PLANNING COMMISSION Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, May 23, 1979 Reel 78, Side II,Tr. 2, 900 to End; Side I, Tr.l. 001 to 321 Chairwoman vanTamelen called the meeting of the Planning Commission to order at 7:50 p.m. in the Council Chambers of Town Hall. ROLL CALL: Present: Commissioners Stewart, Carico, Lachenbruch, Rydell, Dochnahl, Kuranoff, Chairman vanTamelen Absent: None Also Present: City Manager Robert Crowe, City Engineer/Planner John Carlson, Secretary Ethel Hopkins Press: Judy J. Miller, Peninsula Times -Tribune ADDRESS BY MAYOR McREYNOLDS: Mayor McReynolds addressed the Planning Commission and commended the Commission on its vital efforts and work on behalf of the Town. He noted that the Town, as a result of the passage of Proposition 13 and the fact that the Town and surrounding valley area were almost full, was in a period of transition. He stated that he would o welcome ideas from the Planning Commission and City Council on constructive ways of dealing with these challenges. APPROVAL OF MINUTES: The Minutes of May 9 were corrected as follows: 1) On page 3, last sentence before the Lands of Chu public hearing, change the time of the meeting resumption to 9:53 p.m.; 2) On page 5, second paragraph under New Business, Item #2, change the first sentence of the paragraph to read: Commissioner Lachenbruch suggested that Commissioners, at the time of site development, require for the Lands of Love that the combined structural coverage not exceed 15%, and the combined impermeable surface not exceed 40% of the net acreage in the two adjacent substandard parcels owned by Love; and 3) Under the "Election of Officers", page 5, third line, first paragraph, change "...seconded by Commissioner vanTamelen..." to 'seconded by Commissioner Stewart...'. Chairman vanTamelen declared the Minutes of May 23 approved as amended. PUBLIC HEARINGS: 1. LANDS OF TRYON, File #CU 8034-79: (continued) Mr. Carlson reviewed background information on the above request as detailed in his staff report for the meeting of May 23. He reminded the Commissioners that with the passage of Ordinance 246 access to secondary dwellings and the residential dwelling must be from the same driveway and that a condition should be added to the checklist to assure this on the Lands of Tryon Use Permit. City Manager Crowe noted that the structure under consideration pre -dated the incorporation of the Town, and that if more than 50% of the building were remodeled a variance would have to be applied for to permit the intrusion of the building into the setback area. He added that the Planning Commission's desire to request a conditional exception for the building's intrusion into the setback would signify that it had been recognized by the Commission as a problem. Commissioners asked questions on the removal of the existing driveway off Robeleda Road; the removal of the gas line and 220 volt electrical outlet; how kitchen facilities could be controlled; when the remodelling of the structure would take place; what buildings would be preserved and what structures would be removed; and finally, how access to the secondary dwelling would be obtained through a con- servation easement area. The hearing was opened to the public discussion. BarbaraTryon, Applicant, responded to Commissioners' questions on access, the oval remof the apartment and the garage, vehicular access off Robleda, pathway c access to the secondary dwelling, the location of the water heater, and the use of the structure as a guest house. The public hearing was closed, and a review of the conditions was begun, with the following amendments and changes made: Condition 1: MOTION SECONDED AND CARRIED: To add to Condition 1 the following sentence: A11 kitchen plumbing, kitchen sink, and cabinets shall be removed. AYES: Commissioners Stewart, Carico, Rydell and vanTamelen NOES: Commissioners Lachenbruch, Dochnahl and Kuranoff ABSTAIN: None Conditions 4 and 5: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Kuranoff and seconded by Commissioner Carico to add the following two conditions: Condition 4: Access to the secondary dwelling shall be limited to a pathway between the primary and secondary dwelling. Condition 5: There shall be no vehicular access to the property from RObleda, and the existing driveway from Robleda shall be removed. Condition 6: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Carico and seconded by Commissioner Lachenbruch to add as Condition 6: The apartment situated on the southwest portion of the property shall be removed. tw Condition 7: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Lachenbruch and seconded by Commissioner Rydell to add as Condition 7: PLANNING COMMISSION MINUTES - May 23, 1979 Page three PUBLIC HEARINGS: (continued) 2. LANDS OF TRYON, File #CU 8034-79: (continued) Condition 7: (continued) A conditional exception shall be granted for a seven foot (7') encroachment into the setback from Robleda, and a three foot (3') encroachment into the sideline setback for the secondary dwelling. Condition 8: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Comnissioner Carico and seconded by Commissioner Stewart to add as Condition 8: This conditional use permit shall be recorded. MOTION SECONDED AND LOST: It was moved be Commissioner Stewart and seconded by Commissioner Rydell to add as a condition: The Planning Commission shall review the final remodelling plans before the building report is issued. AYES: Commissioners Stewart, Rydell and vanTamelen NOES: Commissioners Carico, Lachenbruch, Dochnahl and Kuranoff ABSTAIN: None MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and seconded by Commissioner Dochnahl that the Lands of Tryon, File #CU 8034-79 be recommended for approval with conditions as amended by the Planning Commission. 3. USE PERMIT FOR THE ADOBE CREEK, File #CU 8035-79, Moody Road, Paul Nowack and Associates, Inc., Engineers, Request for Recommendation of Approval of Conditional Use Permit City Manager Robert Crowe discussed the application before the Commission, noting that the request before the Commissioners was for a new use permit for the Adobe Creek property and that applicants were present to answer any questions the Commissioners might have. Mr. Crowe advised that the request be continued so that a completed staff report might be available with appropriate conditions and recommendations. Staff at that time was still evaluating recently submitted information. Commissioners asked about the various sections outlined on the use permit map. Applicants stated that these various sections represented different uses proposed in each of the areas sectioned off. Commissioners asked that each use be fully explained and that the map be modified to reflect the open space conservation area on the steeper land of the property, accurate contours of the land, and the amounts of acreage and owners' names for adjacent properties. The hearing was opened to the public discussion. Anthony La orio, Attorney for the A plicant, 300 Third Street, Los Altos, discussed background on the request for the use permit, noting t at by-laws modeled on the use permit with the Fremont Hills Country Club would be used for The Adobe Creek by-laws, introduced Ron Washington who would be responsible for the daily operation of the club, discussed the terms of ownership of the facility, and responded to questions from Commissioners. Ron Wash ina_ton, Minnea alis, Minnesota, referred Commissioners to the applicants' submission dated May outlining the proposals for use of The Adobe Creek property, reviewed his background and qualifications for managing a recreational club, discussed the various kinds of membership that would be offered, discussed the various uses for the areas marked out by dark lines on the map, and areas and numbers of club employees who would be living on the property. USE PERMIT FOR THE ADOBE CREEK, File #CU 8035-79: (continued) Mr. Crowe noted that the followina information was needed before conditions could be drawn up: 1. Staff housing, who would be utilizing staff housing and how many - this information was needed in writing by the Town. 2. Are there different utilizations of different areas - will the club be private or common? 3. Ingress -egress easement - why is it necessary? 4. The Pathway Committee wants some method of getting to the top of the hill - how would this be handled? 5. Overall intensity of use for the property. 6. What type of facilities are planned and what will be the maximum number of people on the property at any given time? What will be the timing for activities, i.e., picnic grounds, etc., wants to have things spelled out clearly, also what outside activities or other planned events will be scheduled? 7. Tennis programs - what and how often would major regional, national and celebrity events be planned? 8. Paddle tennis - where would paddle tennis be played and when? Paul Nowack, En ineer for the A licant, 220 State Street, Los Altos, reiterated that there was no intention on t e part of the app icants to subdivide the property, and that areas set apart by the dashed lines were the different use areas. He added that the ingress -egress easement was no longer necessary. Warner Remmen, A licant, discussed facilities available to members who joined the c ub and reminded t e Commission that they, the applicants, were under a time limit to obtain a use permit for their proposed use and purchase of the property. Commissioners asked that the allocation of the acreage on the map be clearly stated; that the proprietary aspect of club memberships be addressed, what do club members own and not own and who owns the other sections of the property and who collects fees for use of the different club areas. Commissioner Lachenbruch requested that before the next meeting a distinct clarification be provided on the status of the various portions of the property known as The Adobe Creek, clarification on how the use permit will function and how it is related to the separate sections of land outlined by the map, and that the City Attorney render an opinion on how interest can be sold on non-subdividable land. He also requested a complete map with proper swale and land divisions showing the two legally separate parcels that comprise The Adobe Creek land. Commissioner Carico asked about any conditional exceptions that might have to be requested for separate residences on the property and whether the applicant would have to come back for further consideration for different areas to be added to the use permit. She was told by Mr. Crowe that the use permit would function like the Fremont Hills Country Club permit, where there would be modifications of the use permit for any new section added. USE PERMIT FOR THE ADOBE CREEK, File #CU 8035-79: (continued) MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by Commissioner Dochnahl and seconded by Commissioner Carico that the staff and the applicant work out a set of conditions, articles of incorporation and by-laws, and all necessary maps and documents for the next meeting of the Plannina Commission on June 12 at 7:45 p.m. (an adjourned meeting). OLD BUSINESS: Commissioner Rydell discussed the status of his work on the Tennis Court Control Subcommittee. NEW BUSINESS: 1. Setting of Dates for Public Hearings for the Variance and Permit and Planning Commission Meetings on June 13, 1979: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Carico and seconded by Commissioner Kuranoff that the following items be set for public hearing on June 13: Variance and Permit Commission: Lands of Ramey, File #VAR. 7061-79 Planning Commission: 1. Abandonment of Easement, Lot 2, Tract 5762 2. Abandonment and Relocation of Easement, 26989 Beaver Lane 3. Lands of Hom, File #TM 2084-78, Resubmitted Tentative Map 4. Lands of Johnson, File #TM 2098-78 5. Lands of Binder, File #VAR. 7055-78 2. Re ort from the Cit Council Meet in of May 16: Commissioner Rydell stated that as t e P ann ng Comm ssion items for t e May 6th meeting had been continued by applicant request, he would be the Cornission representative at the June 6th meeting and would speak to the tennis court variances being appealed as well as to the other items of business from the Planning Commission. Schedules for Planning Commission Committee Work for 1979-80: Chairman vanTamelen polled Commissioners on the desirability of two month assignments on the Site Development and Subdivision Committees, and it was the consensus that this would be a problem to the working members of the Planning Commission. The suggestion was made by Commissioner Stewart that a staff member take minutes at these Committee meetings and provide a file summary so that if a Site Develop- ment or Subdivision Committee matter must be considered further at the Committee level and the Commissioner who was assigned to the first meeting is not the Commissioner for the second meeting, notes and background would be available. It was suggested that Commissioners provide notes and submit them to the Planning Secretary for typing for the file.
