HomeMy WebLinkAbout07/22/1981PLANNING COMMISSION Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING I Wednesday, July 22, 1981 94 Reel 0, Side II, Tract I, 150 -End; Side I, Tract II 000-280 The meeting of the Planning Commission was called to order by Chairman Rydell at 7:35 P.M. in the Council Chambers of the Town Hall. A. ROLL CALL AND PLEDGE OF ALLEGIANCE: Present: Commissioners Carico, Dochnahl, Lachenbruch, Rydell, Stewart vanTamelen Absent: Commissioner Kuranoff Also Present: John A. Carlson City Engineer/Planner; Pat Webb Assistant Planner; Leslie Penfold Secretary 1 E. CONSENT CALENDAR: The minutes of July 8, 1981 were removed by Commissioners Lachenbruch and vanTamelen for minor corrections as follows: Page Two, third paragraph, after six foot radius, add "around the trees". Page Two, fifth paragraph, after provision that, add "the portion not needed". Commissioner Lachenbruch questioned the minutes of June 24, 1981, page four, second paragraph, the Condition 4.A. of the Lands of Ayer was approved by the City Council at their meeting of July 1, 1981, as written in the minutes of June 24, 1981. MOTION SECONDED AND PASSED: It was moved by Commissioner Dochnahl and seconded by Commissioner Lachenbruch to approve the minutes of June 24, 1981 and July 8, 1981 as amended. PASSED BY CONSENSUS: It was moved by Commissioner Rydell and seconded by Commissioner Dochnahl to approve the remainder of the Consent Calendar, namely: 1. Setting of a Study Session for the meeting of August 12, 1981: Study Session by the Planning Commission to consider amendments to the Housing Element of the General Plan for the Town of Los Altos Hills. C. ACTIONS OF THE CITY COUNCIL MEETING OF JULY 13, 1981: Mr. Carlson reported that the City Council approved the Tentative Map for the Lands of Widman, File #TM 13-80. REPORT FROM CITY COUNCIL MEETING OF JULY 13, 1981: l Commissioner Carico reported that the City Council approved Mr. Woolworth's request to allow thirteen maximum lots on the Lands of Eshner on Julietta Lane and Altamont Road. This item was continued for discussion under "New Business". Mrs. Carico noted the Council discussed the Town Newsletter, noting that all items in newsletter would be pro and con on issues, and the Council felt a need for following a policy. E. SITE DEVELOPMENT APPEAL: 1. Lands of Wachs, File #A 5094; 27450 Sherlock Court, Consideration of an appeal of a Site Development Denial. Mr. Carlson reported that this application was before the Site Development Committee for request of a swimming pool. The request was denied because of the following: 1) proposed location is very visable from adjacent properties and offsite property; 2) a more suitable location for the pool is to the west of the residence, this area would require less grading and could be more easily screened; and 3) the pool is located in a graded area, there is no record of approval for the grading. Staff recommended denial. Mr. David Janssen, 27440 Sherlock Court, noted he was in favor of Mr. 6 Mrs. Wachs getting approval for their swimming pool, and further noted that the grading in question, was performed in 1959. Commissioner vanTamelen noted that the Site Development Commission denied the request because it would also be obtrusive to residences across the ridge; and asked Mr. Wachs if he would agree to building the pool on the west side of the residence. Mr. Wachs, 27450 Sherlock Court, noted that there are no complaints from the neighbors and they will be landscaping the pool for screening purposes, and asked that the Commission grant approval for the swimming pool in the proposed location. In regard to the pool west of the residence, Mr. Wachs noted the he would not like the pool in the front of the residence. Mrs. Wachs, 27450 Sherlock Court, noted they would like the pool in the rear of the residence for privacy, and noted they would be fencing and landscaping the lot when the pool is complete. Mrs. Lee Patmore, 27650 Central Drive, noted the impact of the residence is great, and is concerned with the screening of the residence and pool. MOTION SECONDED AND PASSED: It was moved by Commissioner Stewart and seconded by Commissioner Dochnahl to continue the Site Development Appeal for the Lands of Wachs, File #A 5094, until the following necessary documents are received by the Planning Department: 1. The Planning Commission shall reconsider the application after a landscape plan that complies with the spirit of the landscape policy of the Town is submitted for the entire property, this is to be prepared by a Professional Landscape Architect, and the applicant is to post a bond equivalent to 100% of the construction installation, and `, 2. The applicant is to submit a site plan showing contours of the lot and previous grading operations. Staff will obtain copies of the plot plan and landscape plan for the residence for review when this subject is placed on the Planning Commission Agenda. Lands of Matadero Creek, Tract 7197, Consideration of Design Review Mr. Carlson reported that Condition 7.E. of the Conditions of Approval states procedure of Design Review is to be established prior to Final Map Approval. Mr. Carlson briefly reviewed the items included in the July 16, 1981 staff report. ' Commissioners discussed who would be designated as the Design Review Board, Commissioner Rydell felt at this point it should be left up to the entire Planning Commission; after review of a couple lots, then the commission can appoint a committee to functionas the Design Review Board.Commissioners were in concurrence. Mr. Frank Saul, Via Ventanna, indicated to the Commission that a set o CC&R's are needed for the development and that the owners of the property usually handle the review board process, and it be evolved around to the new home owners in the subdivision. The Commission is the majority of the review board, with 3 other members participating. t Mr. Paul Reneau, 13149 Byrd Lane, would like the Environmental Design Committee to participate in the Design Review process. Mr. Reneau felt ` at this time it is very important to consider more specifics and details ' of Design Review. The Commission adopted as prepared with modifications the Design Review for Matadero Creek, staff will incorporate changes and suggestions and return with draft at the meeting of August 12, 1981. 2. Zoning: Mobile Homes (SB 1960) This item is regarding a memo from William Spangle dated April 23, 1981, Mr. Spangle recommends that the Town depend on Design Review to control adverse effects of mobile homes or manufactured homes in Los Altos Hills, and that the Town treat mobile homes the same as any other single family dwelling. Commissioner vanTamelen felt the Site Development Committee needed to be strengthened before this could be established, and the possibility of evening meetings should be considered so more commissioners could attend the meetings. Mr. Paul Reneau, 13149 Byrd Lane, felt the Matadero Creek Subdivision was a good stepping stone for starting Design Review, to act as a model to show good planning and design review, which could then be adopted for the whole Town, that could be a part of Site Development or Planning Commission process. Commissioners interested in participating in a small discussion meeting with Mr. Spangle should contact Mr. Rydell. Chairman Rydell noted he would contact Mr. Spangle and arrange a meeting. 3. Lands of Oskay, Status Report, File #CUP 8029-79, 25231 La Rena Drive Ms. Webb gave a brief review of the background relating to the Lands of Oskay, noting since our meeting of July 8, 1981, Mr. Oskay has planted a 15 gallon pine tree in the former driveway area. In reviewing the City Attorney's memo, there are no longer grounds for revocation of the CUP. Planning Commission Minutes of July 22, 1981 Page Four Lands of Oskay, (continued) ` Commission discussed with staff what the next step is for the CUP. Staff informed commission that a semi annual review is required, staff suggested that a condition be added to allow tighter charge of the use permit. Staff is to send a letter to Mr. Oskay, informing him that the CUP is contingent upon the care and keeping of the existing landscaping and that the $500.00 deposit will be returned as soon as possible. G. NEW BUSINESS: 1. Consideration of proposal for Zoning Permit Process Mr. Carlson reported that this item stems from the new ordinances passed by the Town, specifically Fencing and Development Area. It is a formalized procedure to ensure site development and building permits conform to the Zoning Code, it would also include CUP's and variances. Mr. Carlson asked commission if they had any changes or recommendations. Commission and staff discussed what type of structures would require a zoning permit. Staff was instructed to look at the advantages and disad- vantages of the zoning permit process, eliminating some of the problems foreseen, and return with a summary of this at the next meeting. 2. Eshner property Mr. Carlson reported that Mr. Woolworth proposed to the City Council that the convenant between the Town and Mr. Eshner be removed; the Council agreed that not more than nine lots be established and that Mr. Woolworth give $200,000. for open space elsewhere in the Town. 3. Proposed Housing Element Planning Commission received copies of the draft of the proposed Housing Element, dated July 22, 1981, from Spangle & Associates. This item was placed on the Agenda for a study session on August 12, 1981.
