MINUTES OF A REGULAR MEETING
Wednesday, June 2d, 1981

The meeting of the Planning Commission was called to order by Chairman Rydell
at 7:30 p.m. in the Council Chambers of the Town Hall.
A. ROLL CALL AND PLEDGE OF ALLEGIANCE
Present: Commissioners Dochnahl, Kutanoff, Lachenbruch and Rydell
Absent: Commissioners Carico, Stewart and vanTamelen
Also Present: John A. Carlson City Engineer/Planner; Pat Webb Assistant
Planner; Leslie Penfold Secretary
B. CONSENT CALENDAR:
The Planning Commission minutes of June 10, 1981 were removed by
Commissioner Lachenbruch for corrections as follows: Page four,
8th paragraph, sentence one; after values and; 2) a plan be devised
for maintenanceand assurance of a adequate police. It was empha-
sized that this is an invitation to the Town to present such a plan
for review.
MOTION SECONDED AND PASSED: It was moved by Commissioner Dochnahl
and seconded by Commissioner Lachenbruch to approve the June 10, 1981
minutes.
PASSED BY CONSENSUS: It was moved by Commissioner Dochnahl and
seconded by Commissioner Lachenbruch to approve the remainder of the
Consent Calendar.
D. REPORT FROM CITY COUNCIL MEETING OF JUNE 15, 1981:
Commissioner Lachenbruch and Staff discussed the councils consideration
of the Development Intensity Ordinance; Mrs. Hillestad gave her congratu-
lations to Commissioner Dochnahl for his work on the parade; and Mr. Stewart
was re -appointed for another term on the Planning Commission.
E. PUBLIC HEARINGS:
1. Lands of Matadero Creek, File #TM 1-81, Page Mill Road at Alexis
Drive, Nowack & Associates, Engineers, Consideration of Tentative
Map, (continued from June 10, 1981 meeting).
Mr. Carlson reported that at the June 10, 1981 Planning Commission meeting
( _ the Commission recommended approval of the Negative Declaration and held
�I- the public hearing for the Tentative Map, Mr. Carlson reviewed the additional
information presented to the Commission, noting Exhibit #8, had been slightly
updated, and the Tentative Map was slightly changed to show common driveways
and balancing of lots, in addition there were several conditions added to the
Conditions of Approval.

The public hearing as opened and closed with no one speaking for or against the
( subdivision. Commissioners began a review of the Conditions of Approval.
60 MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Lachenbruch
and seconded by Commissioner Dochnahl to approve Section 1., entitled "LAND AND
EASEMENT DEDICATIONS", of the Conditions of Approval.
PASSED BY CONSENSUS: It was passed by consensus to approve Sections: 2, "FINAL
SOILS REPORT"; 3, "PUBLIC UTILITIES"; 4, "PATHWAYS"; 5, "WATER SYSTEMS".
CONDITION 6.A. MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by
Commissioner Lachenbruch and seconded by Commissioner Kuranoff to amend Condition
6.A. as follows: The owner shall install street improvements and utilities
as shown on the Tentative Map; the pathway should be separated by atleast three
feet (3') from berm of roadway.
PASSED BY CONSENSUS: It was passed by consensus to approve Condition 6.B. and
7.A.
MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by Commissioner Dochnahl
and seconded by Commissioner Lachenbruch to incorporate Column #4, entitled,
"Maximum Development Area", of the June 5, 1981 staff report as updated.
PASSED BY CONSENSUS: It was passed by consensus to approve Condition 7.C. as
amended. The first paragraph is amended as follows: The maximum height of
structures, landscape requirements, house orientation and other Site Development
criteria contained in Exhibit #8 shall apply to each lot, a summary of these
16 requirements are listed below.
The last paragraph was amended as follows: In addition to the house orientation
criteria above, the house location shall be restricted to the Building Site
Circle as shown on Exhibit #8 of the staff report.
PASSED BY CONSENSUS: It was passed by consensus to approve Condition 7.D.
CONDITION 7.E. Commissioners discussed Condition 7.E, relating to Design Review.
Commissioners Lachenbruch and Kuranoff gave a brief presentation of their Design
Review proposal dated June 9, 1981. Commissioner Lachenbruch made some minor changes
to the draft. Commissioners also discussed at what level the design review would
be handled, either Site Development or full Planning Commission.
PASSED BY CONSENSUS: It was passed by consensus to delete Section "E" of the
Design Review dated June 9, 1981. Under Section A.7, it should be changed to
read as follows: To encourage safe pedestrian/equestrian and bicyclists traffic
throughout the subdivision, while discouraging thru vehicular traffic within
the subdivision.
CONDITION 7.E. MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved
by Commissioner Dochnahl and seconded by Commissioner Kuranoff that Design
Review procedure satisfactory to the Planning Commission should be established
prior to approval of the Final Map. This procedure will be based upon
principles set forth in document designated "Design Review", dated June 9, 1981.
PASSED BY CONSENSUS: It was passed by consensus to add Condition 9.(d),
60 Parks and Recreation in -lieu fee in the amount of $6,618.53.
MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by Commissioner Dochnahl
and seconded by Commissioner Lachenbruch to recommended approval of the Lands of
Matadero Creek, File #TM 1-81.

2. Lands of Widman, File #TM 13-80, 26971 Moody Road, Sandie & Associates,
Engineer, Consideration of Tentative Map, (continued from June 10, 1981
L meeting).
Mr. Carlson noted this item was before the Commission at their June 10, 1981
meeting, where the commission recommended approval of the Negative Declaration
and held a public hearing for the Tentative Map. The Commission continued
this item due to the neighbors concern of the existing driveway, the City
Attorney was asked for his legal opinion on this matter. Mr. Carlson noted
that included in the packet was a memorandum from the City Attorney, indicat-
ing this matter was not a part of the subdivision and advised that the
Commission disregardthis item. Mr. Carlson noted the Conservation Easement
was now shown on the Tentative Map,
The Public Hearing was then opened.
Mr. Saudis, Engineer, asked if the removal of the cottage could be prolonged
as much as possible, and asked if a bond could be established with the Town
to ensure removal at a later date.
The Public Hearing was then closed.
Mr. Carlson informed Commission that in order to allow the cottage to remain,
a Conditional Use Permit would have to be issued; in regard to establishing a
bond, Mr. Carlson felt this matter would get too complicated. Commissioners
began discussion of the Conditions of Approval.
PASSED BY CONSENSUS: It was passed by consensus to add Condition S.B., to
read as follows: No trees greater than 4" shall be removed without prior
approval by the Site Development Committee.
PASSED BY CONSENSUS: It was passed by consensus to add Condition S.C., to
read as follows: The existing cottage indicated to be removed on the Tentative
Map, shall either be removed prior to Final Map Approval or a Conditional Use
Permit be obtained for the cottage to remain for a limited specified time period.
MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by Commissioner Kuranoff
and seconded by Commissioner Dochnahl to recommend approval of the Tentative Map
for the Lands of Widman, File #TM 13-80.
3. Lands of Ayer, File #SA 4-B1, West Sunset Drive and Robleda Road,
John Riley, Engineer, Request for recommendation of approval of
Site Approval.
Mr. Carlson referred to his staff report dated June 19, 1981, noting
this property is characterized by steep 30-40% slope, due to the steep
hillside, the design and construction of improvements is critical. Staff
is recommending the conclusions and recommendations of Dunham & Associates,
soils investigation dated May 1981,be part of the conditions of approval.
The public hearing was then opened.
Mr. John Riley, Engineer, noted instead of the usual conservation ease-
ment, the applicant is requesting a deed restriction defining the do's
and don'ts allowed in the restricted area.
The public hearing was then closed, and conmtissioners began a review of
the conditions of approval.

PASSED By CONSENSUS: It was passed by consensus to amend Condition 1.A..
as follows: The owner shall provide a twenty-five foot (251) driveway
�. access easement across lots 1 and 2 of Tract 3879. The owner shall pro-
vide sufficient easement for turnout purposes, located at the common
property line corners of lots 1 and 2 of Tract 3879.
PASSED BY CONSENSUS: It was passed by consensus to amend Condition 4.A.
as follows: Fencing shall be allowed between P.obleda Road and pathway
easement, excluding solid wood six foot (6') fence.
PASSED BY CONSENSUS: It was passed by consensus to amend Condition S.A.
as follows: Any modifications or changes to the deed restriction, shall
be approved by the Town.
MOTION SECONDED AND APPROVED UNANIMOUSLY: It was moved by Commissioner
Dochnahl and seconded by Commissioner Lachenbruch to recommend approval
of the Lands of Ayer, Site Approval, File #SA 4-81.
F. OLD BUSINESS:
1. Lands of Oskay, Status Report, File #CUP 8029-79
Ms. Webb reported the gates and posts had been removed and three small
trees had been planted in the driveway area.
Commissioner Lachenbruch asked staff what types of trees were planted
and if a vehicle could still pass thru the driveway area. Commissioner
Kuranoff noted he felt the area still looked like a driveway.
Mr. Warren Oskay, informed the Commission that he felt a vehicle could
not gain access.
Commissioners Dochnshl and Rydell suggested that Mr. Oskay plant a tree
in the middle of the former driveway area, not parallel with the drive.
It was passed by consensus to have this item return again at the July 8,
1981 meeting, staff is to recommend the type of tree that is to be planted.
2. Proposed Ordinance, Accessory Uses and Structures
Ms. Webb informed Commission that she checked and did not find any previous
ordinances or resolutions with regard to this proposed ordinance.
Commissioners briefly discussed this item and decided to continue to the next
meeting, so that other commissioners would be present for discussion.
3. Proposed Ordinance, Grading
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Kuranoff
and seconded by Commissioner Lachenbruch that No grading shall be permitted
except for construction of pathways and to allow driveways to cross the property
line. Staff is to send the proposed ordinance to the City Attorney for prepara-
tion of the ordinance.
G. NEW BUSINESS:
1. SB 1960 - regarding manufactured housing

�Ay Ms. Webb briefly reviewed Mr. Spangle's proposal, suggesting that the Town
rely on design review for all manufactured housing; a process to be handled
through Site Development Committee and the Planning Staff.
Commissioner Rydell requested that staff look into similar communities as to
what they are proposing and report back to the Planning Commission with this
information.
Mr. Carlson noted staff will inform the City Council that Commission and
staff are working on this project and request input for consideration.
2. Commissioner Lachenbruch suggested that the Pathway Committee look into
the pathway to be located on the Lands of Ayer, and check into the
extending connections on the Lands of Conn and McCullough.
There being no further new or old business, the meeting was adjourned at 10:46p.m
