MINUTES OF A REGULAR MEETING
Wednesday, May 13, 1981

The meeting of the Planning Commission was called to order by Chairman vanTemelen
at 7:50 p.m. in the Council Chambers of the Town Hall.
A. ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Commissioners Dochnahl, Kurano£f, Lachenbruch, Rydell, Stewart and
vanTamelen
Absent: Commissioner Carico

B. CONSENT CALENDAR:
It was requested by staff that Item #2, Acceptance of Tentative Map for
Filing; Matadero Creek Subdivision, File #TM 1-81, be postponed until the
meeting of May 27, 1981.
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Kurano£f
and seconded by Commissioner Dochnahl to approve the Consent Calendar, with
the removal of Item #2.
* NOTE: There were no public hearings to be set for May 27, 1981.
C. REPORT FROM CITY COUNCIL MEETING OF MAY 6, 1981:
Commissioner Rydell noted that he was not able to attend the meeting. Mr. Carlson
indicated actions taken by the Council are outlined under Section "D" of the
Agenda.
E. PUBLIC HEARINGS:
1. Lands of Betz, File #SA 3-81, 27751 Lupine Road, Request for Reccrmendation
of Site Approval.
Mr. Carlson reviewed his staff report dated May e, 1981, indicating that the
adjacent property is owned and resided on by the Betz family, which is a sub-
standard lot with respect to the Municipal Code, therefore, it must be enlarged
by taking land from the subject parcel. The Site Approval Map dated, "Received
May 7, 1981", shows the proposed lot line change. Mr. Carlson further indicated
`, that there are several dedications associated with the subject site approval.
** Note: On the map dated, "Received May 7, 1981", the instruction to remove
pavement near Lupine Road should be deleted.

The public hearing was then opened.
Mr. Alan Betz, expressed his concern over the pathway requested along the north-
ern portion of Lupine Road, indicating that this particular area is in a Swale,
he felt that it would be very impractical.
Mr. Silins, 27693 Lupine Road, questioned if he would be required to install a
new road to his property, and if he would eventually be land locked because of
this Site Approval.
Staff informed Mr. Silins that the existing road to his property, (which runs
over Betz property), would not have to be removed at this time.
Mrs. Fran Stevenson, Chairman Pathway Committee, explained that the path will
continue down Silins driveway, not Lupine Road, noting that the path is not a
major connector and would be located only on one side, further noting the path
request would be withdrawn.
It was the consensus of the Commissioners, staff and applicant to use the existing
driveway as access to Parcel "A".
The public hearing was then closed and commissioners began review of the conditions.
It was passed by consensus to add Condition I.E. as follows:
Condition I.E. The owner shall dedicate a thirty five foot (35') wide easement
along the centerline of the existing driveway across Parcels A and B, as shown
on the Site Approval Map. A Maintenance Agreement for the common driveway between
the two parcels of land shall be executed and recorded. The Agreement shall be
approved by the City Attorney.
It was passed by consensus to delete Conditions 4.A. and 4.B. Condition 4.0 was
renumbered as 4.A.
It was passed by consensus to add Condition 5.(c), Path in lieu fee of $300.00.
The total amount of the Conditions is then changed to $1,313.61.
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Lachenbruch
and seconded by Commissioner Kuranoff to recommend approval of the Lands of Betz,
File #SA 3-81.
2. Lands of Taaffe, File #TM 16-80, 12310 Concepcion Road, Newark & Associates,
Engineer, Acceptance for filing of -entative Map and Bequest for Recermendation
of Approval for Tentative Map and Negative Declaration.
Mr. Carlson noted that staff completed a review on April 29, 1981 for the
Negative Declaration and determined that this subdvision will not have sig-
nificant effect on the environment.
The Public Hearing was then opened for discussion of the Negative Declaration.

`. MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart
and seconded by Commissioner Dochnahl to recommend approval of the Negative
Declaration to the City Council.
Mr. Carlson referred to his staff report dated April 29, 1981, noting that
currently there is one residence and a construction yard with a Conditional
Use Permit. Items peculiar to this subdivision are: 1) Conditional Use
Permit; 2) swale down the east side of subdivision; 3) access; 4) existing
residence, and 5) prior to Final Map approval, the applicant must return and
request a Conditional Use Permit for Lots 3 and 4.
Commissioners Stewart expressed his concern over the
number of driveways off Concepcion Road. They questioned if this subdivision
could be serviced by a cul-de-sac. Staff informed Commission that originally
there was, but there were problems with grading and it would have pushed Lots
1 and 2, Building Area, into the swale.
The Public Hearing was then opened.
Mr. Jon Lynch, Nowack & Associates, indicated that the Taaffe's are considering
this property for estate planning only, and not intending to sell the lots at
this time. He further indicated that there were no objections to any of the
Conditions.
The Public Hearing was then closed and Commissioners began discussion and
review of the Conditions.
MOTION FAILED DUE TO LACK OF SECOND: It was moved by Commissioner Stewart
that a cul-de-sac be provided in lieu of driveways on Concepcion Road.
MOTION SECONDED AND FAILED: It was moved by Commissioner Stewart and seconded
by Commissioner Lachenbruch that ingress/egress, P.U.E. and S.S.E. easements
be increased to thirty-five feet (35') on Lots 2 and 5.
VOTE: Ayes: Commissioners Lachenbruch, Stewart and vanTamelen
Noes: Commissioners Dochnahl, Kuranoff and Rydell
Commissioners discussed Condition 5.A., the owner shall install a Type IIB
path along Concepcion Road. Staff informed Commission that the path should
be brought up to Town Standards. Commissioners Dochnahl and Stewart felt
the path fell below Town Standards, because the Town failed to maintain the
property.
MOTION FAILED DUE TO LACK OF SECOND: it was moved by Commissioner vanTamelen
to bring pathway up to Town Standards.
MOTION SECONDED AND PASSED: It was moved by Commissioner Rydell and seconded
by Commissioner Kuranoff to remove Condition 5.A.
It was passed by consensus to add Conditions 6.D., 6.E., and 6.F. as follows
Condition 6.D.: The owner shall install one (1) fire hydrant near the dead-
end of the proposed cul-de-sac.

Sw Condition 6.E.: Fences located on Concepcion Road right of way line
are subject to the following height limits:
1. three feet (3') for a fence with less than fifty percent (50%)
open area, (when viewed perpendicular to the plane of the fence).
2. four and one-half feet (9-1/2') for a fence with no less than fifty
percent (508) open area.
The maximum height of the fence increases with distance from the right
of way at the rate of one foot (1') of height for each ten feet (10')
of distance. In no case may a fence exceed a height of six feet (6')
between the right of way and the structural setback line.
Condition 6.F.: there shall be no vehicular access on Concepcion Road,
and Lot four to the abutting Reed property.
MOTION SECONDED AND FAILED: It was moved by Commissioner vanTamelen and
seconded by Commissioner Lachenbruch to add Condition 7.C., Path in -lieu
Fee of $1,800.00.
MOTION SECONDED AND PASSED: It was moved by Commissioner Rydell and seconded
by Commissioner Lachenbruch to recommend approval of the Tentative Map for
the Lands of Taaffe, File #TM 16-80, to City Council.
taw 3. Development Intensity and Building Height Ordinance:
The Commissioners briefly discussed the proposed ordinance, thereafter the
public hearing was opened for public discussion.
Mr. Charles Anderson, 26810 Ortega Drive, expressed his concern of T.V.
and radio antennas which exceed ttirty feet in height, indicating there
are many Towns people in violation of this ordinance.
Mr. Ken Pastrof, Al Woolworth, and Carl Munsey, Developers, questioned
Commission and staff on certain points of the proposed ordinance. Commissioner
Lachenbruch thoroughly answered all questions presented to Commission.
It was passed by consensus that staff include in the proposed ordinance, the
following: In the case of common driveways, only the portion of driveway
specifically used for each residence can be charged towards that residence.
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Kuranoff
and seconded by Commissioner Stewart to recommend approval of the proposed
Development Intensity and Building Height Ordinance. This ordinance will be
sent back to the City Attorney for changes and crsparation for public hearing
at Council level.
F. OLD BUSINESS:
1. Lands of Oskay, File #CUP 8029-78, Report from Assistant Planner
Ms. Webb referred to her staff report dated May 8, 1981, suggesting that the
Planning Commission use the prepared report outlining the reasons for revokation.

l Ms. Webb further noted that Condition I.E. was in violation.
�/ Mr. Oskay, owner, indicated the use of the driveway has only been used
for moving and emergency use.
Commissioners questioned Mr. Oskay if he intended to comply with the
Conditions and why this has been delayed. Mr. Oskay indicated that he
intended to comply with their requests.
Mr. Oktay Oskay, executer, indicated they are requesting an extension
to comply with this condition because there is no money in the estate
at this time; the court must approve all expenses before anything can
be started.
Commissioners indicated they are requesting that there be no vehicular
access to the secondary dwelling; and by removing driveway and gates,
and planting of trees, grass, etc. the appearance of a front yard would
be accomplished, and would eliminate violation to this condition.
Mr. Oskay agreed that he would remove driveway and plant trees to give
the appearance of a front yard.
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner
Rydell and seconded by Commissioner Kuranoff to grant Mr. Oskay a thirty
(30) day extension on Condition 1.E., with immediate compliance, with
respect to vehicular access. This item will return to the Planning
Commission at their regular meeting cf June 10, 1981.
G. NEW BUSINESS:
1. Commissioner Dochnahl asked Commission if they will participate
in the May 30th parade?
2. It was moved by Commissioner Stewart and seconded by Commissioner
Kuranoff to read into the minutes a letter from Mrs. Dorothy Price,
regarding the lights recently installed at the Veterans Hospital in
Palo Alto,
3. Commissioners requested that staff check into a residence on Country
Way that has lights for their sports court.
There being no further new or old business, the meeting was adjourned at
11:50 p.m.
