MINUTES OF A REGULAR MEETING
Wednesday, April 11, 1979

The meetino of the Variance and Permit Commission was called to order by
Acting Chairman Michael Kuranoff at 7:17 p.m.
ROLL CALL:
Present: Commissioners Rydell, Dochnahl and Kuranoff
Absent: None
Also Present: City Enaineer/Planner John Carlson, Secretary Ethel Hopkins
APPROVAL OF MINUTES:
MOTION SECONDED AND CARRIED: On the motion of Commissioner Dochnahl seconded by
Commissioner Kuranoff, the Minutes of March 28 were approved as submitted.

PUBLIC HEARINGS:
1. LANDS OF JAISWAL, File #VAR. 7057-79, 13571 Hill Way, Request for Recommendation
of Approval of Request for Variance in Setback to Construct a Garage (Continued
to April 25)
2. LANDS OF OLIVER, File #VAR. 7047-77, 25466 Adobe Lane, Oakley & Associates,
Enaineers, Request for Recommendation of Approval for Variance for Tennis Court
Mr. Carlson discussed with Commissioners pertinent information on the above request
as detailed in his staff report of April 11. Commissioners questioned on how much
of the lot area was covered by impervious surfaces, and thereafter the hearing was
opened to the public discussion.
Dick Oliver, 25466 Adobe Lane, Applicant, discussed whether the old private easement
s ou d be included in calcu atina the aross area of his lot, the use of this old
easement over the years he has lived on the property, the cost of having the easement
abandoned, the fact that neighbors support his request for a variance to build a
tennis court, called attention to his adjacent neighbor's letter supporting his
request for a variance, his desire to correct a long-standing drainage problem in
the area if the variance for the tennis court were granted, noted that all his
neighbors supported his request and that many of them had similar problems on their
lots, and finally, noted that he had adequately addressed the six conditions for the
%W granting of the variance. He requested that the Commission recommend approval of his
variance.

Don Hull, 25445 Adobe Lane, spoke for the approval of the request for a variance,
noting t at it wou d be a welcome addition to the recreation area for the neighbor-
hood to have an additional tennis court. He stated further that none of the neighbors
objected to this request for a variance to build a tennis court.
The public hearing was closed and discussion returned to the Commission. Commission-
er Rydell asked about the drainage problem but was told by Mr. Carlson that it was
a private matter that could be dealt with at the time of site development. Other
comments concerned the fact that the property under discussion was of an odd shape
and the aranting of this variance could set an undesirable precedent because so
much of the court would be in the setback area. A motion to recommend the granting
of the variance died for lack of a second.
MOTION SECONDED AND CARRIED: It was moved by Commissioner Dochnahl and seconded
by Commissioner Kuranoff to recommend denial of the request for variance for the
Lands of Oliver, File #VAR. 7047-77.
AYES: Commissioners Dochnahl and Kuranoff
NOES: Commissioner Rydell
ABSTAIN: None
After the passage of the motion, Mr. Oliver requested that he be able to go to
the Planning Commission with this request. The request was granted.
ADJOURNMENT:
There being no new or old business, the meetina of the Variance and Permit Commission
was adjourned by Commissioner Kuranoff at 7:55 p.m.
