HomeMy WebLinkAbout12/12/1979VARIANCE AND PERMIT COMMISSION v Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, December 12, 1979 Reel 82, Side 2, Tr. 2, 120 to 199 Chairman vanTamelen called the meeting to order in the Council Chambers of the Town Hall at 7:10 p.m. ROLL CALL: Present: Commissioners Dochnahl and vanTamelen Absent: Commissioner Carica Also Present: Assistant Planner Pat Webb, Secretary Ethel Hopkins APPROVAL OF MINUTES: On the motion of Commissioner Dochnahl, seconded by Commissioner vanTamelen, it was declared that the Minutes of the meeting of September 26 be approved as sub- mitted. 4W PUBLIC HEARINGS: 1. LANDS OF BJORKLUND, File #VAR. 7064-79, 12874 Normandy Lane, Request for Recommendation of Approval of Variance in Setback for Dwelling Assistant Planner Pat Webb discussed the subject request as detailed in her staff report dated December 7, noting that since variances are a tool to deal with land use issues, it was important to approve a previous violation of the setback area that occurred when the dwelling was constructed. The applicant's requestwas for a variance so that he might add a second story to the portion of the dwelling that exists in the setback area of the property. After Commissioner Dochnahl's question on how the dwelling had been built in viola- tion of the setback requirement, the hearing was opened to the public discussion. Pete Bi orkl und, 1075 Los Altos Avenue, Los Altos, noted that a fence had been con- structed on t e property wit no reference to t e proper boundary lines. He discussed with the Commission the history of the property and the fact that he wished to add an to the dwelling which he had recently purchased. He stated that all the neighbors were in favor of his request for a variance, stated that his plans for the addition were essentially like those presented with the variance request, and that a variance would not be needed for a pool. The public hearing was closed, and the following motion passed: MOTION SECONDED AND PASSED UNANIMOUSLY APPROVED: It was moved by Commissioner Dochnahl and seconded by Commissioner vanTamelen to recommend approval of the 7.31 foot encroachment into the side yard setback area for the construction of a second floor on the dwelling, such variance to include a pre-existing encroachment into the setback area which occurred at the time of the construction of the dwellina. The variance for the Lands of Bjorklund, File #VAR. 7064-79, meets the six conditions for the granting of a variance AAas specified in the staff report for the December 12th meeting.
