MINUTES OF A REGULAR MEETING
Wednesday, February 11, 1981

The meeting of the Variance and Permit Commission was called to order by
Chairman Kuranoff at 7:00 p.m. in the Council Chambers of the Town Hall.
A. ROLL CALL:
Present: Commissioners Carico, Docbnahl, Kuranoff
Absent: None
Also Present: Assistant Planner Pat Webb; Secretary Leslie Penfold
B. PUBLIC HEARINGS:
1. Lands of Ramirez, File #VAR 10-80, 14123 Tracy Court, Request for
recommendation of Approval for Variance for a Swimming Pool with an
eight foot encroachment into the rear setback.
Ms. Webb referred to her staff report dated February 6, 1981, indicating
L that this variance is a re -submittal by the applicant, after being heard
�r at the January 14, 1981 Variance and Permit Commission meeting, (the
request was denied without prejudice for a fourteen foot encroachment).
The new plan places the pool in the rear yard with an eight foot (8')
encroachment. Staff recommends approval of this variance request.
The Public Hearing was then opened.
Mr. Alan Shedroff, Admiral Pools, indicated the pool site is located so
as not to be a nuisance to the adjoining neighbors, of the Town and the
City of Palo Alto. There are large trees on the property that would be
sufficient for screening from off-site. Mr. Shedroff urged that this
variance be granted.
Mr. Burmeister, 14066 Tracy Court, spoke in favor of the granting of this
variance.
Commissioners were concerned with the adjacent lands of Palo Alto, (Lands
of Arastra), and the type of development that would occur and when.
Mr. Michael Stewart, 13456 Mandoli Drive, indicated that he had read re-
cently that the Lands of Arastra was possibly going to build high density
housing, (cluster housing).
The Public Hearing was then closed.
Commissioner Carico indicated that just recently, the Variance and Permit
Commission granted approval for a swimming pool variance that was adjacent
to the Lands of Palo Alto, (very similar situation), and felt this variance
should be granted as per staff's recommendation as it relates to the six (6)
criteria for a variance.

�1/ Commissioner Kuranoff noted that, 1) creek and easements are not to be used
as grounds for variances, as indicated in the Tentative Map Conditions; 2)
that he felt the granting of this variance would constrain the lot with too
much development.
Mr. Shedroff, indicated that the pool could be placed elsewhere on the property,
but the owners surveillance of the pool would be poor, further indicating that
the pool could be placed where the solar panels would be located, but then the
solar panels would be placed elsewhere on the property with not as much efficiency
Mrs. Burmeister, 14066 Tracy Court, spoke in favor of this variance request.
MOTION SECONDED AND FAILED: It was moved by Commissioner Carico and seconded
by Commissioner Dochnahl to recommend approval of the Lands of Ramirez, File
#VAR 10-80.
VOTE: AYES: Commissioner Carico
NOES: Commissioners Dochnahl and Kuranoff
Commissioners discussed the Variance further.
MOTION SECONDED AND PASSED BY THE FOLLOWING VOTE: It was moved by Commissioner
Dochnahl and seconded by Commissioner Kuranoff to deny without prejudice the
Lands of Ramirez, File #VAR 10-80.
VOTE: AYES: Commissioners Dochnahl and Kuranoff
NOES: Commissioner Carico
The applicant was informed they could appeal this decision, within ten (10) days
in writing.
There being no further new or old business, the meeting was adjourned at 7:35 p.m.
