MINUTES OF A REGULAR MEETING
Wednesday, September 23, 1981

Chairman Stewart called the Variance and Permit Commission to order at 6:30 P.m.
ROLL CALL:
Present: Commissioners Dochnahl, Stewart and vanTamelen
Absent: None
Also Present: Pat Webb Assistant Planner; Leslie Penfold Secretary
PUBLIC HEARINGS:
1. Lands of Wallace, File #VAR 2-81, 12400 Stonebrook Drive, Parcel "A",
APN 336-23-21, Request for recommendation of approval for variance for
a new residence.
Ms. Webb reviewed her staff report dated September 18, 1981, indicating this
' encroachment into the building
request is for a variance for
height limitation area (ordinance #268). The applicant has oriented the house
a maximum 15
to the south to maximize its functionality as a passive solar structure, they
have proposed a building height up to 30' that encroaches into the 15' building
height limitation area adjacent to both sideyard setbacks. Staff recommends
approval of this variance, based on the six findings of fact as outlined in
the September 18, 1981 staff report. Staff also recommends the addition of
2 conditions as outlined in the staff report.
commissioners discussed the variance request in relation to adjacent properties.
The public hearing was then opened.
Mr. Wallace, applicant, noted they are hoping to build a passive solar residence
and have looked at other alternatives, but they would not be as effective as the
one proposed.
The public hearing was then closed.
Commissioner vanTamelen noted she was concerned with the Rich's secondary dwelling
being so close to the property line and with this request being close to the
property line. Ms. Webb informed Commission the Rich's secondary dwelling was
45' from setback.
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Dochnahl
and seconded by Commissioner Stewart to recommend approval of the variance for
Lands of Wallace, File #VAR 2 -el, with conditions as outlined in staff report
dated September 18, 1981, as based on the six criteria for granting of a variance
as outlined in staff report dated September 18, 1981.
There being no further new or old business, the meeting was adjourned at 7:05 p.m.
