaluate the tennis court including development area limitations, grading,
drainage, height, setbacks, and visibility.

The tennis court will be located 30' from the property lines and the proposed development
area will be below the Maximum Development Area (MDA) allowed for the property.
Visibilitv
Section 10-1.507 of the Los Altos Hills Municipal Code allows outdoor athletic court
fencing to be a maximum of 10'. The applicant is proposing a 10' tall black vinyl coated
chainlink fence at the north and south ends of the court and a 4' tall fence along the east
and west sides to minimize view impacts to the adjacent neighbors.
Pursuant to Section 10-2.901 of the Los Altos Hills Municipal Code, "Recreation courts
shall be landscaped and screened so as to be unobtrusive from off-site". The applicant
has provided a landscape screening plan showing plantings around all four sides of the
fence to create a layer of hedges and trees for screening. Seven (7) pine trees are
proposed to be removed and one (1) 12" heritage oak tree is proposed to be relocated to
accommodate the construction of the tennis court.
The adjacent neighbor at 27076 Fremont Road has submitted an email requesting that
additional screening be provided at the north end of the tennis court. (Attachment 2) To
help screen the tennis court from the adjacent neighbor's views, the applicant is
proposing to transplant the 12" heritage oak to the north end of the tennis court to fill in
the space between the 48" and 14" eucalyptus trees.

Grading & Drainage
Total grading quantities include 195 cubic yards of cut and 100 cubic yards of fill. The
Engineering Department has reviewed the proposed grading and concluded that it is in
conformance with the Town's grading policy.
Pursuant to Section 10-2.503, Drainage Facilities Standards, of the Municipal Code, the
Engineering Department has determined that the proposed drainage design complies with
Town requirements. Water runoff generated from the tennis court will be carried to a 124'
L x 21" D slotted pipe along the west edge of the court. The drainage system then meters
the outflow to a 46' L x 4" D pipe and releases the water into a detention basin north of
the tennis court.
Outdoor Lighting
Pursuant to Section 10-2.1002 of the Site Development Code, "no artificial lighting is
permitted for tennis and other recreation courts." No outdoor lighting is proposed for this
project.
Committee Review
The Environmental Design Committee has reviewed the proposal and recommends
replanting of vegetation to mitigate view and privacy impacts to surrounding neighbors.
CEOA STATUS
The project is categorically exempt under Class 3 of the State CEQA Guidelines

RECOMMENDED CONDITIONS
FOR SITE DEVELOPMENT PERMIT FOR A TENNIS COURT
LANDS OF SINDHU & BERTRAND, 27060 OLD TRACE LANE

A. PLANNING DEPARTMENT:
1. No other modifications to the approved plans are allowed except as
otherwise first reviewed and approved by the Planning Director or the
Planning Commission, depending on the scope of the changes.
2. No new outdoor lighting is approved. Pursuant to Section 10-2.1002 of
the Los Altos Hills Municipal Code, no tennis court lighting is allowed.
3. No portions of the tennis court shall encroach within the property line
setbacks.
4. No grading shall occur within 10' of the property lines.
5. The existing 12" oak tree shall be replanted between the 48" and 14"
eucalyptus trees on the west side of the tennis court to screen the tennis
court from the adjacent neighbor at 27076 Fremont Road.
6. Additional landscaping may be required. Staff will visit the site prior to
final inspection to determine if any additional plantings will be needed for
screening or to restore areas disturbed by grading or construction. All
landscaping required for screening purposes or for erosion control (as
determined by the City Engineer) must be installed prior to final
inspection.
7. A landscape maintenance deposit (or certificate of deposit) in the amount
of $5,000 shall be posted prior to final inspection. An inspection of the
landscape to ensure adequate establishment and maintenance shall be
made two years after the installation. The deposit will be released at that
time if the plantings remain viable.
8. Prior to beginning any grading operation, all significant trees are to be
fenced at the drip line. The fencing shall be of a material and structure
(chain-link) to clearly delineate the drip line. Town staff must inspect the

fencing and the trees to be fenced prior to commencement of grading. The
property owner shall call for said inspection at least three days in advance
of the inspection. The fence must remain throughout the course of
construction. No storage of equipment, vehicles or debris shall be allowed
within the drip lines of these trees. Existing perimeter plantings shall be
fenced and retained throughout the entire construction period.
B. ENGINEERING DEPARTMENT:
9. Peak discharge at 27060 Old Trace lane, as a result of Site Development
Permit 175-04, shall not exceed the existing pre -development peak
discharge value of the property. Detention storage must be incorporated
into the project to reduce the predicted peak discharge to the pre -
development value. Provide the data and peak discharge hydrologic
model(s) utilized, as well as, the calculations of the peak discharge value
prior and post development. Determine the design peak runoff rate for a
10 -year return period storm and provide detention storage design plans to
reduce the predicted peak discharge to the pre -development value. All
documentation, calculations, and detention storage design (2 plan copies)
shall be submitted for review and approval to the satisfaction of the City
Engineer prior to acceptance of plans for building plan check. Prior to
final inspection, a letter shall be submitted from the project engineer
stating that the detention storage design improvements and site grading
were constructed as shown on the approved plans.
10. Any, and all, changes to the approved grading and drainage plan shall first
be approved by the Town Engineering Department. No grading shall take
place during the grading moratorium (November 1 and April 1) except
with prior approval from the City Engineer. No grading shall take place
within ten feet of any property line.
11. The location and elevation of the tennis court shall be certified in writing
by a registered civil engineer or licensed land surveyor as being in/at the
approved location and elevation shown on the approved Site Development
plan prior to final inspection.
12. The property owner shall inform the Town of any damage and shall repair
any damage caused by the construction of the project to pathways, private
driveways, and public and private roadways, prior to final project
approval and shall provide the Town with photographs of the existing
conditions of the roadways and pathways prior to acceptance of plans for
building plan check

13. Any, and all, areas on the project site that have the native material
disturbed shall be protected for erosion control during the rainy season and
shall be replanted prior to final inspection.
CONDITION NUMBERS 9 AND 12 SHALL BE COMPLETED AND SIGNED
OFF BY THE PLANNING AND ENGINEERING DEPARTMENTS PRIOR TO
ACCEPTANCE OF CONSTRUCTION PLANS FOR PLAN CHECK BY THE
BUILDING DEPARTMENT.
Project approval may be appealed if done so in writing within 23 days of the date of this
notice. The building permit cannot be issued until the appeal period has lapsed. The
applicant may submit construction plans to the Building Department after March 19, 2005
provided the applicant has completed all conditions of approval required prior to
acceptance of plans for building plan check.
Upon completion of construction, a final inspection shall be set with the Planning
Department and Engineering Department at least two weeks prior to final building
inspection approval.
NOTE: The Site Development permit is valid for one year from the approval date (until
February 24, 2006). All required building permits must be obtained within that year and
work on items not requiring a building permit shall be commenced within one year and
completed within two years.

Thank you for viewing the site today. Would you mind asking the Sindhus to screen between the 48 " Eucalyptus and 14"
Eucalyptus on the northside of the tennis court. This would help mitigate the ten foot fence from our view. A tree or bush
that grows at least ten feet would be ideal.
