MINUTES OF A REGULAR MEETING
Wednesday, June 27, 1979

The meeting of the Variance and Permit Commission was called to order by Chairman Rydell
at 6:35 p.m. in the Council Chambers of the Town Hall.
ROLL CALL:
Present: Commissioners Dochnahl, Carico and Rydell
Absent: None
Also Present: City Planner/Engineer John Carlson, Secretary Ethel Hopkins
APPROVAL OF MINUTES:
Minutes o 'Ma
23, 1979: The following corrections were made in the May 23rd Minutes:
On page t reek item one, Lands of Binder, correct the first sentence after the colon
to read: 'Although Commissioner vanTamelen felt that the lot was not of an unusual
size or shape, the other Commissioners agreed that ..... (the rest of the sentence
remains as written.) Correct the second sentence of the first paragraph after the
six items addressed on page three to read: 'Commissioner Dochnahl stated that he
could agree with all the conditions ..... (the rest of the sentence remains as written.)
MOTION SECONDED AND CARRIED: The Minutes of May 23 were approved as corrected on
the motion of Commissioner Dochnahl seconded by Commissioner Rydell.
AYES: Commissioners Rydell and Dochnahl
NOES: None
ABSTAIN: Commissioner Carico
Minutes of June 13, 1979: MOTION SECONDED AND CARRIED: On the motion of Commissioner
Carico, seconded by Commissioner Dochnahl, the Minutes of June 13 were approved as
submitted.
AYES: Conmissioners Carico and Dochnahl

ABSTAIN: Commissioner Rydell
PUBLIC HEARINGS:
1. LANDS OF GLOSS, Files SA 6100-77, SA 6101-77, SA 6102-77, Ravensbury Avenue,
Paul Nowack and Associates, Inc., Engineers, Request for Site Approval of
Three Adjacent Lots:
Mr. Carlson discussed the background and recommendations made on the above requests,
the oroblems with the lots on meeting. slope density requirements, 160 foot circle
requirements, and Health Department standards in conflict with Staff recommendations
on the location of dwellings. Mr. Carlson added that the City Attorney was reviewing
Town ordinances and staff recommendations to determine whether staff interpretation
of recently enacted ordinances was correct. Lastly, Mr. Carlson recommended that inasmuch
Commissioners had had difficulty in findinq the sites, the applicant's engineer should
stake out the properties so that they could be easily located in the future, and that the
item should be continued until all matters had been worked out.

Commissioners noted their difficulties in locating and determining the boundaries of
the property. It was suggested also that the requests be heard by the full Planning
Commission. Thereafter, the hearing was opened to the public discussion.
Paul Nowac k, Engineer, 220 State Street, Los Altos, suggested that the requests for
Tite appro;t prk ed recent ordinance c anges and that therefore they should be
exempt from those requirements. He noted that the Health Department had approved
all sites as they were being proposed, that the house on SA 6100-77 could be moved
downhill as was suggested and still get the leachfield in, but that the filling
of the creek area was not a problem as a horse stable was located upstream. On the
problem of flooding during the rainy season, Mr. Nowack stated that this was caused
by a plugged culvert.
Mrs. Closs, Applicant, stated that she was not going to build houses immediately,
but that she was trying to extend site approval another ten years. She asked about
staff's suggestion on moving the proposed location of the house on SA 6100.77 to a lower
elevation.
Paul Nowack requested that the staff report for SA 6101-77 be changed by deleting the
lastparagraph as this was not the reason the lots had been combined. He asked that
instead the report reflect that "Lots 2 and 3 of the original subdivision had been
1 combined only at the request of Mrs. Closs to provide a better homesite."
Mr. Carlson agreed to consider Mr. Nowack's suggestion, the public hearing was closed,
and the Commission passed the following motion:
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Carico and
seconded by Commissioner Dochnahl that Lands of Closs, Files SA 6100-77, SA 6101-77,
and SA 6102-77,be considered as soon as possible by the full Planning Commission,
that a field trip be scheduled to review the property, and that the City Attorney
provide his ruling on the ordinances and this property before the field trip occurs.
NEW BUSINESS:
Commissioner Dochnahl, as a result of his great difficulty in finding the Lands of
Closs, suggested that unless the area to be discussed is simple and easy to find,
Commissioners should not be sent maps until the area is staked out and easily located.
ADJOURNMENT:
There being no further new or old business, the meeting of the Variance and Permit
Commission was adjourned by Chairman Rydell at 6:58 p.m.
